U.S. Border Patrol Agents Foil Maritime Smuggling Attempt at Coronado Beach

CORONADO, Calif., – Yesterday morning, U.S. Border Patrol Agents arrested a group of eight migrants that included three undocumented non-citizens with criminal history as they attempted to land on a beach in Coronado.  

The event occurred on August 2, at approximately 4:25 a.m., when agents spotted the blacked-out pleasure craft traveled north along the coast from Mexican waters. As the vessel continued to travel north that is when Customs and Border Protection’s (CBP) Air and Marine Operations (AMO) agents in a CBP interceptor vessel approached the vessel, at which time the operator attempted to evade at a high rate of speed.  The vessel continued to travel north along the coast, passing the Naval Training Center and into the surf just west of the Hotel Del Coronado.  

At approximately 5:00 a.m., the vessel landed on Coronado Beach, where eight people jumped from the vessel and began running north. Agents responded to the scene and arrested all eight migrants. 

“Smugglers only care about making money and are willing to bring anyone into our communities regardless of their criminal past.” said Chief Patrol Agent Aaron M. Heitke.  “Additionally, they continue to use these dangerous tactics in their efforts to get their commodity, be it drugs or people into the United States.  Maritime smuggling not only endangers the people being smuggled, but also our agents who often selflessly go into the surf to rescue them.” 

The group, all adults, consisted of six Mexican males, one Mexican female and one Guatemalan female.
Record checks revealed that among the smuggled migrants were a documented gang member, a previously convicted sex offender, and a subject with prior drug convictions.  
All eight undocumented non-citizens are in U.S. Border Patrol custody and are being processed accordingly.  

The vessel was seized by AMO.

Laredo Sector Border Patrol stops a human smuggling attempt at checkpoint, recovers stolen vehicle

LAREDO, Texas – Laredo Sector Border Patrol agents assigned to the Laredo North Station stops a human smuggling attempt and recovered a stolen tractor-trailer at the I-35 checkpoint.

The incident occurred on August 3, when a commercial vehicle approached the primary inspection lane.  During an immigration inspection of the driver, a Service canine alerted to the vehicle, subsequently, agents referred the driver to secondary inspection.  After opening the trailer, agents discovered over 40 undocumented individuals inside.  The individuals were identified as being from the countries of Mexico, Honduras, El Salvador, and Guatemala.

The tractor-trailer was reported as being stolen out of San Antonio, Texas. It was turned over to the Webb County Sheriff’s Office.

All subjects including the driver, a U.S. citizen, were taken into custody to be processed accordingly.

These Beats Were Not So Sweet

BUFFALO, N.Y. – U.S. Customs and Border Protection (CBP) officers at the Champlain Port of Entry Cargo Facility seized a shipment of counterfeit Beats earphones.

In July, a shipment was selected, and a thorough examination was conducted. CBP officers discovered zip lock bags of wired earphones located within the shipment. A physical inspection of the items revealed Beats Tour earphones that appeared to be of poor quality with no labels or invoices. In coordination with the Electronics Center of Excellence and Expertise, it was determined that the items were counterfeit and violated the Intellectual Property Rights (IPR) of the manufacturer. Furthermore, CBP Import Specialists helped to determine the earphones had a total Manufacturers Suggested Retail Price (MSRP) value of more than $25,000.

IPR violations pertain to products that infringe upon U.S. trademarks, copyrights, and patents. Other violations can include misclassification of merchandise, false country-of-origin markings, health and safety issues, and valuation issues. These violations can threaten the health and safety of American consumers, the economy and national security.

“Our dedicated CBP officers continue protecting our economy and consumers from counterfeit goods,” said Champlain Area Port Director Steve Bronson. “They do a tremendous job in their role to protect consumers and businesses from fraudulent items.”

“Seizures such as these keep fraudulent items from harming consumers health and safety, and help protect and secure our economy,” said Assistant Director, Field Operations Buffalo, Trade, Sharon Swiatek.

Six People Rescued Offshore From Vessel In Distress

EDINBURG, Texas – Rio Grande Valley Sector (RGV) Border Patrol agents interdicted six migrant smuggling events with the assistance of local law enforcement agencies.

