New Jersey had to remove 1 million bogus registered voters ahead of 2025 election

by Shore News Network September 30, 2025
By Shore News Network

Trenton, NJ – New Jersey election officials confirmed the removal of more than 1 million inactive and ineligible voters from state rolls, a sweeping cleanup that comes as federal authorities review compliance with the National Voter Registration Act (NVRA).

The state reported earlier this month that over 100,000 inactive voters had been taken off the lists in the latest round of updates.

Current figures show 224,653 inactive registrations, a sharp decline from the 496,711 reported in 2022. The reduction follows a statutory notice from federal officials questioning whether New Jersey’s voter list maintenance met NVRA standards.

The issue carries political weight.

In the last gubernatorial race, Gov. Phil Murphy defeated Jack Ciattarelli by fewer than 84,000 votes. At that time, the state’s rolls contained nearly half a million inactive voters.

Federal data previously showed incremental growth in inactive voters: 412,572 in 2018, 413,728 in 2020, and nearly half a million by 2022. With the latest removals, New Jersey has cut that figure by more than half.

Arby’s loses battle to dismiss roast beef false advertising lawsuit

by Shore News Network September 30, 2025
By Shore News Network

Brooklyn, NY – A federal judge has cleared the way for a proposed class action lawsuit against Arby’s Restaurant Group, Inc., which accuses the fast-food chain of misleading customers about the amount and quality of meat in its signature roast beef sandwiches.

Plaintiff Joseph Alongis filed the case on behalf of himself and other New York consumers, claiming Arby’s ads falsely represented that its sandwiches contained “rare roast beef” and at least double the meat actually served. The menu items at issue include the Classic Roast Beef, Double Roast Beef, Half Pound Roast Beef, Beef ’N Cheddar variations, and the Smokehouse Brisket.

Arby’s sought to dismiss the case, arguing that Alongis lacked standing to represent customers who purchased different sandwiches or ordered through online platforms such as Uber Eats, Grubhub, Seamless, and DoorDash. But U.S. District Judge Nusrat J. Choudhury ruled that Alongis had standing to pursue claims on behalf of both in-store and online customers in New York, finding that the alleged misrepresentations raised the same concerns across the product line.

The court partially granted Arby’s motion, dismissing certain aspects of the complaint, but allowed core claims under New York General Business Law §§ 349 and 350, which prohibit false and deceptive advertising, to proceed.

The ruling means Arby’s must now face discovery over whether its marketing misled consumers about the content of its popular roast beef sandwiches.

Judge allows lawsuit against NYPD officers to proceed in false arrest case

by Shore News Network September 30, 2025
By Shore News Network

Brooklyn, NY – A federal judge has ruled that parts of Isaiah Sano’s civil rights lawsuit against the City of New York and three NYPD officers can move forward, rejecting efforts by the city to dismiss the case in full.

Sano filed the suit in 2022, claiming Officers Devon D. Moses, Patrick Sanon, and Detective Brian Flynn falsely accused him of firing a gun outside his apartment building in October 2021. According to the amended complaint, the officers knowingly misrepresented video evidence, then arrested Sano two weeks later without probable cause.

Sano alleges he was taken to multiple precincts, subjected to a strip search, and questioned without being informed of his rights. He also claims officers mocked him during transport, with one allegedly saying, “Once I get you in cuffs, everything is over baby… Without you, I wouldn’t have a job,” before blasting music in the car.

The officers later reported that drugs were found on Sano during the arrest, but he contends the search and seizure were unlawful. His lawsuit, brought under 42 U.S.C. §§ 1983, 1985, and 1988, also includes claims under state law.

U.S. District Judge Dora L. Irizarry granted the city’s motion to dismiss in part but allowed several constitutional claims, including those related to false arrest, unlawful search, and malicious prosecution, to proceed.

The decision means the case will now enter discovery, keeping the officers and the city facing liability in federal court.

