Insurers poised for US break on investment losses from high rates

SEATTLE (Reuters) – Some insurers operating in the United States stand to reap a windfall worth hundreds of millions of dollars from the relaxing of a 31-year-old rule on reporting interest rate-related losses, a Reuters review of regulatory filings and interviews with executives and analysts show.

U.S. regulators who met in Seattle on Sunday voted to change how insurers should recognize these losses after the industry lobbied for the move.

The change, whose scope and financial impact are first reported here, will free up cash which insurers can use to write new policies, invest in their business, or boost their share price through dividends and stock buybacks, according to their financial disclosures and analysts who cover them.

At least 23% of life insurers rated by credit ratings agency Fitch stand to benefit, because their interest rate maintenance reserves (IMR), which reflect gains or losses from interest rate changes, were negative as of the end of December. That is up from 8% a year earlier. A negative IMR forces insurers to tap pots of money they would have otherwise spent on their business or returned to shareholders.

The change, which would expire at the end of 2025 unless revisited, will allow insurers to realize some of these losses over time, rather than straight away, according to a draft of the proposal released by the National Association of Insurance Commissioners (NAIC).

The Reuters review, which included a search of the public filings of all insurers listed in the stock market as well as those rated by credit ratings agencies, shows the changes will be particularly advantageous for firms invested in long-term bonds. This is because bonds that were issued before the Federal Reserve raised interest rates more than 5 percentage points over the last year carry much lower rates, and insurers incurred losses when they sell them.

Among those insurers are Prudential Financial, OneAmerica Financial Partners, Principal Financial and Massachusetts Mutual Life Insurance Company, according to Fitch. In the case of Prudential, the reprieve would be worth more than $1.3 billion, according to the company’s disclosures. That compares to $1.8 billion in net fixed income-related losses Prudential recorded in 2022.

The NAIC’s move diverges with how banking regulators have approached the same issue. They do not give banks the option of deferring interest rate-related losses, fearing excesses that led to the 2008 financial crisis. Such losses were behind the collapse of major regional banks this year, including Silicon Valley Bank and First Republic Bank.

Some consumer advocates have criticized the NAIC for going ahead with the proposal. Edward Stone, a lawyer who has represented policyholders in cases where troubled insurance companies were liquidated, said the rule change would encourage more insurers to risk investment losses in order to juice returns.

“Insurance companies, for decades, have been trying to kick the can down the road. This is just another attempt by them to say we should get some sort of favorable accounting treatment,” Stone said.

An NAIC spokesperson said the change is in the interest of insurance policyholders, because they would make it easier for insurers to sell loss-making bonds to re-invest in higher-yielding ones, boosting their financial health.

A representative for the American Council of Life Insurers (ACLI), a lobby group that pushed for the change, said its intention is to harmonize the treatment of interest rate-related losses and gains. Under existing rules, insurers with a positive IMR realize the benefit over time, rather than immediately.

Insurers in the United States are regulated by individual states rather than the federal government, but the NAIC has said that all states will automatically adopt the change it backs. While the change sunsets in 2025, the NAIC is also considering a long-term tweak to the rules, insurers including Equitable Holdings and MetLife have said in filings with the U.S. Securities and Exchange Commission (SEC).

DEFERRING LOSSES

Following the rule change, insurers will be allowed to amortize interest rate-related losses over time equivalent to 10% of their statutory surplus. The statutory surplus is the difference between insurers’ assets and liabilities, money that can be used to pay policyholders in unforeseen circumstances.

The new regime has some safeguards. A key metric of an insurer’s financial health, its risk-based capital ratio, would have to be at least 300% after adjustments to be allowed to defer interest rate-related losses.

Prudential would have been able to reverse about $1.3 billion of $1.8 billion in bond losses last year had the new rules been in place, Chief Financial Officer Ken Tanji told analysts on the company’s second-quarter earnings call.

The change will also increase Prudential’s risk-based capital ratio to 409% from 383%, according to an SEC filing. Staying close to the 400% threshold is a target many insurers seek to achieve a better credit rating.

A Prudential spokesperson declined to comment beyond Tanji’s remarks.

A spokesperson for MassMutual, which along with Prudential, OneAmerica, and Principal Financial ranks among the insurers rated by Fitch that have the largest negative IMR balances, declined to comment on gauges of the company’s financial strength, such as its risk-based capital ratio. The spokesperson would only say that MassMutual had a negative IMR balance of $611 million as of the first quarter of 2023.

OneAmerica declined to comment, while Principal Financial did not respond to requests for comment.

Some insurers that do not carry large negative IMR balances also say they would benefit from having room to take more risk when hedging interest rates. Unum Group, which has “very little” negative IMR, would see little immediate financial impact from the change but would be able to be more flexible with its hedging program when it comes to accepting losses, chief financial officer Steven Zabel told analysts on August 2.

“That would be helpful to really ramp up the hedging program a little bit more,” Zabel said.