On August 3, Harlingen Border Patrol Station agents responded to a call for assistance from the Port Mansfield Police Department concerning six individuals rescued from a vessel more than a mile offshore. Agents interviewed the group and determined three were illegally present in the U.S. and the other three were U.S. citizens.  The three U.S. citizens were juveniles travelling with a non-citizen relative.  All were determined to be in good health and transported to the station for processing.

Later that morning, McAllen Border Patrol Station (MCS) agents interviewed five individuals encountered after a vehicle pursuit/bail out with Palmview Police Department (PPD). Agents arrested three migrants from Guatemala and one migrant from Ecuador. PPD retained custody of the U.S. citizen juvenile driver to charge with migrant smuggling.

Just before noon, RGV agents and Hidalgo County Sheriff’s Office Operation Stonegarden units conducted a vehicle stop on a Ford Expedition suspected of human smuggling in Mission, resulting in two arrests. Upon further investigation, the team arrested two more subjects at a migrant stash house nearby. All subjects are nationals from Mexico and no caretaker was identified.

Later that evening, RGV agents attempted to initiate an immigration inspection on the occupants of a Cadillac SUV near Norias. The vehicle failed to yield and led agents and Texas Department of Public Safety (TXDPS) troopers on a vehicle pursuit. The vehicle came to a stop near Raymondville and all the occupants bailed out. The grass under the unoccupied vehicle caught fire as did the Cadillac until the Raymondville Fire Department responded to extinguish the flames. TXDPS arrested the U.S. citizen driver and agents apprehended three migrants from Honduras in the brush nearby.  

Rio Grande City Border Patrol Station agents encountered two large groups totaling 297 subjects near La Grulla yesterday and this morning. The group consisted of 140 single adults, 106 family unit members (four are U.S. citizen juveniles), and 51 unaccompanied children. The migrants are from Cuba, South and Central America.

CBP Continues Seizing Dangerous Drugs

SAN DIEGO – U.S. Customs and Border Protection  officers in the San Diego Field Office thwarted three more narcotic seizures in the month of July.

These recent interceptions come on the heels of nine other significant narcotic seizures that occurred in the same month.

“These impressive drug seizures highlight our officer’s commitment to keep our border secure.” said Anne Maricich, CBP Acting Director of Field Operations in San Diego. “Our frontline officers continue to maintain a robust enforcement posture and are successfully disrupting the flow of dangerous narcotics from entering our country.”

The most recent seizure occurred on Sunday, July 24, at about 9 a.m., when a 31-year-old female applied for entry into the U.S. by presenting her California driver’s license to CBP officers at the Tecate port of entry.  The officer referred the vehicle and occupant for further inspection.

CBP officers scanned the vehicle using the port’s imaging system, similar to an x-ray, where they noticed anomalies in the trunk area.  A CBP officer screened the vehicle with his assigned human/narcotics detector dog which alerted to the floor of the vehicle.  CBP officers removed and seized 25 packages containing fentanyl, heroin, cocaine, and methamphetamine concealed in the spare tire well with a total weight of 57.17 pounds.

The second seizure happened at the San Ysidro port of entry at 7:45 a.m. on July 23.  A 54-year-old male and his vehicle were referred for further inspection after a K-9 alerted to the undercarriage of the vehicle as he was waiting in line.  The driver presented his California driver’s license when he applied for admission into the United States.

During the inspection, officers discovered 33 packages of fentanyl, weighing 47.17 pounds, in the gas tank and doors of the vehicle.

The day before that seizure, on July 22, at about 12:15 a.m. a driver, identified as a 52-year-old male in possession of a legal resident card, was removed from the vehicle and escorted to the security office after CBP officers observed several packages concealed in the vehicle.

Further inspection of the vehicle revealed 113 packages of methamphetamine weighing 128 pounds hidden in the rear doors, rear backseat rest, quarter panels, and spare tire. 

The fentanyl, heroin, cocaine, and meth have a combined estimated street value of close to $1.4 million. CBP officers seized the narcotics and vehicles.

All occupants were turned over to U.S. Immigration and Customs Enforcement (ICE), Homeland Security Investigations (HSI).

