ALBUQUERQUE, N.M. – Gregory Diaz, 34, of Farmington, New Mexico, was sentenced in federal court on Dec. 14 to three years and one month in prison for being a felon in possession of a firearm and ammunition. Diaz pleaded guilty on May 12.
According to the plea agreement and other court records, on Oct. 3, 2018, Diaz sold a .40 caliber pistol to an undercover law enforcement officer. At the time, Diaz has four previous felony convictions in the State of New Mexico, including possession of a controlled substance (methamphetamine), attempt to commit residential burglary, child abuse and possession of a firearm or destructive device by a felon. As a convicted felon, Diaz could not legally possess a firearm or ammunition.
Upon his release from prison, Diaz will be subject to three years of supervised release.
The Bureau of Alcohol, Tobacco, Firearms and Explosives investigated this case. Assistant U.S. Attorneys Jaymie L. Roybal and Jack E. Burkhead prosecuted the case.