Judge sides with Mantua schools in fight over special education evaluation costs

by Shore News Network September 30, 2025
By Shore News Network

Camden, NJ – A federal judge has ruled that the Mantua Township Board of Education is not required to pay for independent evaluations obtained by the parent of a former student, overturning a state administrative order that had forced the district to cover the costs.

The dispute arose after E.K., the parent of an autistic student identified as W.W., sought three outside educational assessments and then demanded reimbursement from the district under the Individuals with Disabilities Education Act (IDEA). In 2022, a New Jersey administrative law judge granted the parent’s request, finding the Board had waived its right to challenge the invoices.

But in a decision released last week, U.S. District Judge Karen M. Williams reversed that outcome, holding that the administrative judge misapplied state regulations. The court granted judgment in favor of the Board, concluding that the waiver finding improperly sidestepped whether Mantua schools were actually responsible for the bills under federal and state special education law.

The IDEA requires public schools to evaluate students suspected of having disabilities and, in some circumstances, pay for independent educational evaluations if parents disagree with the district’s findings. Mantua officials argued they had followed proper procedures and were not obligated to cover the additional testing.

The ruling sends the case back into the district’s column after years of litigation, clarifying that the earlier administrative decision cannot stand.

Judge orders release of Ecuadorian woman held in New Jersey immigration detention

by Shore News Network September 30, 2025
By Shore News Network

Newark, NJ – A federal judge has ordered the immediate release of Diana M. Rivera Zumba, a 44-year-old Ecuadorian woman who has lived in the United States for more than two decades, ruling that her detention violated federal immigration law and the Constitution.

In a decision issued Friday, U.S. District Judge Katharine S. Hayden found that Rivera Zumba’s confinement under Section 235 of the Immigration and Nationality Act was unlawful. The court held that the statute, which mandates detention for certain noncitizens during removal proceedings, did not apply to her case.

Rivera Zumba entered the country without inspection in 2002 and has remained in New Jersey ever since. She and her late husband were placed in removal proceedings in 2017, but after an initial denial of her application for cancellation of removal, her case was sent back to the immigration court in 2023 for further proceedings. She has been waiting nearly two years for a new hearing date.

Despite that procedural posture, immigration officials detained Rivera Zumba at the Delaney Hall facility in Newark. In her ruling, Judge Hayden said the detention violated both the INA and the Fifth Amendment’s Due Process Clause.

The court granted Rivera Zumba’s habeas petition, ordered her release within 24 hours, and temporarily barred immigration authorities from re-arresting her under a separate detention statute for 14 days to allow her to return home.

The ruling marks a significant victory for Rivera Zumba, whose legal battle has stretched on for more than six years.

GOP lawmakers demand Mikie Sherrill release Naval Academy records as cheating scandal continues

by Shore News Network September 30, 2025
By Shore News Network

Trenton, NJ – Dozens of Republican legislators from both the New Jersey State Senate and Assembly are calling on Congresswoman Mikie Sherrill to authorize the release of records tied to her alleged involvement in a 1994 U.S. Naval Academy cheating scandal.

In a joint statement issued Tuesday, the lawmakers said they were “stunned” by recent revelations that Sherrill, now a Democratic member of Congress and declared candidate for governor, was barred from walking in her graduation due to the scandal.

“While we respect her service, we are deeply disappointed that she denied her involvement during her first campaign for Congress and has maintained that lie ever since,” the statement read. “New Jerseyans deserve to know whether Congresswoman Sherrill upheld that standard.”

The group of Republicans argued that Sherrill has an obligation to disclose the full details of her case, including any statements she made to Naval investigators, the specific violations she committed, and the extent of her punishment.

“The only way to accomplish that level of disclosure is for the Congresswoman to personally authorize the immediate and full release of all records limited specifically to her involvement in the 1994 cheating scandal at the Naval Academy,” the statement continued.

The call for transparency was backed by more than 40 GOP legislators across the state, including State Senators Mike Testa, Declan O’Scanlon, Doug Steinhardt, and Kristin Corrado, along with Assembly members Robert Auth, Vicky Flynn, Erik Peterson, and Dawn Fantasia.