Russian central bank to hold emergency rate meeting as rouble tumbles

MOSCOW (Reuters) – Russia’s central bank will hold an extraordinary meeting on Tuesday to discuss the level of its key interest rate, it said on Monday, as the sharply weakening rouble prompted calls for higher borrowing costs.

President Vladimir Putin’s economic adviser rebuked the central bank on Monday as the rouble slid past 101 per U.S. dollar, blaming loose monetary policy in a sign of growing discord among Russia’s monetary authorities.

The bank, whose key rate is currently 8.5%, had been scheduled to hold its next meeting on rates on Sept. 15. The bank said it would announce the board’s decision at 10:30 Moscow time (0730 GMT).

The rouble pared its losses and firmed back to below 100 per U.S. dollar after the central bank announced Tuesday’s meeting.

Explainer-How Hunter Biden, Trump special counsels work independently

WASHINGTON (Reuters) -The appointment of an outside prosecutor to investigate President Joe Biden’s son Hunter means there are now three special counsel inquiries that could figure prominently in next year’s election.

Attorney General Merrick Garland tapped David Weiss on Friday to review whether Hunter Biden violated federal tax and gun laws. Weiss signaled that he would likely take the president’s son to trial.

Earlier, Garland appointed Jack Smith to investigate matters related to President Donald Trump’s efforts to cling to power after he lost the 2020 election and classified documents found in the Florida estate where he lives.

Garland also named a special counsel to review classified documents found in Biden’s home.

WHAT IS A SPECIAL COUNSEL?

Special counsels are appointed to handle sensitive cases – usually involving political figures or allegations of serious wrongdoing by the government – with more independence than is usually afforded to federal investigators.

Justice Department rules allow the attorney general to appoint one when the department would have a conflict of interest or when he or she decides that it would be in the “public interest” to have an outside lawyer handle an investigation.

The attorney general defines the scope of the investigation but the special counsel also has the power to investigate new crimes that occur during the probe, such as obstruction of justice.

Unlike other federal prosecutors, special counsels work without day-to-day control by the Justice Department. But the attorney general can still overrule decisions about how – or whether – an investigation should proceed.

WHAT POWERS DO THEY HAVE?

They have the powers of a federal prosecutor: supervising investigations, deciding whether to bring charges and, if so, taking those cases to trial.

They are required to follow the Justice Department’s internal rules, including policies that spell out how to decide whether to bring charges.

They also operate with more public scrutiny. Unlike with other cases, the attorney general must notify Congress if he or she overrules one of the special counsel’s decisions. And the special counsel must submit a report laying out the reasons for charging people or declining to do so. Those reports can become public, something that rarely happens in other federal investigations.

WHO CAN BE A SPECIAL COUNSEL?

Usually a special counsel is a lawyer brought in from outside the Justice Department. That was the case with Smith and with Robert Mueller, the former FBI director who investigated allegations that Trump’s campaign had conspired with Russia before the 2016 election.

But in some cases, attorneys general have appointed lawyers from within the agency to be special counsels to add heft to investigations they were already supervising.

WHAT EXPERIENCE DO WEISS, HUR AND SMITH HAVE?

Hunter Biden case: Weiss has been the U.S. attorney in Delaware since Trump appointed him to the post in 2018. He was a prosecutor in that office before taking the top job.

Biden Documents case: Robert Hur was the U.S. attorney in Maryland from 2018 to 2021. Trump nominated him for the job. He had been a federal prosecutor in Maryland, worked at Justice Department headquarters and as a partner at a private law firm.

Trump cases: Smith is a former federal prosecutor who led the unit responsible for investigating public corruption. In 2018, he became the chief prosecutor investigating war crimes in the Kosovo War.

HOW ARE THEY DIFFERENT FROM INDEPENDENT COUNSELS?

After the Watergate scandal, the government handled the most sensitive cases by appointing independent counsels.

Those lawyers worked with an even greater degree of independence than special counsels. The attorney general would seek their appointment, but they would be put in the job by a special panel of federal judges, and those judges could prevent the counsel from being fired.

When statute creating independent counsels expired in 1999 it was replaced by existing Department of Justice rules for appointing special counsels.

WHAT ARE THE CHARGES AGAINST HUNTER BIDEN? Hunter Biden was charged with two misdemeanor tax offenses and a felony firearm offense by Weiss in June, but a federal judge refused to accept a proposed plea deal.

The special counsel’s investigation could weigh on Biden’s 2024 reelection campaign, some Democrats say, because it has the potential to broaden to other issues.

Contagion fears spread as China property sector cash crunch intensifies

HONG KONG/BEIJING (Reuters) – China’s largest private real estate developer Country Garden is seeking to delay payment on a private onshore bond for the first time, the latest sign of a stifling cash crunch in the property sector, piling pressure on Beijing to step in.

Adding to worries about contagion risk, a major Chinese trust company that traditionally had sizable exposure to real estate, Zhongrong International Trust Co, has missed its repayment obligations on some investment products.

