Buffalo Man Gets 3 Year Prison Term for Fight, Gun Charge

Erie County District Attorney John J. Flynn announces that 39-year-old Jonathan C. Caban-Jimenez, also known as Jonathan C. Caban, of Buffalo was sentenced yesterday afternoon before Erie County Court Judge Kenneth Case to 3 ½ years in prison followed by 1 ½ years of post-release supervision.

On November 21, 2020, at approximately 3:30 p.m., Buffalo Police officers responded to a 911 call for a reported fight inside of an auto mechanic shop on Hinman Avenue. When the officers entered the auto shop, they saw the defendant and another person on the ground in an apparent fight. The officers saw the defendant reaching for what appeared to be a firearm, that was partially visible from the defendant’s pants leg near his ankle, as he was being held down by the other individual. The officer removed the gun from the defendant’s pant leg and placed him under arrest.

The illegal pistol was loaded when the weapon was recovered by police. The gun was submitted to the Central Police Services lab for testing and found to be operable.

Caban-Jimenez pleaded guilty to one count of Attempted Criminal Possession of a Weapon in the Second Degree (Class “D” violent felony) on June 2, 2022. The defendant pleaded guilty to the charge on the morning jury selection was scheduled to begin in his upcoming trial.

The case was prosecuted by Assistant District Attorneys Nicholas C. Bussi and Nicholas J. Marino of the Felony Trials Bureau.
