Doctor Under Investigation After Performing Abortion On 10-Year-Old Drops Lawsuit Against AG

Dr. Caitlin Bernard, an Indiana OBGYN, rescinded her lawsuit against Indiana Attorney General Todd Rokita Thursday regarding an investigation Rokita conducted alleging that Bernard failed to correctly report the abortion she provided for a 10-year-old victim of rape.

Rokita’s investigation examined whether Bernard failed to correctly report the abortion to law enforcement as required by Indiana law and culminated in an Indiana Medical Board complaint against her for breaching patient privacy “when she disclosed her patient’s abuse, medical issues, and medical treatment to a reporter at an abortion rights rally to further her political agenda,” Rokita said in a statement, referring to the widely-publicized news story of which Bernard was the source. Bernard responded to the investigation by filing a lawsuit against Rokita for issuing subpoenas for medical records based on complaints from non-patients, according to NPR.


On Dec. 2, Marion County Judge Heather Welch ruled in favor of Rokita’s investigation but also stated that he breached confidentiality by informing the public that he was investigating Bernard before informing the Indiana Medical Board of his investigation, according to ABC 7 Chicago.

In an announcement on Thursday, Bernard’s attorney stated that they were dropping the lawsuit in order to “preserve our victory in court proving that the Attorney General violated Indiana law by publicly discussing the details of an investigation into Dr. Bernard which he was statutorily required to keep confidential at that stage,” according to CNN.

A spokesperson for Rokita told the Daily Caller News Foundation that Bernard dismissing the lawsuit after the judge ruled in Rokita’s favor was telling.

“[L]ess than a week after our win in court is further confirmation that she was putting her political agenda above the privacy and safety of her 10 year old patient,” the spokesperson stated. “At the same time any of the court’s extraneous verbiage about the attorney general’s comments didn’t have legal value as the court itself acknowledged.”

Rokita launched an investigation into Bernard on Jul. 26 after a number of “consumer complaints” were filed about Bernard providing an abortion for a 10-year-old who was reportedly raped by an illegal immigrant. Bernard has been an avid supporter of abortion rights and has been referred to as an abortion “activist,” according to CBS News.

Public records show that Bernard filed a report within two days of performing the abortion, according to ABC 7 Chicago.

Bernard did not respond to the Daily Caller News Foundation’s request for comment.