Analysts warned that a rise in default by trust companies, also known as shadow banks, which have strong ties to the domestic property sector, will further weigh on the world’s second-largest economy.

Anxiety about contagion risks is spreading through global markets, putting China’s government under mounting pressure to deliver support for the ailing real estate sector, which accounts for roughly a quarter of the economy.

Once considered a more financially sound developer, Country Garden’s woes could also have a chilling effect on homebuyers and financial firms, with more private developers close to a tipping point if Beijing’s support does not materialise soon.

The real estate sector has suffered tumbling sales, tight liquidity and a series of developer defaults since late 2021, with China Evergrande Group at the centre of the debt crisis.

Weak overseas demand, tepid domestic consumption and persistent problems in the property sector have been major factors in China’s struggles to mount a solid post-COVID recovery.

In a move that dealt a fresh blow to investors’ sentiment, two Chinese listed companies said over the weekend that they had not received payment on maturing investment products from Zhongrong International Trust Co.

Trust firms, or shadow banks, operate outside many of the rules that govern banks, channelling the proceeds of wealth products sold by banks to developers and other sectors that are unable to tap bank funding directly.

Concerns about the outsized exposure of China’s shadow banks – a $3 trillion industry, roughly the size of Britain’s economy – to property developers have grown over the past year as the sector lurched from one crisis to another.

JPMorgan in a research note on Monday said that rising trust defaults would drag down China’s economic growth by 0.3-0.4 percentage points directly, and that it expects a “vicious cycle” of real estate financing challenges.

“In addition to the apparent financial risks and their transmissions, the latest wave of defaults from wealth management firms on trust-related products is likely to cause some substantial ripple effects for the broader economy through wealth effects,” Nomura said in a separate note.

‘CRITICAL MOMENT’

A source with direct knowledge said on Monday that Country Garden has proposed to creditors to extend repayment for an onshore private bond due Sept. 2, with an outstanding of 3.9 billion yuan, by three years in seven instalments.

Country Garden declined to comment. In separate filings during the weekend, the developer said it would suspend trading in 11 of its onshore bonds from Monday, a move traders said usually signals plans to seek repayment extensions.

In September alone, Country Garden may need to repay more than 9 billion yuan ($1.25 billion) worth of onshore bonds, according to Reuters’ calculations.

The suspension of its onshore bonds followed a report by Chinese media outlet Yicai on Friday that the company was heading for a debt restructuring, after it missed payments of two dollar bond coupons due on Aug. 6 totalling $22.5 million.

The developer’s shares dived 18.4% to HK$0.8 on Monday, dragging down the Hang Seng Mainland Properties Index which dropped 3.7%. The stock has lost 50% so far this month.

Country Garden’s offshore bonds also eased, with a few trading at the lower end of 6 cents on the dollar earlier. Most have since firmed slightly.

Its woes are adding to spillover concerns across a property market already grappling with weak buyer demand.

“The problems in the sector have been brewing for a long time, it wiped off the wealth effect among investors and no one wanted to buy property now,” said Dickie Wong, executive director at Kingston Securities.

Wong said the sector’s impact on the economy has reached a “critical moment” and that regulators should implement more policies including further cutting interest rates and reserve ratios.

China’s economy grew at a frail pace in the second quarter as demand weakened at home and abroad, prompting top leaders to promise further policy support and analysts to downgrade their growth forecasts for the year.

State-owned China Jinmao said in a filing on Sunday it expected to post a 80% decline in net profit in the first half of this year, due to a drop in gross profit margin in some projects and a decrease in land development revenue.

Its Hong Kong-listed shares slumped 4.1% on Monday.

China’s Country Garden woes raise fears of REIT defaults – J.P.Morgan

(Reuters) -Turmoil at China’s largest private developer Country Garden could set off a “vicious cycle” of financing stress on the country’s real estate investment trusts (REITs), brokerage J.P. Morgan warned on Monday.

The brokerage flagged issues at Chinese conglomerate Zhongzhi Enterprise Group, after two Chinese listed companies said they had not received payment on maturing investment products from its unit, Zhongrong International Trust.

REITs would be forced to dip into their profits if they fail to honor payments on debts, analysts said, putting at risk nearly 2.8 trillion yuan ($385.78 billion) worth of assets under the management.

These fresh worries come as Country Garden sought to delay payment on a private onshore bond for the first time and suspended trading in 11 onshore bonds.

“Unlike banks, which have holding power and are able to roll over credit to wait for an eventual resolution, alternative financing channels such as trusts may default once trust investors are unwilling to roll over the products,” J.P.Morgan analysts led by Katherine Lei said in a note.

“The default events may lead to a chain reaction on developer financing, adding stress to POE (privately owned enterprise) developers and their creditors.”

China’s property sector has been grappling with a liquidity crunch since late 2021 when China Evergrande Group collapsed and triggered a series of debt defaults.

