Delaware’s seasonal ban on burning begins today

WILMINGTON, DE – Delaware residents are reminded that open burning is generally prohibited from May 1st to September 30th, known as “Ozone Season”, with some exceptions such as camping, cooking, and ceremonial fires. The state’s Open Burning Regulations prohibit certain types of burning at all times, and provide guidance for authorized burning under specific conditions.

Individual counties or the state fire marshal may also issue a ban against open burning activity, and the National Weather Service may issue a red flag warning due to unfavorable weather conditions that may result in dangerous fire conditions.

On Air Quality Action days, all open burning is prohibited when Delaware’s air quality is forecast as unhealthy. The Regional Air Quality Partnership provides air quality forecasts for ground level ozone and fine particulate matter, with ozone forecasts available from May through September.

Burning waste and garbage, fallen leaves and grass clippings, and material generated from land clearing are always prohibited. Open burning is defined as any outdoor fire or outdoor smoke producing process from which the products of combustion are emitted directly into the ambient air. This does not include incinerators, boilers, or heaters used in process operations.
