Buffalo Child rapist gets 20 years in prison

Erie County District Attorney John J. Flynn announces that 36-year-old Dwaine Gozdziak of Alden was sentenced this morning before Erie County Court Judge Suzanne Maxwell Barnes to a determinate sentence of 20 years in prison followed by 20 years of post-release supervision. The defendant will be required to register as a sex offender upon his release.

The defendant was caught in the act of attempting to engage in sexual intercourse with a child victim at a location in the Town on Alden on April 3, 2020.

Gozdziak pleaded guilty, as charged, to one count of Attempted Rape in the First Degree (Class “C” felony) on July 23, 2020.

After a sentencing hearing, the defendant was adjudicated as a Second Child Sexual Assault Felony Offender. The defendant had previously been convicted of Lewd or Lascivious Battery in Florida for engaging in sexual intercourse with a 13-year-old victim when he was eighteen-years-old.


DA Flynn commends Detectives Scott Piel, Matthew Fuqua, Lee Richards, Christian Parisi, and Brian O’Hara of the Erie County Sheriff’s Office for their work in the investigation.
