Illegal immigrant charged with DWI, assaulting police officers

FREDERICK CO., MD – On Dec. 07, 2021, the Frederick Police Department arrested Juan Chica-Pereira, age 29, of Frederick, on charges including three counts of second-degree assault of three police officers, resisting arrest, possession of cocaine, possession of a controlled dangerous substance (fentanyl), and possession of paraphernalia. Additionally, he had 20 traffic citations including driving while intoxicated and hit-and-run.

Following his arrest, U.S. Immigration and Customs Enforcement (ICE) placed a detainer on Chica-Pereira through the 287(g) program at the Frederick County Adult Detention Center.

Chica-Pereira received his initial appearance for these charges before a District Court Commissioner who subsequently released him on his own recognizance. With the ICE detainer in place, officials transferred Chica-Pereira to the custody of the Immigration and Customs Enforcement.


The 287(g) program allows a state or local law enforcement entity to enter into a partnership with ICE, under a joint Memorandum of Agreement. The state or local agency receives delegated authority for trained officers to perform certain functions of immigration enforcement within the jail or detention center. In 2008, FCSO entered into a partnership with the Department of Homeland Security’s Immigration and Customs office to begin the 287(g) Program within Frederick County.