El Paso Area CBP Officers Seize 73 Pounds of Hard Narcotics

EL PASO, Texas – U.S. Customs and Border Protection officers working at El Paso area ports of entry seized fentanyl, cocaine, and methamphetamine over the last week.

On July 25, CBP officers working at the Paso Del Norte border crossing intercepted 14.77 pounds of cocaine from a 36-year-old female Mexican citizen. A CBP canine alert and a non-intrusive inspection led CBP officers to the discovery of cocaine filled bundles concealed within the vehicle.

On July 26, CBP officers working at the Paso Del Norte border crossing intercepted 16.97 pounds of methamphetamine from a 32-year-old male U.S. citizen. The discovery was made after a CBP canine alerted to a dolly leading CBP officers to locate methamphetamine filled bundles. Later, CBP officers intercepted 0.48 pounds of fentanyl from a 32-year-old male U.S. citizen. The discovery was made after a pat down search was conducted leading CBP officers to discover two bags filled with pills.

On July 27, CBP officers working at the Ysleta border crossing intercepted 0.24 pounds of fentanyl from a 21-year-old female U.S. citizen. The woman arrived via pedestrian bridge and was referred for a secondary inspection. Following a CBP canine alert, the woman admitted to carrying narcotics in her private partsl cavity.

On July 28, CBP officers working at the Bridge of the Americas border crossing intercepted 1.06 pounds of methamphetamine from a female U.S. citizen. The discovery was made after a pat down search was conducted revealing packages in the groin area. Later, CBP officers working at the Ysleta border crossing intercepted a mixed load of 9.83 pounds of fentanyl and 12.87 pounds of cocaine from a 19-year-old male U.S. citizen. The discovery was made following a non-intrusive inspection and intensive search of the vehicle. A few minutes later, CBP officers encountered a 22-year-old female attempting to smuggle 6.08 pounds of cocaine concealed within her vehicle.

On July 30, CBP officers working at the Paso Del Norte border crossing intercepted 11.28 pounds of methamphetamine from a 24-year-old female U.S. citizen. The seizure occurred following a CBP canine alert and non-intrusive search of the vehicle.  

“CBP officers are dedicated to protecting our borders and stopping the flow of dangerous narcotics from reaching our communities,” said Director Field Operations Hector A. Mancha. “These seizures are examples of the vigilance and commitment by our CBP officers to the border security mission.”

The subjects arrested by CBP officers were turned over to U.S. Immigration and Customs Enforcement Homeland Security Investigations or local authorities for prosecution.

U.S. Border Patrol Agents Seize $700K of Fentanyl

TEMECULA, Calif. — U.S. Border Patrol agents arrested a man on Wednesday with nearly 50 pounds of fentanyl concealed inside his vehicle.

The incident began on Wednesday at approximately 11:27 a.m., when agents stopped a blue 2018 Volkswagen Jetta on Interstate 15 just north of the Murrieta Border Patrol Checkpoint. Agents on the vehicle stop requested assistance from a Border Patrol K-9 unit. The agency K-9 conducted a sniff of the vehicle and alerted to the presence of narcotics.

Upon searching the vehicle, agents located 10 packages hidden inside the spare tire. An additional three packages were found within a compartment inside the vehicle’s battery. Seven of the 13 packages were found to contain fentanyl pills. The remaining packages contained fentanyl powder. The combined weight of the seizure was 49.6 pounds. The estimated street value of the seizure is $704,000.

The driver and the narcotics were turned over to the Riverside County Sheriff’s Southwest Investigative Bureau (SIB) for investigation and prosecution.  The vehicle was seized by the U.S. Border Patrol.

Since October 1, 2021, San Diego Sector Border Patrol agents have seized more than 613 pounds of Fentanyl.

Human Smuggling Attempt Thwarted on St Clair River

DETROIT – Detroit Sector Border Patrol agents arrest three foreign nationals during a smuggling attempt on the St. Clair River near Algonac early Tuesday morning.

On August 2nd, at approx. 3am, Border Patrol dispatch monitoring the Remote Video Surveillance System observed a vessel on the St. Clair River near Algonac cross the international border near a historically known smuggling route. Dispatch officials immediately notified agents in the area of a possible smuggling incident taking place.

