Swanborne Project Back on the Table, This Time with Six Apartment Buildings

JACKSON-Swanborne LLC which owns 158.8 acres that stretches from East Veterans Highway to South Hope Chapel Road to Whitesville Road has submitted a new application to the township zoning board.

In July, Swanborne submitted an application to build 195 single family dwellings on the property.

Now, the developer is trying to build a total of 232 dwellings, an increase of 37 units, this time to include six apartment units that will contain 46 affordable housing units.   The single family housing part of the project has been reduced by 10, to 185 units.


In 2009, Swanborne sued Jackson Township over the township’s pending zoning ordinance and the courts sided with the developer, stating the township’s zoning ordinance for the property was “ineffective”.

TOWNSHIP OF JACKSON NOTICE OF PUBLIC HEARING JACKSON TOWNSHIP ZONING BOARD OF ADJUSTMENT OCEAN COUNTY, NEW JERSEY PLEASE TAKE NOTICE that the Jackson Township(“Township”) Zoning Board of Adjustment (“Board”) will hold a public hearing on September 6, 2017, at 7:00 p.m. at the Jackson Township Municipal Complex main meeting room, located at 95 West Veterans Highway, Jackson Township, Ocean County, New Jersey or at such other time and place as the Board may adjourn to thereafter, to consider an application made by Swanborne, LLC (“Applicant” or “Swanborne”) for General Development Plan (“GDP”) for a proposed Major Subdivision and Major Site Plan, with Use Variance Relief pursuant to N.J.S.A. 40:55D-70(d)(1) and Density Variance Relief pursuant to N.J.S.A. 40:55D-70(d)(5), to permit a proposed residential development of 232 dwelling units, consisting of 185 market rate units on single family lots and 46 affordable units, and 1 property manager unit, within 6 apartment buildings on 3 separate lots, 4 stormwater management and open space lots, and a sanitary sewer pump station lot, and associated site improvements (“Application”), with regard to certain property known and designated as Lots 1, 8, 9, 10, 11, 12, 15, 16, 17, 18, and 28 in Block 20801, and Lot 3 in Block 20701, as shown on the Township’s Tax Map (“Property”). The Property is approximately 158.8 acres in size and bounded by East Veterans Highway (Ocean County Route 528) to the north, South Hope Chapel Road (Ocean County Route 547) to the east, and Whitesville Road (Ocean County Route 527) to the south and west, and is located in the Township’s Regional Growth 2 Zone (“RG-2 Zone”). Within this Application Swanborne seeks GDP approval for a proposed Major Subdivision and Major Site Plan. Swanborne proposes the phased development of the Property and anticipates seeking Major Subdivision and Major Site Plan approval by way of separate future applications. Pursuant to the Municipal Land Use Law, N.J.S.A. 40:55D-1 et seq. (“MLUL”), and the Township’s Land Use and Development Regulations (“Ordinance”) Chapter 224-29, Applicant requests a term of effect of 10 years for the GDP approval, which is permitted by the MLUL. In order to permit the improvements proposed within the Application Swanborne seeks variance relief pursuant to the MLUL and Ordinance. Specifically, Swanborne seeks: (1) “(d)(5)” Density Variance Relief to permit 232 total dwelling units and an overall density of 1.46 units per acre, and residential lots of 12,000 s.f., whereas the currently effective RG-2 Zone Ordinance permits 1.0 unit per acre and a minimum residential lot size of 1 acre if alternate treatment septic service or public sewer is provided. The density proposed by the Application is consistent with the Pinelands Comprehensive Management Plan, the Pinelands certified Township Master Plan, and Ordinance 08-17 which was recently enacted by the Township but has not yet received certification from the Pinelands Commission; and, (2) “(d)(1)” Use Variance relief to permit the construction of 46 rental housing units affordable to low and moderate income individuals and families within 6 separate 2-story apartment buildings, which is not a permitted housing type by Ordinance. Swanborne reserves the right to seek any such additional variance, waiver, exception, or other relief as the Board may deem necessary pursuant to the Ordinance and the MLUL without additional public notice. A copy of the Application and supporting documentation is on file in the Office of the Board Secretary located at 65 Don Connor Boulevard, Jackson Township, Ocean County, New Jersey 08527, and is available for public inspection during regular business days and hours. This Notice is given pursuant to the MLUL.
