BUFFALO, NY – Earlier this year, ma Buffalo man shot and killed his neighbor’s dog with a shotgun. Today, he is being charged with a Class E felony for cruelty to animals.
Erie County District Attorney John J. Flynn announces that 58-year-old Timothy S. Manning of Buffalo was arraigned yesterday afternoon before Erie County Court Judge Susan Eagan on one count of Aggravated Cruelty to Animals, a Class “E” felony, one count of Overdriving, Torturing and Injuring Animals, a Class “A” misdemeanor, and one count of Discharge of a Shotgun, a violation of the City of Buffalo ordinance.
It is alleged that on April 16, 2020, at approximately 4:45 p.m., the defendant intentionally killed a neighbor’s dog on Buffum Street in the City of Buffalo by shooting it with a shotgun.
Manning is scheduled to return on Thursday, November 12, 2020 at 10:00 a.m. He remains released on his own recognizance.
If convicted on all charges, Manning faces up to 2 years in jail.
DA Flynn commends the Buffalo Police Department for their work in the investigation.
The case is being prosecuted by Assistant District Attorney Rachel Kranitz McPhee of the DA’s Animal Cruelty Unit and Assistant District Attorney Ryan Flaherty of the DA’s Felony Trials Bureau.
As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
