Jury convicts Buffalo man on gun charges after pot deal turned into shooting

BUFFALO, NY – A 29-year-old Buffalo man has been convicted of being a criminal in possession of an illegal weapon and acquitted of all other charges this week.

“Erie County District Attorney John J. Flynn announces that a jury has found 29-year-old Elmarious E. Honeycutt of Buffalo guilty of one count of Criminal Possession of a Weapon in the Second Degree (Class “C” violent felony). He was acquitted of all other charges against him,” District Attorney John Flynn said. “The jury rendered their decision yesterday afternoon after nearly four hours of deliberation following a 2 ½ day trial.”

According to court records and police reports, on July 14, 2019, at approximately 10:45 a.m., the defendant contacted the victim through social media to arrange a meeting to exchange marijuana.


“Approximately 30 minutes later, the victim and his girlfriend drove to Durham Street in the City of Buffalo to meet the defendant. When the defendant got into the backseat of the vehicle, a struggle ensued, resulting in the male victim being shot in the neck,” according to a release by the Erie County District Attorney’s Office. “After the shooting, the defendant fell out of the victim’s vehicle, recovered the handgun and ran from the scene, which was supported by video evidence. The girlfriend drove the victim to ECMC where he was treated for the injury.”

Honeycutt faces a maximum of 15 years in prison when he is sentenced as a second violent felony offender on Wednesday, May 25, 2022 at 2:00 p.m. He continues to remain held without bail.
