Beavercreek man pleads guilty to attempting to travel overseas to join ISIS-K

by DOJ Press November 1, 2021
By DOJ Press

DAYTON, Ohio – A Beavercreek man who was arrested by the FBI’s Joint Terrorism Task Force at John Glenn International Airport in 2018 while trying to travel to Afghanistan to join ISIS Wilayat Khorasan (ISIS-K) has pleaded guilty in federal court.

Naser Almadaoji, 22, an Iraqi-born United States citizen, was scheduled to start jury trial today. He pleaded guilty Friday evening to one count of attempting to provide material support – himself, as personnel – to foreign terrorist organizations, namely ISIS and ISIS-K.

“This is now the second person from the Dayton area held accountable in recent times for trying to join ISIS,” said Acting U.S. Attorney Vipal J. Patel. “Whatever grievances might exist with our government, our country, or our way of life, violence is not the answer. Providing material support in whatever form – personnel, services, funding, or otherwise – to designated foreign terrorist groups simply begets more terror, and every effort will be made to hold accountable those who provide such support.”

According to court documents, Almadaoji purchased a plane ticket for travel on October 24, 2018, and was arrested after checking in and obtaining his boarding pass.

The defendant intended to travel to Astana, Kazahkstan, where he planned to be smuggled into Afghanistan so that he could join and receive military training from ISIS-K in support of both that terrorist group and ISIS. Almadaoji explained to an individual whom he believed to be  an ISIS supporter that he wanted “weapons experts training, planning and executing, hit and run, capturing high value targets, ways to break into homes and avoid security guards. That type of training.” He began making travel plans in September 2018.

Prior to that, between February 16 and 24, 2018, Almadaoji traveled to Egypt and Jordan for the purpose of joining ISIS’s affiliate in the Sinai Peninsula, ISIS Wilayat Sinai, another designated foreign terrorist organization, but he ultimately was unsuccessful.

Almadaoji told an individual posing as an ISIS supporter online about his proposed plot to start a conflict in the United States between the federal government and anti-government militias. He asked the purported ISIS supporter for a guide on how to make a car bomb.

In August 2018, Almadaoji also told the purported ISIS supporter that he was “always willing” to assist with “projects” in the United States.

Almadaoji recorded and sent a video of himself wearing a headscarf and pledging allegiance to the leader of ISIS.

In addition, Almadaoji translated a purported ISIS document from Arabic to English, and he told his contact—whom Almadaoji believed to be part of ISIS—“Don’t thank me . . . it’s my duty.”

Attempting to provide material support and resources to a foreign terrorist organization is a federal crime punishable by up to 20 years in prison. Congress sets the maximum statutory sentence. Sentencing of the defendant will be determined by the Court based on the advisory sentencing guidelines and other statutory factors.

“This case is another example of how the agents and officers of the Joint Terrorism Task Force continue to work each day to protect the community and disrupt those intent on aiding and supporting terrorist groups,” stated FBI Cincinnati Special Agent in Charge J. William Rivers. “The task force brings together federal, state, and local law enforcement partners to expertly investigate developing threats and those who may be focused on violence.”

Vipal J. Patel, Acting United States Attorney for the Southern District of Ohio; J. William Rivers, Special Agent in Charge of the Cincinnati Division of the FBI; Alan J. Hill, Oakwood Public Safety Director; and Greene County Sheriff Gene Fischer announced the plea entered into before Senior U.S. District Judge Walter H. Rice. Assistant United States Attorneys Dominick S. Gerace and Nicholas A. Dingeldein and Trial Attorney Justin Sher of the National Security Division’s Counterterrorism Section are representing the United States in this case.

Man Illegally Living in Peoria Sentenced to 37 Months in Prison for Possession of a Sawed-Off Shotgun

by DOJ Press November 1, 2021
By DOJ Press

PEORIA, Ill. – A man illegally living in Peoria, Illinois – Pedro Lozolla, 28, of the 2100 block of West Garden Street – was sentenced on October 29, 2021, to 37 months in federal prison, to be followed by three years of supervised release, for unlawful possession of a firearm by an illegal alien.