Rising trust defaults would drag economic growth by 0.3-0.4 percentage points directly, J.P.Morgan warned.

“Beijing has already done some things to ease the tensions in the property sector, but it has been too slow and too little,” analysts at Nomura said, adding that China will be compelled to take more steps.

A cut to the reserve requirement ratio and a “small-scale” government bailout program for local-government financing vehicles could be some of policy routes, J.P.Morgan analysts said, but they do not see large-scale monetary easing or fiscal stimulus.

Little-known Kakar sworn in as Pakistan’s PM to oversee elections

KARACHI, Pakistan (Reuters) – Anwaar-ul-Haq Kakar, a little-known politician who is believed to be close to the military, was sworn in as Pakistan’s caretaker prime minister on Monday to oversee national elections as the country navigates political and economic crises.

Kakar, from the southwestern province of Balochistan, will name a cabinet and head a government until a new administration is elected. He was sworn in by President Arif Alvi on Monday in a ceremony at the Presidency.

He resigned as a member of senate and from his party on Sunday. He was part of the Balochistan Awami Party, which is widely considered to be close to the country’s powerful military.

“Owing to the fundamental responsibility conferred upon me as the caretaker prime minister, I have decided to surrender my membership of the Balochistan Awami Party (BAP) and relinquish my Senate position. Prayers requested from everyone,” Kakar, 52, said on Sunday.

The military continues to have a huge role behind the scenes in Pakistan. It has ruled the country directly for more than three decades of its 76-year existence, and wields significant power in politics.

Political analysts say that if the caretaker set-up stretches beyond its constitutional tenure, a prolonged period without an elected government would allow the military to consolidate control.

Under Pakistan’s constitution, a neutral caretaker government oversees national elections, which must be held within 90 days of the dissolution of the parliament’s lower house – which in this case means early November.

However, the ballot may be delayed as the Election Commission has to draw new boundaries for hundreds of federal and provincial constituencies and, based on that, it will give an election date.

Outgoing opposition leader Raja Riaz told broadcaster Geo News that he believed elections would take place in February next year and not as scheduled before November.

The choice of caretaker prime minister has assumed greater importance because the candidate will have extra powers to make policy decisions on economic matters.

Economic stabilisation is the top challenge with the $350 billion economy on a narrow recovery path after an ongoing $3 billion International Monetary Fund bailout averted a sovereign debt default. Economic reforms have already fueled historic inflation and interest rates.

Political uncertainty is also a factor after the jailing of former prime minister Imran Khan and his ban from standing in the election. His continued detention will raise questions about the credibility of the election.

AMC stock sinks, preferred units climb after conversion settlement

(Reuters) – AMC Entertainment’s shares slid 35% on Monday on fears that the approval of a revised stockholder settlement will allow the company to issue more shares to raise capital, a move that will dilute the worth of each common share.

The common shares dropped to $3.45, levels just before the meme stock mania of January 2021 when retail traders hyped up the stock on online forums like Reddit.

The preferred stock units called “APE”, which trade at a significant discount to common shares, jumped 15% to $2.05.

Under the settlement, AMC will provide stock worth an estimated $129 million to common shareholders to settle potential legal claims related to a stock conversion plan.

The approval comes just three weeks after the judge rejected a prior version of the settlement.

The ruling allows AMC to follow through with a plan, announced in March, to convert preferred share units into common stock, a one-for-ten reverse share split and potentially sell more shares to help pay down some of its $5.1 billion debt.

The reverse stock split is expected to take effect on Aug. 24, AMC said on Monday, with “APE” ceasing to trade from Aug. 25, while its Class A common stock is expected to increase to 550 million from about 524 million.

“The concern for common stockholders is that they are getting diluted to oblivion by the preferred for starters and that they will be diluted more after additional capital raises – if successful,” said Thomas Hayes, managing member of Great Hill Capital LLC in New York.

Wedbush analysts said they expect AMC and APE shares to converge around $3 per share before the conversion.

CEO Adam Aron called the ruling a “significant milestone” on X, formerly known as Twitter.

AMC, which was at the heart of the meme stock mania in 2021, launched preferred “APE” units as a special dividend last year in a nod to retail investors who call themselves “apes” on social media such as Reddit and Twitter.

Aron said the company has raised $418 million in cash through the sale of “APE” units over the past 12 months.

AMC was sued earlier this year by some investors who alleged the company was attempting to circumvent the will of common stock holders who opposed the company diluting their holdings.

The world’s largest movie theater chain last week reported a surprise quarterly profit as movie theaters saw a gradual revival following an uneven recovery from pandemic lows.

“This gives AMC an opportunity to fund longer term growth, despite the short term hit to stock,” said JJ Kinahan, chief executive officer of IG North America.