Marysville agents on patrol were able to respond to the area and immediately encountered three people near the location where dispatch had last observed the vessel headed towards the United States.  An agent interviewed the three subjects, whom all admitted to having just crossed the border from Canada in a boat. The three subjects were taken into custody and transported to the Border Patrol station for processing.

During processing it was confirmed that one of the subjects was a 53-year-old male Dominican National, along with a pair of females aged 25 and 26 from Mexico.

“Intercepting this was made possible by technology and the teamwork of our agents and support personal. I am proud of the vigilance and dedication to duty displayed by the men and women of Detroit Sector.” Said Chief Patrol Agent Robert Danley.

On August 2, CBP officers encountered a 19-year-old male U.S. citizen who arrived from Mexico via vehicle. During primary inspection by CBP officers it was revealed there was an outstanding warrant for homicide (negligent manslaughter-vehicle). The individual was secured and a secondary inspection was conducted utilizing biometric verification which confirmed his identity along with the active warrant for homicide (negligence manslaughter-vehicle) by the Comanche County Sheriff’s Office, Lawton, Oklahoma.

“Working closely with law enforcement agencies and apprehending fugitives from justice is a part of our daily work to keep our borders and communities safe and secure,” said Port Director Jesus Chavez. 

The suspect was arrested by CBP officers and turned over to local authorities pending extradition to the originating agency.

Over 50,000 Lethal Doses of Fentanyl Seized by CBP Louisville

LOUISVILLE, Ky—U.S. Customs and Border Protection (CBP) officers in Louisville seized a shipment early this morning containing multiple pills of the lethal narcotic fentanyl, enough to kill 50,200 people.

Fentanyl, an extremely toxic substance to handle in addition to being a dangerous narcotic to use, was found by CBP officers in Louisville earlier this morning.

 

On August 4, CBP officers detained a shipment arriving from India manifested as medicine. When officers inspected the package, they found five pill bottles. The pills tested positive for fentanyl properties. The shipment was destined for a residence in Brampton, Ontario, Canada. These pills had a street value of at least $15,000.

“This narcotic is not only dangerous to the user, but also very dangerous to our officers,” said LaFonda D. Sutton-Burke, Director, Field Operations-Chicago Field Office. “Our officers take every precaution with every shipment they inspect, and we are very relieved no one was seriously injured during this seizure.”

Fentanyl is an extremely toxic substance to handle in addition to being a dangerous narcotic to use. Officers are extremely careful when confronted with this substance, which again demonstrates the risk CBP officers face performing their daily duties.

“Even though this shipment may seem like a very small amount, remember two milligrams of this stuff is lethal,” said Thomas Mahn, Port Director, Louisville. “This seizure showcases the excellent work our officers do every day. This is a dangerous opioid, and our officers were able to prevent this deadly drug from reaching its destination.”

Fentanyl and its analogues are synthetic opioids that bind to and activate the opioid receptors in the brain creating analgesic and euphoric effects. Compared to other opioid medications, most types of fentanyl are extremely powerful.   

CBP conducts operations at ports of entry throughout the United States, and regularly screens arriving international passengers and cargo for narcotics, weapons, and other restricted or prohibited products. Sex Offenders and Gang Members Arrested in the RGV

EDINBURG, Texas – Rio Grande Valley Sector (RGV) Border Patrol agents arrested five convicted sex offenders and more than 20 gang members since last Thursday.

On July 28, Falfurrias Border Patrol Station (FLF) agents apprehended Manuel Ramirez, a Honduran national, near Falfurrias. Ramirez was arrested in New York and charged with first degree attempted rape and sentenced to four years incarceration in 2017. He was also identified as a Mara Salvatrucha (MS-13) gang member.

On July 30, FLF agents processed a Salvadoran MS-13 gang member with prior criminal history for carnal knowledge of a child in Virginia and sentenced to five years incarceration.

McAllen Border Patrol Station agents apprehended a Mexican national on July 31 with a prior conviction for lewd/lascivious acts with a child and sentenced to three years probation and six months incarceration in California.

