JACKSON, NJ – The Jackson Township council has approved the following four ordinances on first reading.
AN ORDINANCE OF THE TOWNSHIP OF JACKSON, COUNTY OF OCEAN, STATE OF NEW JERSEY, AMENDING AND SUPPLEMENTING CHAPTER 372 OF THE TOWNSHIP CODE OF THE TOWNSHIP OF JACKSON, ENTITLED “STREETS AND SIDEWALKS,” ARTICLE V, ENTITLED “STREET VACATION PROCEDURE,” AS TO AMEND §372-24(A) AND (B) ENTITLED, “APPLICATION PROCEDURE,”
NOW, THEREFORE, BE IT ORDAINED, by the governing body of the Township of
Jackson, County of Ocean, State of New Jersey, as follows:
The procedure for each applicant desiring to obtain the vacation of streets and roads by the Township Council shall be as follows:
A. Application shall be made in writing on forms provided by the Township Engineer, and said application shall include a map or sketch of the streets and roadways requested to be vacated.
B. Said application, supporting documents and information shall be submitted to the Township Engineer, together with a fee of $150 to defray administrative costs and direct expenses. In addition, the application shall contain the applicant’s agreement to defray all engineering costs and expenses caused to the Township of Jackson.
SECTION 2. All ordinances or parts of ordinances inconsistent herewith are hereby repealed.
SECTION 3. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held to be invalid or unconstitutional by a Court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions hereof.
SECTION 4. This ordinance shall take effect after second reading and publication as required by law.

NOW, THEREFORE, BE IT ORDAINED, by the governing body of the Township of
Jackson, County of Ocean, State of New Jersey, as follows:
SECTION 1. The Township Code of the Township of Jackson is hereby amended and supplemented to amend Chapter 372, entitled “Streets and Sidewalks,” article III, entitled “Street Openings,” as to amend §372-11(A) through (D) entitled “Prerequisites to Opening Street,” to read in its entirety as follows:
No person, firm, partnership or corporation shall open or dig a trench in any public road, street or highway of this municipality without first having done each of the following:
- Made a written application to the Township Engineer on forms to be provided by the Township Engineer, which application shall state the purpose thereof, such as an opening or excavation for sewer, water, gas, telephone, electric or any other purpose. Attached to the application shall be a sketch, in duplicate, showing the location and type of work to be done pursuant to the provisions hereof. The Township Engineer shall submit said sketch and the application to the Chief of Police or his designated representative. Upon approval by the Township Engineer and Chief of Police that said application is in compliance with all state and municipal laws and regulations, the permit shall be issued, subject, however, to any conditions which may be imposed by the Township Engineer or the Chief of Police, reasonably related to the health, safety and welfare of the Township residents and those who travel upon its road. Wherever in this article the Township Engineer or Chief of Police is designated, the reference therein may equally apply to any designated representative of the same.
- Paid the proper fee to said Township Engineer for such opening or trench as hereinafter determined.
- Given the Township Engineer a cash or surety company bond to guarantee that the opening or trench made by the permittee will be properly closed and the road, street or highway over the same and the surrounding improvements or facilities reconstructed so that it will remain in good condition for at least one year after the closing by the permittee.

- Received from the Township Engineer a written permit for the specific opening or trench.
A. Each applicant for a permit for such opening or trench shall post a cash or surety company bond with the Township Engineer to cover the estimated costs of closing and fully and completely restoring the particular opening or trench for which the application is being made, as well as to cover the repairs to any surrounding roadway, curbing, gutters, sidewalks, landscaping or other surrounding improvements or facilities which may have been damaged by the project, according to the following schedule of estimated costs:

B. Each such surety bond shall be executed by the permittee as principal therein, and the surety company shall be the surety therein, which surety company shall be one licensed to do business in the State of New Jersey. Maintenance of the bond shall be the responsibility of the Township Clerk.
SECTION 3. All ordinances or parts of ordinances inconsistent herewith are hereby repealed.
SECTION 4. AN ORDINANCE OF THE TOWNSHIP OF JACKSON, COUNTY OF OCEAN, STATE OF NEW JERSEY, AMENDING AND SUPPLEMENTING CHAPTER 185 OF THE TOWNSHIP CODE OF THE TOWNSHIP OF JACKSON, ENTITLED “EXCAVATIONS, MINING, AND DREDGING” AS TO AMEND §185-2(A) AND §185-2(E) ENTITLED, “APPLICATION, LICENSING,” AND §185-6(A) ENTITLED, “BOND,”
NOW, THEREFORE, BE IT ORDAINED, by the governing body of the Township of
Jackson, County of Ocean, State of New Jersey, as follows:
SECTION 1. The Township Code of the Township of Jackson is hereby amended and supplemented to amend Chapter 185, entitled “Excavations, Mining, and Dredging,” to amend §185-2(A) entitled, “Application, Licensing,” to read in its entirety as follows:
- An application for a license shall be made to the Township Committee by delivering such application and supporting documents to the Township Engineer in triplicate.
SECTION 2. The Township Code of the Township of Jackson is hereby amended and supplemented to amend Chapter 185, entitled “Excavations, Mining, and Dredging,” to amend §185-2(E) entitled, “Application, Licensing,” to read in its entirety as follows:
(E) Application requirements. Application for a license hereunder shall be made on a form furnished by the Township Engineer, which form shall be executed by the applicant and submitted with the appropriate license fee to the Township Engineer. The application shall be accompanied by a map or maps which indicate the following:
(1) The exterior lines of the land that will comprise the site of the mining or other activity hereunder.
(2) The lot and block numbers of all adjoining lands as shown on the Official Tax Map and an identification of the owners thereof.
(3) The existence of a permanently established bench mark approved by the Township Engineer.
(4) Contour lines showing elevations of the proposed mining site at the time of the application.
(5) Contour lines showing elevations as a result of the excavation, mining and removal of any natural mineral substance.
(6) Limits. The limits of the area to be mined or excavated, which area shall not in any one license term exceed:
(a) In the case of a license under §185-10 of this chapter, 400 acres.
(b) In the case of a license under §185-11 of this chapter, 50 acres to a depth not to exceed 10 feet below the surface of any adjoining property or road. These limitations of the area and depth to be mined shall not apply to any licensee operating under § 185-10 hereof, but such licensee shall also obtain a license under § 185-11 hereof.

(c) In the case of a license under §185-12 of this chapter, 10 acres.
(7) The location of all access roads and other roads adjoining the property.
(8) The location of all slopes created by the mining or excavation.
(9) The location of any artificial lakes that may be created as a result of the mining or excavation.
SECTION 3. The Township Code of the Township of Jackson is hereby amended and supplemented to amend Chapter 185, entitled “Excavations, Mining, and Dredging,” to amend §185-6(A) entitled, “Bond,” to read in its entirety as follows:
- Prior to the issuance of any license or renewal of a license under this chapter, the applicant shall submit a bond in an amount approved by the Township Engineer and the Township Committee wherein the owner, if not the applicant, and the applicant is principal and a bonding or insurance company licensed to do business in New Jersey is surety, the bond to run to the Township of Jackson, in the County of Ocean and State of New Jersey, its successors or assigns, and to be conditioned for the faithful performance of the conditions of this chapter. Once approved, the bond shall be submitted to the Township Clerk for maintenance.
SECTION 4. All ordinances or parts of ordinances inconsistent herewith are hereby repealed.
SECTION 5. ORDINANCE 2025-20
AN ORDINANCE OF THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF JACKSON, COUNTY OF OCEAN, STATE OF NEW JERSEY ESTABLISHING A 35 MPH SPEED LIMIT FOR GRAND BOULEVARD.
BE IT ORDAINED by the Township Council of the Township of Jackson as follows:
SECTION 1. At the request of the Jackson Township Police Department, the Township Engineer, T&M Associates has prepared a study to address the appropriate speed limit for Grand Boulevard between Bowman Road and Veterans Highway (CR 527 and 528). As a result of that study the Jackson Township Police Department and the Township Engineer have recommended to the Township Council that a 35 MPH speed limit be established
SECTION 2. Chapter 103-62 of the Township Code of the Township of Jackson establishes various speed limits for different streets.
SECTION 3. Chapter 103-62C be and hereby is amended to add an additional street which is subject to a 35 MPH speed limit as follows:
Grand Boulevard between Bowman Road and Veterans Highway (CR 527 and 528) and shall be included in Schedule XVIII set forth in Chapter 103-62.
SECTION 4. Severability. The various parts, sections and clauses of this Ordinance are hereby declared to be severable. If any part, sentence, paragraph, section or clause is adjudged unconstitutional or invalid by a court of competent jurisdiction, the remainder of the Ordinance shall not be affected thereby.
SECTION 5. Repealer. Any ordinances or parts thereof in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict.