Argentina raises interest rate, devalues peso after shock primary election -official source

BUENOS AIRES (Reuters) – Argentina’s central bank will raise the benchmark interest rate to 118% from 97% previously, an official source said Monday, adding the country’s currency will be devalued to 350 pesos per dollar in the aftermath of a shock primary election.

Sunday’s primary vote, seen as a reliable bellwether for the upcoming presidential elections, propelled ultra-right libertarian outsider Javier Milei, who wants to axe the central bank and dollarize the economy, to first place with some 30% of the vote.

The official peso plunged nearly 18% on Monday morning to just over 350 pesos per dollar and the source said the exchange would be fixed at this rate until the October presidential vote.

Latin America’s third-biggest economy is battling a severe economic crisis with sky-high inflation and dwindling central bank reserves.

Man Fatally Shot in Old North Dayton

DAYTON, OH – Early Saturday, in Old North Dayton, a man lost his life after a reported shooting incident.

Based on information from the Montgomery County Regional Dispatch, Dayton Police were alerted around 3:23 a.m. and made their way to the area of Leo Street.

Responding to a shooting report, they discovered a man who had reportedly been shot.

The injured individual was transported to Miami Valley Hospital but was declared deceased upon arrival.

Dayton Police have taken an alleged suspect into custody, and currently, the incident remains under examination.

One Dead in Shooting in Elizabeth

ELIZABETH, NJ – A burst of gunfire disrupted the early hours in Elizabeth, near North Broad Street and Magnolia, just before 3:30 a.m.

When Elizabeth Police arrived on the scene, they found a male from Somerset County gravely injured from bullet wounds to his head.

He was declared deceased shortly after the shooting.

As the Elizabeth Police worked on setting up a crime scene to investigate the motive behind the attack, the Union County Prosecutor’s Office has since taken over the investigation.

Presently, no other injuries have been reported from the incident.

The good news is, you can get drunk on Dunkin’. The bad news for New Jersey is, for now, you will have to travel to New York to get it initially.

As reported by VinePair, Dunkin’ is collaborating once again with Harpoon Brewery to create this unique line of beverages. Together, they’re set to unveil Dunkin’ Spiked Iced Teas and Dunkin’ Spiked Iced Coffees. This comes after the successful partnership on the Dunkin’ Harpoon beer and receiving approval for the Dunkin’ Spiked product labels from the Alcohol and Tobacco Tax and Trade Bureau.

These flavorful beverages are flavored malt beverages, fermented primarily from sugar, giving them a sweet and satisfying taste.

Both the iced teas and iced coffees contain real tea and coffee, so they do have some caffeine. The teas contain between 15 and 30 mg per 12 oz serving, depending on the flavor, while the iced coffees contain about 30 mg per 12 oz serving. That’s less caffeine than a typical coffee, so you’ll get a gentle boost without the jitters.

These spiked beverages are not gluten-free since they contain a small amount of gluten-containing grain (malt).

Where can I buy Dunkin’ Spiked?

The Dunkin’ Spiked Iced Teas are shipping now, and the Spiked Iced Coffees will be available starting in September. They are launching in several states including Connecticut, Delaware, Florida, and New York, with more states coming in 2024 and beyond. However, these beverages will NOT be available in Dunkin’ restaurants, but you can find them in grocery stores, liquor stores, bars, and restaurants.

Canoo finalizes incentive package with Oklahoma, Cherokee Nation

(Reuters) – Electric-vehicle startup Canoo said on Monday it finalized incentive agreements with the state of Oklahoma and the North American tribe Cherokee Nation, for an estimated value of $113 million over 10 years.

As part of the agreements, Canoo said it has already started hiring for its vehicle assembly facility in Oklahoma City and the battery manufacturing factory in Pryor.

The company said the agreement with the Department of Commerce will enable Canoo to receive performance-based payouts and make it eligible for some state tax credit and exemption programs.

Canoo, which will invest more than $320 million at both its facilities in the state, had entered into a long-term lease agreement for the vehicle manufacturing facility in Oklahoma City earlier this year.

Analysts expect the startup to report a loss of about $75 million when it reports second-quarter results after markets close on Monday, according to Refinitiv data.

Hunter Biden’s lawyers wrote in a court filing Sunday night that the terms of his plea deal and pretrial diversion agreement were “largely dictated” by Department of Justice (DOJ) prosecutors.

The deal, rejected by Judge Maryellen Noreika, would have had Biden plead guilty to two misdemeanor tax charges and enter a diversion agreement allowing him to avoid jail time for a felony gun charge. Noreika’s questioning during the July 26 hearing brought to light a section of the diversion agreement that included a promise of broad immunity for any crime referenced by the attached statement of facts, which outlined payments Biden received from his business dealings in China, Ukraine and Romania.

“[A]s is customary in negotiated resolutions, prosecutors (and not the Defendant or his counsel) proposed and largely dictated the form and content of the Plea and Diversion Agreements,” Hunter Biden’s lawyers told the judge in a filing Sunday night. “This is true with respect to the form in which the documents were presented to the Court (i.e., as two separate and independent agreements), as well as the express

language of paragraph 15 of the Diversion Agreement (the so-called immunity provision). Throughout the settlement process the Defendant and his counsel negotiated fairly and in good faith with the prosecutors.”