On August 2, Rio Grande City Border Patrol Station (RGC) agents apprehended a Salvadoran 18th Street gang member whose criminal history in his home country revealed attempted homicide, possession of firearms, and theft. The following day, RGC agents apprehended Cesar Campos, a Peruvian national, who was previously convicted of raping a victim less than 17 years old and was sentenced to 16 months to four years incarceration in New York. The same day, RGC agents arrested another sex offender from Honduras who was sentenced to 12 months incarceration in New Jersey for criminal sexual contact.

Additionally, RGV agents apprehended 11 18th Street gang members, 9 MS-13s, and a Paisa gang member with multiple convictions for marijuana possession.

All subjects were processed accordingly.

RGV Agents Seize 166 Pounds of Marijuana After A Failed Smuggling Attempt

EDINBURG, Texas – Rio Grande Valley Sector Border Patrol (RGV) agents disrupted two human smuggling events and seized 166 pounds of marijuana.

Brownsville Border Patrol Station (BRP) agents seized over 166 pounds of marijuana when camera operators observed several subjects scale the border wall with several bundles of narcotics near Brownsville, on August 4. BRP agents responded to the area and encountered the subjects loading the bundles into a Chevrolet Tahoe who sped off. The vehicle failed to yield and led agents on a vehicle pursuit. The driver struck another vehicle as he attempted to evade law enforcement authorities. The pursuit ended, when the driver drove into a parking lot and attempted to abscond. Agents apprehended the Mexican national driver, two U.S. citizen passengers, and recovered the bundles, with an estimated street value of more than 133,000 USD. Texas Department of Public Safety troopers responded and took custody of the narcotics, vehicle, and subjects to be charged with state charges. No injuries were reported.

That afternoon, RGV agents apprehended 10 subjects in a human smuggling stash house located in Edinburg. Agents identified all subjects to be illegally present in the United States. The subjects were citizens of Mexico and El Salvador. No caretaker was identified. 

McAllen Border Patrol Station (MCS) agents received information regarding a Pontiac Sedan loading up migrants in a well-known smuggling area near Los Ebanos on August 4. MCS camera operators located the vehicle and guided responding agents to the location. As agents approached the vehicle multiple subjects immediately absconded into the nearby brush. A CBP Air and Marine Operations helicopter assisted in the apprehension of three migrants all determined to be illegally present in the U.S. The U.S. citizen driver was also arrested.

All subjects were processed accordingly.

Bi-National Operation Yields Rifle, Ammunition, Makeshift Ladders

U.S. Border Patrol agents seized 29 makeshift ladders near the international boundary near Otay Mountain, California.

OTAY MESA, Calif. – U.S. Border Patrol Agents  conducted a bi-national operation with Government of Mexico law enforcement elements  along the shared border region near Otay Mountain in California.

The bi-national patrol began Wednesday at about 6 a.m. in the mountainous area east of the Otay Mesa Port of Entry and included Border Patrol Agents from the San Diego Sector Foreign Operations Branch and the Guardia Nacional and Instituto Nacional de Migracion.

This mountainous area is well-known for smuggling and bandit activity because of its desolate location and deep canyons on both sides of the international border.

“Our agents continue to leverage the strong relationships we have forged with our law enforcement partners in Mexico,” said San Diego Chief Patrol Agent Aaron M. Heitke. “Border safety has always been a shared concern, and this is just one example of how our coordinated efforts against a common threat has paid off.”

While patrolling the area, agents using handheld drone technology observed a group of suspected undocumented migrants and armed smugglers near the international boundary.  As the bi-national team responded to the location from both sides of the border, the group saw the agents and absconded deeper into Mexico. The group was able to get away, but left behind several items.  

Agents secured the abandoned items which included: a loaded rifle magazine, 75 rounds of 7.62 ammunition, and 29 makeshift ladders used to scale the border wall.  All the seized items were transported to the Joint California Forensic Center for processing.  Information gleaned from the forensic process will be shared with the GoM law enforcement partners.

This fiscal year, San Diego Sector Border Patrol has conducted over 149 bi-national patrols with GoM and will continue to do so with the goal of dismantling Transnational Criminal Organizations and disrupting bandit activity along our shared borders.

