ORDINANCE NO. 2025-16

AN ORDINANCE OF THE TOWNSHIP OF JACKSON, COUNTY OF OCEAN, STATE OF NEW JERSEY, AMENDING AND SUPPLEMENTING CHAPTER 244 OF THE TOWNSHIP CODE ENTITLED “LAND USE AND DEVELOPMENT REGULATIONS, ARTICLE VII: PINELANDS AREA REQUIREMENTS”

BE IT ORDAINED, by the Township Council of the Township of Jackson, County of Ocean, State of New Jersey, as follows:

SECTION 1. The Township Code of the Township of Jackson is hereby amended and supplemented so as to amend Chapter 244, entitled “Land Use and Development Regulations,” so as to amend §244-87 entitled “PV Pinelands Village Zone” as follows:

  1. The following uses shall be permitted in the PV Pinelands Village Zone:
    1. No change.

    1. Churches and similar places of worship, parish houses and convents, subject to the conditions specified in § 244-115. Reserved.
    1. Public and quasi-public schools and institutions of higher learning which are not conducted as a business, subject to such uses being located on a lot with a minimum lot area of two acres and subject to the lot, use and structures adhering to all other requirements set forth for the PV Pinelands Village Zone. Reserved.

  • The following accessory uses shall be permitted:

  • Area, yard and building requirements shall be as follows:

(1) If a proposed dwelling is to be Any proposed use served by a standard septic system, the following standards shall apply:

  • Minimum lot area: 3.2 acres. Notwithstanding this requirement, no minimum lot area for a nonresidential use served by a standard septic system shall be less than that needed to meet the water quality standards of § 244-79G(4)(d).

  • Minimum lot area: one acre. Notwithstanding this requirement, no minimum lot area for a nonresidential use served by a nitrogen-reducing septic system shall be less than that needed to meet the water quality standards of § 244-79G(4)(e).

Dormitories, student residences and faculty residences shall be subject to the same standards as the secondary schools and higher learning institutions they serve. Reserved.
  • Bulk standards and design criteria for primary and secondary schools, higher learning institutions and accessory uses thereto, including dormitories, student residences and faculty residences.
    • General requirements.
      •  On an annual basis, where a dormitory, student residence, or faculty residence exists as an accessory or conditional use to a secondary school or higher learning institution, a yearly report shall be submitted to the Township indicating that such residents are or were students, faculty, or permitted family members associated with the primary institutional use during the prior year.

    • The lot on which the use is proposed, and the building(s) erected thereon shall conform to the following minimum bulk and area standards: bulk and area standards in Section C. above.
      • The minimum lot area shall be the same as required in the district in which the school or higher learning institution is to be located.

      • The following yard setbacks shall apply to both primary and accessory buildings, on interior lots:
        • Front, side, and rear yard setbacks shall comply with § 244-87C.
      • Unless otherwise addressed herein, all other bulk requirements of the underlying zoning district shall apply.

B. C. Area, yard and building requirements shall be as follows:

  • Minimum lot area: 3.2 acres. Notwithstanding this requirement, no such minimum lot area for a nonresidential use in the RD-1 Zone shall be less than that needed to meet the water quality standards of § 244-79G(4)(b)§ 244-79G(4)(d), whether or not the lot may be served by a centralized wastewater treatment or collection system.

SECTION 5. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions hereof.

SECTION 6. This ordinance shall take effect after second reading and publication as required by law.

NOTICE IS HEREBY GIVEN that the foregoing ordinance was introduced and passed by the Township Council on first reading at a meeting of the Township Council of the Township of Jackson held on the 13th day of May, 2025, and will be considered for second reading and final passage at a regular meeting of the Township Council to be held on the 27th day of May, 2025 at 6:30 p.m., at the Township Municipal Building, located at 95 West Veterans Highway, Jackson, New Jersey, at which time and place any persons desiring to be heard upon the same will be given the opportunity to be so heard.