The firearm recovered was a modified ERA 12-gauge shotgun, the barrel of which had been sawed off.  The stock of the gun had been removed and replaced with an aluminum baseball bat. At sentencing, the government noted that Lozolla had admitted to police that he had been selling drugs for several months and possessed the firearm because he liked how it looked.

Lozolla pleaded guilty to the charge in June 2021 and agreed to forfeiture.

The statutory penalties for possession of a firearm by an unlawful alien are no more than 10 years imprisonment, up to 3 years of supervised release, and a $250,000 fine.

This case was the result of a joint investigation by the Drug Enforcement Administration; Department of Homeland Security, Immigration and Customs Enforcement; and the Peoria County Sheriff’s Office.  Assistant U.S. Attorney Katherine Legge represented the government in the prosecution.

Federal Court Orders Tampa Pharmacy to Close in Case Alleging Unlawful Opioid Distribution

by DOJ Press November 1, 2021
By DOJ Press

A federal court in Florida ordered a Tampa-area pharmacy shut down and prohibited two of its employees from ever owning, managing or operating any business where controlled substances are dispensed.

Pursuant to an agreed consent judgment and permanent injunction filed in U.S. District Court for the Middle District of Florida, the court enjoined WeCare Pharmacy, its pharmacist owner Qingping Zhang, pharmacy technician Li Yang and a related corporate entity, L&Y Holdings LLC, from ever owning, managing or operating any business where controlled substances are dispensed. The order also requires the permanent closure and dissolution of WeCare Pharmacy.

The consent decree resolves a civil complaint the government filed earlier this year alleging that the defendants repeatedly dispensed opioids in violation of the Controlled Substances Act. The complaint alleged that over a period of several years, the defendants dispensed highly addictive and highly abused prescription opioids while ignoring “red flags” — that is, obvious indications of drug diversion and drug-seeking behavior. U.S. District Judge Mary Scriven, who entered the order, previously granted the government’s request for a temporary restraining order shortly after the case was filed.

“Pharmacists and those who own and operate pharmacies have a duty to ensure that controlled substances are distributed lawfully,” said Acting Assistant Attorney General Brian M. Boynton of the Justice Department’s Civil Division. “The Department of Justice will continue to work with its partners to ensure that business owners and medical professionals handling controlled substances do not violate the Controlled Substances Act.”

“Failure to comply with professional standards and protocols while dispensing controlled substances places the public at risk of harm and is a violation of the law,” said Acting U.S. Attorney Karin Hoppmann for the Middle District of Florida. “We will continue to work with our law enforcement partners to enforce the law against those engaged in harmful practices, to keep our citizens safe.”

“Pharmacies have an obligation to ensure controlled substances are dispensed in accordance with the law,” said Acting Special Agent in Charge La Verne Hibbert of the Drug Enforcement Administration (DEA) Miami Field Division. “When they ignore that obligation, it contributes to the widespread misuse and abuse of prescription opioids that devastate our communities. The DEA Miami Field Division remains committed to working with our law enforcement partners to ensure the health and the safety of our communities.”

The investigation was conducted by the DEA.

The case was handled by Trial Attorneys Scott Dahlquist and Thomas Rosso of the Civil Division’s Consumer Protection Branch and Assistant U.S. Attorney Sean P. Keefe for the Middle District of Florida.

California Attorney Pleads Guilty To Multimillion-Dollar Investment Fraud Scheme

by DOJ Press November 1, 2021
By DOJ Press

Damian Williams, the United States Attorney for the Southern District of New York, announced that DEREK JONES, an attorney currently suspended from practicing law in California, pled guilty today to charges of carrying out a long-running wire fraud scheme, through which JONES defrauded investors out of at least $5.8 million. JONES is scheduled to be sentenced on February 23, 2022, before United States District Judge Loretta A. Preska, who accepted today’s plea.