New Orleans Man Sentenced to 64 Months For Violating the Federal Gun Control Act

NEW ORLEANS, LOUISIANA – On August 4, 2022, United States District Judge Carl J. Barbier sentenced STEPHONE BRIDGES to 64 months in the Bureau of Prisons for being a felon in possession of a firearm, in violation of the Federal Gun Control Act, announced U.S. Attorney Duane A. Evans.

BRIDGES was charged on November 19, 2021 in a one-count indictment with possessing a Glock 49x 9mm semi-automatic pistol and a red transparent magazine with 18 live rounds while being a convicted felon. BRIDGES’s term of imprisonment will be followed by three (3) years of supervised release and the court ordered him to pay a $100 mandatory special assessment fee.

This case was brought as part of Project Safe Neighborhoods (PSN), which is the centerpiece of the Department of Justice’s violent crime reduction efforts.  PSN is an evidence-based program proven to be effective at reducing violent crime. Through PSN, a broad spectrum of stakeholders work together to identify the most pressing violent crime problems in the community and develop comprehensive solutions to address them. As part of this strategy, PSN focuses enforcement efforts on the most violent offenders and partners with locally based prevention and reentry programs for lasting reductions in crime.

U. S. Attorney Duane A. Evans praised the work of the New Orleans Police Department, the Orleans Parish District Attorney’s Office, and the United States Federal Bureau of Investigation. The prosecution was handled by Assistant United States Attorney Rachal Cassagne.

St. Louis County man sentenced to 5+ years for traveling for sex with teen

ST. LOUIS – U.S. District Judge Sarah E. Pitlyk on Friday sentenced a St. Louis County man to five years and four months in prison for traveling to Springfield, Ill. in 2019 to have sex with a 15-year-old.

Wesley Kimble, now 25, will also be on supervised release for life.

Kimble met the 15-year-old via an online dating site in the fall of 2019 and began exchanging messages with the teen, with many of the messages being sexual in nature.  In December of 2019, Kimble drove to Springfield to pick up the victim.  On the return trip, Kimble engaged in sexual activity with the victim, he admitted in a plea agreement.  Kimble also provided the victim with illegal drugs and engaged in unprotected sex with the victim once they arrived at his apartment in St. Louis County.

Kimble pleaded guilty in November to a charge of interstate transport of a minor for the purpose of engaging in illicit sexual conduct.

In court Friday, the victim’s mother read a statement in which the victim said she’d called Kimble after escaping from a Springfield hotel room where she’d been victimized by another man. Kimble took her phone and backpack away, drove her to his apartment and locked her in there.

The victim’s mother said the mental and emotion scars Kimble inflicted on her daughter “can’t be measured and have no end in sight.”

In addition to the prison time, Judge Pitlyk ordered Kimble to undergo drug, mental health and sex offender treatment.

The case was investigated by the Federal Bureau of Investigation and brought as part of Project Safe Childhood, a nationwide initiative to combat the growing epidemic of child sexual exploitation and abuse launched in May 2006 by the Department of Justice. Project Safe Childhood marshals federal, state and local resources to better locate, apprehend and prosecute individuals who exploit children via the Internet, as well as to identify and rescue victims. Newark, DE Man Pleads Guilty to Prescription Fraud Charges Just Before Trial

PHILADELPHIA – United States Attorney Jacqueline C. Romero announced that Maurice Bertrand, 34, of Newark, DE, pleaded guilty just before jury selection was set to begin for trial in front of United States District Court Judge Harvey Bartle III, to one count of fraudulently obtaining oxycodone, and one count of attempting to fraudulently obtain oxycodone. 

In September 2019, the defendant was charged in connection with his scheme to present forged prescriptions written under the name of a Center City doctor whom he had never met at a Marcus Hook area pharmacy. Evidence which would have been presented at trial would have shown that in May 2019, Bertrand obtained 90 oxycodone tablets, and in June 2019, he was intercepted by law enforcement while attempting to obtain 120 oxycodone tablets.

The charges against Bertrand and 12 other defendants were originally announced as part of the formation of the Newark/Philadelphia Regional Medicare Fraud Strike Force, a joint law enforcement effort that brings together the resources and expertise of the Health Care Fraud Unit in the Department of Justice Criminal Division’s Fraud Section, and the U.S. Attorney’s Offices for the Eastern District of Pennsylvania and the District of New Jersey. The Strike Force focuses its efforts on aggressively investigating and prosecuting complex cases involving patient harm, large financial loss, and the illegal prescribing and distribution of opioids and other dangerous narcotics. Bertrand is the last of the 13 total defendants to plead guilty to federal charges in connection with this investigation and faces up to eight years in prison.