Moreover, Hunter Biden’s lawyers asserted that “the parties have a valid and binding bilateral Diversion Agreement.”

His lawyers also noted their understanding of the scope of immunity being offered—a detail the parties disputed during the hearing—was informed by prosecutors’ “written and oral communications” during negotiations.

“The Defendant’s understanding of the scope of immunity agreed to by the United States was and is based on the express written terms of the Diversion Agreement,” they continued. “His understanding of the scope of immunity agreed to by the United States is also corroborated by prosecutors’ contemporaneous written and oral communications during the plea negotiations.”

Prosecutors said in a motion Friday that a trial is likely in Hunter Biden’s case, describing plea deal negotiations as “at an impasse.”

“The Government now believes that the case will not resolve short of a trial,” they wrote in a court filing.

U.S. Attorney David Weiss, the prosecutor who has been investigating criminal allegations against Hunter Biden, was also appointed as special counsel in the case Friday.

The latest victims of the Biden administration’s hunt for conservatives are Catholics, or as the FBI apparently regards them, “radical, traditional Catholics.” Republican Rep. Jim Jordan of Ohio has been a voice in the wilderness demanding accountability for this apparent government abuse.

As Daily Caller has reported, FBI Director Christopher Wray’s initial testimony, that the FBI operation surveilling Catholics was limited to a “field office in Richmond” was incorrect, given that there were similar FBI operations in Los Angeles and Oregon. Furthermore, the FBI relied on “at least one undercover employee,” according to the House Judiciary Committee’s press release. Based on these revelations, Jordan has subpoenaed FBI Director Christopher Wray for related documents. At issue are Americans’ most basic First Amendment rights and religious freedom.

In his previous testimony in July, Wray deployed a familiar Washington trick: He sought to put the issue to rest by claiming that there is an “ongoing investigation.” In this case, the phrase du jour is “internal review.” This is to say that the FBI is investigating itself.

“It was a single product by a single field office in Richmond,” Wray assured Jordan in his testimony before the House. However, Wray has blocked the House Judiciary Committee from interviewing the relevant agents in that field office in Virginia. Now that the unredacted memo shows the FBI operation against Catholics was larger than Wray claimed, we have a real scandal on our hands.

“Do you think priests should be informants inside the Church, Director?” Jordan asked Wray incredulously during that hearing. Jordan did not appear amused by Wray’s arrogant performance, nor was he reassured by Wray’s promise to investigate himself. The indefatigable Jim Jordan saw right through Wray’s obfuscation, and the evidence now proves that Jordan was correct in his skepticism of the FBI. Wray claimed to be “aghast” at the incident, yet given his eagerness to minimize and even mischaracterize what happened, he can hardly be considered a partner to the House Judiciary Committee in finding the truth.

Simply put, it is unacceptable to investigate Catholics for being Catholics, whose only crime is apparently that they are not liberals. Yet in the view of Merrick Garland’s DOJ, they just might be “extremists.” This has been Garland’s MO since the beginning: those who he perceives as opposed to the Biden admin are all but assumed to be terrorists. Given Biden’s rhetoric, he likewise regards anyone who voted for Trump as an extremist, which one must emphasize refers to about half the country.

Biden frequently invokes “MAGA extremists,” as though to say that any Republican is a potential terrorist, unless they renounce the de facto leader of the Republican party and former president. That is not exactly a unifying message coming from Biden, who after all promised “not to divide but to unify.” One might see the FBI’s persecution of Catholics as downstream from Biden and Garland’s characterization of anyone who opposes them politically as a “domestic extremist.” In this climate, it is easy to see how civil rights abuses, such as those apparently committed by the FBI, might occur.

For all the energy Democrats put into investigating things that don’t exist, such as Russia collusion, House Republicans are deploying their resources to investigate real government abuses. Though these abuses do not appear particularly interesting to Director Wray, they have grave implications for our Constitutional rights and our civil liberties.

New Jersey Announces Sales Tax Holiday for Back to School Shopping: What You Need to Know

TRENTON, NJ – New Jersey shoppers gearing up for the back-to-school season are in for a budget-friendly boost. The state is offering a Sales Tax Holiday from August 26 through September 4, 2023, providing temporary exemptions on various school-related retail purchases.

Here’s everything you need to know.

Tax-Free Items

The Sales Tax Holiday applies to certain items purchased for non-business use. This includes computers priced under $3,000, school art and computer supplies under $1,000, school instructional materials, general school supplies, and sports or recreational equipment. A comprehensive list of eligible items can be found online.

No Purchase Limits or Exemption Certificates

There is no restriction on how many eligible items a customer can buy during this period, and sellers are not required to obtain exemption certificates for sales of eligible items.