U.S. Attorney Damian Williams said:  “For many years, Derek Jones used fake documents and falsehoods to defraud innocent investors out of millions of dollars. Such investors have every right to expect that those promoting real estate deals and venture capital investments are treating them honestly and telling them the truth about their investments. Today, Jones admitted to violating those rights.”

According to the Indictment, statements made in court, as well as other publicly-filed documents in this case:

From at least 2012 through at least 2019, JONES solicited and obtained investments into various companies and investment funds he controlled, including purported real estate development and investment firms using variations of the names “BlueRidge,” “Living City,” and “Atiswin,” and the purported venture capital firm Realize Holdings (“Realize”).

In fraudulently inducing victims to invest in his funds, JONES routinely made materially false oral and written statements, including in glossy brochures and legal documents that contained lies about real estate purportedly owned or otherwise controlled by BlueRidge, Living City, and Atiswin. For example, JONES falsely told investors and prospective investors that BlueRidge was developing a “resort village” on land it controlled in Washington State, and separately that BlueRidge had purchased an existing hotel in that same location, when in fact neither BlueRidge nor JONES owned or controlled any of that property. In other cases, JONES falsely claimed that his companies were under contract to purchase a ranch in Colorado, and that his companies had leased various pieces of property slated for development. Instead, JONES misappropriated investors’ money, using much of it to make Ponzi-like payments to other investors to whom he owed money in connection with earlier transactions, and for personal and family expenses, including the private-school tuition of his children.

In executing his scheme, JONES also sent investors and others falsified and counterfeit documents. For example, on repeated occasions JONES provided doctored bank statements stating that he had millions of dollars in various corporate accounts, when in fact he had little or no money in such accounts. On other occasions, he provided counterfeit financial statements that falsely purported to be based on internal audits of companies that he controlled.

Ad: Save every day with Amazon Deals: Check out today's daily deals on Amazon.

JONES defrauded investors—at least three of whom lived and/or transacted their banking in Manhattan—out of at least approximately $5.8 million. To prolong and conceal the fraud scheme, JONES regularly told lies designed to avoid meetings with or inquiries from victims. For example, in explaining his failure to respond promptly to questions or his reason for postponing meetings, JONES falsely told different investors, on different occasions, that one of his relatives was hospitalized and undergoing surgery. JONES also used the names of other individuals—without those individuals’ authorization or knowledge—to communicate via email with investors and thus foster the illusion that JONES’s businesses were viable operations with real employees.

*                *                *

JONES, 47, of California, pled guilty today to a single count of wire fraud.  That charge carries a maximum sentence of 20 years in prison.  The maximum potential sentence is prescribed by Congress and is provided here for informational purposes only, as any sentencing of the defendant will be determined by the sentencing judge.

Mr. Williams praised the excellent work of the Federal Bureau of Investigation.

This case is being handled by the Office’s Complex Frauds and Cybercrime Unit. Assistant U.S. Attorneys David Raymond Lewis, Michael C. McGinnis, and David M. Abramowicz are in charge of the prosecution.

This Office was one of the districts affected by the SolarWinds intrusion.

McElwee announced today that Caring Unlimited, York County’s domestic violence resource center, was recently awarded a $497,000 three-year grant from the Department of Justice’s Office on Violence Against Women (OVW) Consolidated Youth Program. Caring Unlimited’s program was one of only 16 projects selected nationally to receive such a grant.

The “Safe Communities for Youth” project will expand youth-focused prevention and intervention efforts in York County by conducting a community needs assessment, followed by the creation and implementation of a strategic plan designed to reduce victimization and perpetration of youth dating violence and sexual assaults. “We are thrilled to be a recipient of this highly competitive program. We look forward to partnering with our community to create much needed capacity for youth violence prevention programming,” said Caring Unlimited Executive Director Susan Giambalvo. “The project will take a holistic approach to creating healthy communities for youth by creating leadership opportunities for youth and engaging supportive adults to prevent and respond to youth dating violence and sexual assault. As a community, we all have a responsibility and a role to play in changing the conditions that allow domestic violence to persist.”