“Stopping prescription fraud in order to stem the tide of illegal opioid distribution and addiction in our District is a top priority for our Office,” said U.S. Attorney Romero. “This thirteenth and final conviction in this investigation demonstrates our commitment to cutting off the supply of addictive drugs diverted to the streets in order to keep our communities safe.”

These cases were investigated by the Drug Enforcement Administration’s Tactical Diversion Squad and the U.S. Department of Health and Human Services Office of Inspector General, with assistance from the Easttown Township Police Department. The case is being prosecuted by Assistant U.S. Attorney David E. Troyer.

Former U.S. Postal Service worker pleads guilty to scheme to deliver drugs through the mail

ATLANTA – Former mail carrier Robert Elliott Sheppard has pleaded guilty to drug trafficking charges for recruiting fellow mail carriers to deliver packages of controlled substances while he was on disability leave.

“Postal carriers occupy a position of trust in our communities and Sheppard violated that trust by exploiting his role as a mail carrier to traffic kilogram amounts of cocaine as well as marijuana,” said U.S. Attorney Ryan K. Buchanan. “Sheppard’s conduct is especially egregious because he recruited other postal carriers to participate in his criminal scheme once he was on disability leave. His conduct and greed potentially exposed countless innocent postal workers and the public to dangerous drugs and to the violence that these crimes frequently cause.”

“Sheppard’s greed taints the public’s trust in U.S. Postal Service employees, the majority of whom are hard-working and trustworthy individuals dedicated to delivering mail safely throughout our communities,” said Keri Farley, Special Agent in Charge of FBI Atlanta. “The FBI wants it to be clear that public corruption remains our number one criminal program priority and, as such, we have dedicated significant resources toward the identification, investigation, and prosecution of any individuals involved in similar such conduct.”

“We appreciate the outstanding effort by both the investigative and legal teams,” said Special Agent in Charge Scott Pierce, USPS Office of Inspector General, Southern Area Field Office. “The vast majority of Postal Service employees are honest, hardworking individuals who would never dream of violating the public trust in this manner. An employee who decides otherwise, however, will be aggressively investigated by OIG special agents. This case serves as an excellent example of the successful collaboration between the USPS OIG, our federal and state law enforcement partners, and the U.S. Attorney’s Office to pursue and prosecute Postal Service employees involved in criminal activity.”

“Sheppard enlisted the help of two co-workers to smuggle drugs through the United States Postal system, entangling them in a drug conspiracy and furthering dangerous criminal activity. They have been brought to justice. It is now Sheppard’s time to be held accountable for his selfish actions. The DeKalb County District Attorney’s Office will continue to work with its law enforcement partners to ensure public officials like Sheppard will be brought to justice,” said DeKalb County District Attorney Sherry Boston.

According to U.S. Attorney Buchanan, the charges and other information presented in court: In 2014, Sheppard worked as a U.S Postal Service (USPS) mail carrier. In exchange for bribes, he used his position to deliver five-pound packages of drugs through the U.S. mails to Dexter Frazier, a local drug trafficker who sold cocaine and marijuana.

In 2016, Frazier approached Sheppard about delivering additional drug packages. Sheppard was on disability leave from the USPS at that time and unable to intercept and deliver packages. So Sheppard offered to recruit other mail carriers to deliver drugs for Frazier if Frazier paid Sheppard referral fees consisting of a mix of cash and marijuana. Frazier agreed.

Sheppard then contacted two coworkers, Tonie Harris and Clifton Lee. Sheppard explained to Harris and Lee that in exchange for payment, Frazier needed them to deliver packages of drugs. Sheppard instructed Harris and Lee how to arrange the deliveries to avoid detection. Harris and Lee agreed to participate in the scheme after which Sheppard gave their phone numbers to Frazier. Frazier then coordinated the illegal deliveries with Harris and Lee. Harris and Lee each delivered three packages for Frazier believing they contained two kilograms of cocaine or 10 pounds of marijuana.