Sherrill, who has served in Congress since 2019 and previously flew helicopters in the U.S. Navy, has not yet issued a public response to the lawmakers’ demand.

Cops lose bid for immunity in New Jersey wrongful arrest case

by Shore News Network September 30, 2025
By Shore News Network

Trenton, NJ – A federal judge has rejected attempts by two law enforcement officers to escape liability in a long-running civil rights lawsuit tied to the 2015 arrest of Ronald Saintil.

U.S. District Judge Zahid Quraishi on Monday denied summary judgment motions filed by Scott Crocco, a Middlesex County Prosecutor’s Office sergeant, and Thomas O’Connor, a Carteret police detective. Both men had argued they were shielded by qualified immunity, a legal doctrine that protects government officials from liability unless they violated clearly established rights.

The case, first filed in 2017, stems from an operation in which Crocco, O’Connor, and other officers descended on Saintil’s Hamilton, New Jersey apartment while investigating a homicide. What occurred during the encounter remains sharply disputed. Saintil claims his rights were violated during his arrest and the search of his property, while the officers maintain their actions were lawful.

The district court had previously sided with the defendants, granting summary judgment in their favor, but the Third Circuit Court of Appeals reversed in part last year. The appellate judges instructed the lower court to revisit whether Crocco and O’Connor were entitled to immunity.

With Monday’s ruling, the case will now move forward toward trial, leaving the two officers still facing civil rights claims nearly a decade after the events in question.

TRENTON, NJ – A state grand jury has declined to bring criminal charges against a Franklin Borough police sergeant in connection with a crash that killed 19-year-old Deanna D’Arco of Vernon last year.

The Office of Public Integrity and Accountability (OPIA) announced Monday that jurors reviewed extensive evidence — including police dashcam video, 911 recordings, crash reports, surveillance footage, toxicology results and autopsy findings — before voting “no bill” on September 29. The decision means no charges will be filed against Sergeant William Grissom, the officer involved in the May 27, 2024 collision.

Investigators said Grissom was driving southbound on Route 23 at about 38 to 40 mph in a marked patrol car when a black Honda Prelude exited a ShopRite parking lot, crossed the double yellow line and entered the southbound lane. The police vehicle struck the Honda’s passenger side, where D’Arco was seated.

Grissom immediately radioed dispatch, helped remove the car door to reach D’Arco and remained at the scene until backup arrived. D’Arco was rushed to Newton Medical Center and later transferred to Morristown Medical Center, where she died two days after the crash. The Honda’s driver and Grissom sustained non-life-threatening injuries.

The crash evidence, including dashcam and surveillance footage, has been made publicly available as part of OPIA’s transparency guidelines.

Lancaster killer gets up to 70 years for random street shooting of deaf man

LANCASTER, PA – A Manheim Township man will spend decades behind bars after pleading guilty to fatally shooting a deaf and mute man on a Lancaster city street in what prosecutors called a “deliberate and unprovoked attack.”

Judge Jeffery Wright sentenced 25-year-old Edwin Ulysses Concepcion to 35 to 70 years in state prison Monday after he admitted to gunning down 68-year-old Israel Lugo on May 1, 2023. Concepcion entered guilty pleas to criminal homicide, illegal firearm possession, carrying without a license, altering a firearm’s manufacturer number and making false written statements.

Prosecutors said Concepcion followed Lugo on West New Street before pulling a handgun and firing four shots. Surveillance footage captured the killing and later tracked Concepcion leaving the area in a rideshare vehicle he had ordered. Detectives recovered a handgun with an obliterated serial number, clothing and a debit card linking him to the crime. His fingerprints matched those found on the weapon.

Lugo and Concepcion were strangers. In court, Lugo’s brother, speaking through a translator, demanded answers that Concepcion did not provide. The defendant only told the courtroom that he “appreciated” those present and hoped to learn something from the experience.

Concepcion, who was barred from possessing firearms due to a prior burglary conviction, was also accused of lying on an application to buy a pistol from a Manheim Township gun shop in April 2023. He will be required to pay more than $1,400 in funeral expenses as part of his sentence.