Coupons and Discounts

Store discounts and coupons can be applied to reduce the price of computers and computer supplies that meet the price criteria. However, manufacturer’s coupons and rebates will not make an item eligible for the exemption.

Sales of Bundled Items

Items normally sold together as a single unit cannot be priced and sold separately to qualify for the exemption.

Rain Checks and Exchanges

Items purchased using a rain check are exempt only if redeemed during the Sales Tax Holiday. Exchanges of eligible items for different sizes or colors remain tax-free even if made after the exemption period. Return policies have specific guidelines based on timing and the nature of the exchange.

Computers Exceeding Price Threshold

Computers that exceed the price threshold of $3,000 do not qualify for the exemption, and Sales Tax will be charged on the entire sales price.

Delivery Charges

Delivery charges are considered part of the sales price, and if all items in a shipment are eligible, the delivery charge is not taxable. If a shipment includes eligible and taxable items, tax must be allocated accordingly.

Order Acceptance and Back Orders

An item is exempt if ordered, paid for, and accepted by the seller during the exemption period, even if there are delays in shipment. Delayed shipments requested by the customer do not qualify as immediate shipment.

Time Zones and Incorrect Sales Tax

The time zone of the seller’s location determines the Sales Tax Holiday period. If Sales Tax is incorrectly charged on an exempt item, customers can request a refund from the seller or the Division of Taxation within four years, providing necessary documentation.

“From her leadership as Executive Director of The Leaguers to her time as President of the East Orange School Board, to her service as an Essex County Commissioner, to her tenure as Speaker of the General Assembly, to her role in my administration, as Lieutenant Governor and Commissioner of the Department of Community Affairs,” Governor Murphy said in a speech about Oliver’s dedication to service. “No matter the office, Sheila won whatever victory she could for the forgotten families of our state.”

Now, Murphy must decide who to appoint to replace her. The spot, since it was created has been filled by women. Former Lt. Governor Kim Guadagno was the first, under Governor Chris Christie. Murphy chose Oliver to be his running mate in his 2017 election.

Senator Nick Scutari has been acting governor since Oliver’s death and is doing a decent job. He could be a choice and is a close ally of Murphy. The governor may see Scutari as a better fit for keeping the Senate in order inside the State House.

According to Insider NJ, the state’s second most powerful female Democrat is his wife, Tammy Murphy. That is highly unlikely, but as they say, you never know.

Fran Ehrart, Peg Schafer, and Iris Delgado are among the Insider NJ’s most influential people in New Jersey list. All are Democrat party operatives.

Murphy could also turn to Congresswomen Mikie Sherrill and Bonnie Watson Coleman.

At this time, Murphy has not made any indications about his replacement for Oliver, and if we know anything about the governor, we should expect the unexpected.

Her replacement is expected to fill the void of inclusion and equity within the governor’s administration.

Indonesia says Tesla plans to invest in battery material facility

JAKARTA (Reuters) – Indonesia said on Monday that U.S. electric carmaker Tesla plans to invest in the manufacturing of battery materials in the Southeast Asian country and will make an announcement in the next few months.

Indonesia has for years been wooing Tesla to invest in battery making and car manufacturing in the country, trying to leverage its rich reserves of nickel, which can be processed for use in electric vehicle (EV) batteries.

Senior minister Luhut Pandjaitan in a post on Instagram said he led an Indonesian delegate that held a meeting with Tesla’s Chief Executive Elon Musk during a recent trip to San Francisco, when Musk told him about the investment plan.

“He wants to invest in the manufacturing of materials for lithium batteries,” Luhut said, though he noted Tesla was not looking to build a car factory in Indonesia.

“The investment will be quite big. Let’s wait for Elon to come here around the end of September or October this year,” he said.

Musk will also bring the internet to some remote corners of Indonesia with Starlink, his satellite communications service, Luhut said.

Tesla did not immediately respond to a request for comment. Starlink could not be contacted.

Indonesia said last week that it would give automakers two more years to qualify for EV incentives, trying to attract more investment as it races with Thailand and India to build an EV industry as an alternative to China, the world’s largest producer.

President Joko Widodo in an interview with Reuters in February expressed confidence that Tesla will invest in his country. However, no announcement from the car company so far has raised doubts.

GLOVER, MD – The Baltimore County Police Department has issued a critical missing person alert for 15-year-old Marie Glover, last seen in the Towson area on August 13, at 5:30 p.m.

Marie, who stands at 4’11 and weighs 130lbs, was wearing a gray shirt and black pants at the time of her disappearance.

She may have traveled to the Essex area.

Authorities urge anyone with information regarding Marie’s whereabouts to call 911 or contact the Baltimore County Police Department at 410-307-2020.

More Power Problems for Toms River, Lights Out Again

TOMS RIVER, NJ – Power problems have become a persistent issue in Toms River, with a series of long-term power outages plaguing the township over the past two weeks. Weather events and traffic crashes have been cited as the primary causes, leading to growing concerns from local officials.