Robert Elliott Sheppard, 60, of East Point, Ga., has pleaded guilty to charges of conspiracy to possess with intent to distribute cocaine and marijuana and unlawfully using the mail to commit that crime. Sentencing for Sheppard is scheduled for November 3, 2022.

Other participants in the scheme previously pleaded guilty and received the following sentences imposed by U.S. District Judge Steve C. Jones:

  • Dexter Bernard Frazier, a/k/a “Dec,” 60, of Fairburn, Georgia, was sentenced on June 13, 2018, to nine years in prison to be followed by 10 years of supervised release. He was also ordered to pay restitution in the amount of $10,700. Frazier pleaded guilty to the offense of attempt to distribute cocaine and marijuana on March 6, 2018.
  • Clifton Curtis Lee, a/k/a “Cliff,” 46, of Lithonia, Georgia, a letter carrier assigned to the Sandy Springs Post Office, was sentenced on June 18, 2018, to three years, 10 months in prison to be followed by three years of supervised release. He was also ordered to pay restitution in the amount of $1,800. Lee pleaded guilty to the offenses of attempt to distribute cocaine and bribery of public officials on February 28, 2018.
  • Tonie Harris, 59, of Decatur, Georgia, a letter carrier assigned to the Sandy Springs Post Office, was sentenced on August 14, 2018, to three years, one month in prison to be followed by four years of supervised release. He was also ordered to pay restitution in the amount of $1,450.  Harris pleaded guilty to the offenses of attempt to distribute cocaine and marijuana and bribery of public officials on March 20, 2018.

This case is being investigated by the Federal Bureau of Investigation, the U.S. Postal Service Office of Inspector General, and the DeKalb County District Attorney’s Office.

Assistant U.S. Attorney Garrett L. Bradford, Deputy Chief of the Public Integrity and Special Matters Section, is prosecuting the case.

Six-Time Felon Sentenced to More Than 6 Years in Prison for Cocaine and Gun Possession

WILMINGTON, N.C. – A Sumter, South Carolina man was sentenced today to 77 months in prison for possession with intent to distribute cocaine and possession of a firearm by a convicted felon.  On April 21, 2022, Derrick Lee Daye pled guilty to the charges.

According to court documents and other information presented in court, Derrick Lee Daye, 35, was arrested on June 21, 2021 after officers with the Dunn Police Department found him with a backpack containing over $18,000 in cash, a loaded gun, and 90 grams of compressed cocaine. Daye, a member of the Bloods street gang, had five prior felony convictions before this arrest.

“I would like to thank U.S. Attorney Michael Easley and his team for their cooperation and hard work in assisting law enforcement officers in a successful prosecution and removal of a dangerous habitual felon from the community,” said Dunn Police Chief Clark White. “This is a perfect example of how local and federal agencies working together can achieve great results.”

Michael Easley, U.S. Attorney for the Eastern District of North Carolina made the announcement after sentencing by Chief U.S. District Judge Richard E. Myers II. The Dunn Police Department and Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) investigated the case and Assistant U.S. Attorneys Caroline Webb and Nicholas Hartigan prosecuted the case.

Newell Woman Sentenced to Federal Prison for Drug Distribution

United States Attorney Alison J. Ramsdell announced that a Newell, South Dakota, woman convicted of Distribution of a Controlled Substance was sentenced on August 4, 2022, by Judge Karen E. Schreier, U.S. District Court.

Kimberly Rich, age 56, was sentenced to six years and six months in federal prison, followed by five years of supervised release.  Rich was also ordered to pay $170 restitution to the South Dakota Health Lab and a $100 special assessment to the Federal Crime Victims Fund.

Rich was indicted by a federal grand jury in February 2022 and pleaded guilty on May 13, 2022.  The conviction stems from Rich knowingly and intentionally distributing a mixture or substance containing a detectable amount of methamphetamine, a Schedule II controlled substance, in January 2022.

The investigation was conducted by the South Dakota Division of Criminal Investigation and the Meade County Sheriff’s Office.  Assistant U.S. Attorney Kelsey Blair prosecuted the case.

Rich was immediately remanded to the custody of the U.S. Marshals Service.