Most recently, a power outage near the Tunney Bridge resulted in multiple traffic signals going dark, leading to increased traffic woes.

The Toms River Police Department urged residents to be patient while Jersey Central Power & Light Company (JCP&L) worked to resolve the issue, and expressed gratitude to the linemen who work to respond to these outages.

The reason for the current outage was not revealed. Power was reported out at around 6 am Monday morning.

UPDATE: The outage is no longer reported on the JCP&L Outage Map.

Commissioner Joe Vicari has expressed serious concerns about these repeated outages and has highlighted broader issues with the electrical grid in Toms River. In a letter to Joseph L. Fiordaliso, President of the New Jersey Board of Public Utilities, Vicari emphasized the challenges faced by Ocean County, particularly given its status as a leading tourism destination and home to the largest senior population in the state.

Vicari’s letter outlined the growing reliance on electricity for daily life and the increase in severe storms, questioning whether the existing electric power sources would be sufficient to keep residents and visitors safe.

Ocean County relies on Jersey Central Power & Light Company and Atlantic City Electric for its electric power needs. Vicari emphasized the need for these companies to update policies and enhance the power grid’s reliability. He stressed the importance of designing a sustainable infrastructure with strong resiliency to minimize disruptions for residents and visitors.

Given the region’s considerable senior population, many of whom are 85-years-old and older, Vicari highlighted the critical need to upgrade the power grid to meet their specific needs, especially when it comes to powering devices essential to their health and well-being.

“We need to do all we can to avoid brownouts and power outages,” Vicari said in the press release.

These recent power issues in Toms River underline the complexities and challenges of maintaining a reliable electrical grid in the face of growing demands and changing weather patterns. It also underscores the vital role that energy providers and local authorities must play in ensuring the safety and comfort of their residents.

Boeing front-runner in wide-body jet talks with IndiGo -sources

NEW DELHI (Reuters) -Boeing has emerged as the front-runner to secure an order for around 25 wide-body planes from IndiGo, industry sources told Reuters on Monday, as India’s biggest airline deepens its international expansion with new destinations.

IndiGo is in talks to buy Boeing’s 787 family of twin-aisle aircraft, which has been pitted against Airbus A330neo jets, said the sources who are familiar with the matter.

No decision has been finalised, the sources said, requesting anonymity as the negotiations are confidential.

IndiGo said it does not comment on speculation. Boeing declined to comment. Airbus said it never comments on discussions it may or may not be having with existing and prospective customers.

Reuters first reported in March that IndiGo was in talks with Airbus and Boeing for the wide-body jets.

The recent talks come weeks after IndiGo placed a record order for 500 Airbus narrow-body jets, shadowing an earlier record deal by rival Air India for 470 Airbus and Boeing planes.

Indian carriers are trying to keep pace with the world’s fastest-growing aviation market, where demand for air travel has surged post-COVID, sending industry records tumbling even as plane manufacturers are struggling to meet output goals.

The drive by IndiGo, which has 58% share of India’s domestic market, also comes at a time when it is aiming to double its capacity by the end of the decade and expand its network, especially in international markets.

IndiGo recently launched new flights to destinations in Africa, West Asia and Southeast Asia, and is also growing its presence in Europe through its codeshare partnership with seven carriers including Turkish Airlines and KLM.

So far, IndiGo has been an exclusive buyer of Airbus narrow-body jets and a deal for wide-body planes would be a departure from that strategy. Earlier this year it began international operations with a Boeing 777, its first twin aisle aircraft taken from partner Turkish Airlines, which provides the pilots.

Foreign tourism to Portugal registers best-ever first half

LISBON (Reuters) – The number of foreign tourists visiting Portugal surpassed eight million in January-June, making it the best first half on record, official data showed on Monday.

The National Statistics Institute said nearly 8.2 million foreigners stayed in Portuguese hotels in the period, up from 6.3 million a year ago and 7.4 million in the first six months of 2019, a record year for tourism before the COVID-19 pandemic crippled global travel in 2020.

Tourism, a key driver of Portugal’s economy, accounted for almost 15% of gross domestic product before the pandemic.

Visitors from Britain made up the largest share of total arrivals in the first half, with over one million visitors, closely followed by the Spanish and U.S. markets.

In June, the United States, which has significantly grown as a source of tourism to Portugal, represented the second-largest group of foreign visitors.

The INE said the hotel sector registered 13.6 million guests, including local travellers, in the first half, while total hotel revenues increased 32% year-on-year to 2.5 billion euros ($2.73 billion).

In a separate report, the INE said the number of passengers who travelled through Portuguese airports in the first six months jumped almost 30% from a year ago and rose 12% compared to the first half of 2019.

According to the International Air Transport Association, international travel reached around 90% of pre-pandemic levels this year, with the rebound being led by visitors to Southern Europe.