“Maine continues to experience a significant problem with incidents of domestic violence,” said U.S. Attorney McElwee. “We are proud of Caring Unlimited’s achievement and look forward to the work ahead as domestic violence prevention will be a priority for my office.”

Since 1977, Caring Unlimited has worked to end domestic violence in York County through service to an average of 2000 individuals annually. They offer a comprehensive array of programs including 24-hour Helpline, emergency shelter, transitional housing, individual and group advocacy and support, and legal assistance. The agency relies on volunteers to ensure that support and safety planning services are available to anyone affected by domestic abuse. North Carolina Tax Preparer Sentenced to Prison for Defrauding IRS

by DOJ Press November 1, 2021
By DOJ Press

A North Carolina tax return preparer was sentenced today to 20 months in prison for conspiring to defraud the IRS.

According to court documents and statements made in court, from 2012 through 2017, Andrea Pasley, of Durham, conspired with Karen Jones and Audrey Odom to prepare fraudulent tax returns for clients of Jones and Stone Taxes. Returns prepared by the conspirators claimed false education credits or dependents or manipulated the clients’ income to qualify for larger earned income tax credits. Under the scheme, some clients were charged up to $3,000 for preparing returns. Based on an analysis of the falsely claimed education credits, the conspirators caused a tax loss of approximately $1.2 million.

Jones and Odom also pleaded guilty to conspiracy to defraud the IRS and were sentenced earlier this year to 22 months and 15 months in prison, respectively, for their roles in the conspiracy.

In addition to the term of imprisonment, U.S. District Judge Catherine C. Eagles ordered Pasley to serve three years of supervised release and to pay approximately $1,264,493 in restitution to the United States.

Acting Deputy Assistant Attorney General Stuart M. Goldberg of the Justice Department’s Tax Division and Acting U.S. Attorney Sandra J. Hairston for the Middle District of North Carolina made the announcement.

IRS-Criminal Investigation investigated the case.

Trial Attorneys Todd Ellinwood and Kavitha Bondada of the Tax Division prosecuted the case.

For once, we can’t fault President Joe Biden for falling asleep during a meeting with foreign dignitaries. During a speech about contemporary climate change, Biden dozed off.

“Contemporary climate change includes both global warming caused by humans and its impacts on Earth’s weather patterns. There have been previous periods of climate change, but the current changes are more rapid than any known events in Earth’s history,” the Sun reported.

Gunman Shooting Passing Cars on I-95 Hits one then Accidentally Shot Himself

by Kristen Harrison-Oneal November 1, 2021
By Kristen Harrison-Oneal

PALM CITY, FLORIDA – A 59-year old man was shot while driving northbound on a stretch of I-95 between Hobe Sound and Palm City around 6 a.m. Sunday morning. The victim pulled over and called 911 complaining of sudden pain. He did not realize that he sustained a wound from a gun shot, which came through his vehicle door and hit him in the stomach area. Not far from that scene, an off-duty Riviera Beach Police Officer, who was also headed northbound in the same area, stopped to assist a motorist who crashed off the side of the road.

When the officer got out of the car, 35-year old Aaron Chase Fedukovich walked out of the wooded area holding a gun. Fedukovich appeared to have also been shot in the arm. The officer instructed Fedukovich to drop the gun, and was successfully able to take him into custody while waiting for backup.

Detectives determined that Fedukovich of Ocala, fired multiple shots at passing vehicles as he was driving northbound on the interstate. One of those rounds penetrated the car door and struck the 59-year old victim. He was flown to an area hospital where he is expected to recover. Detectives determined that Aaron Fedukovich’s gunshot wound was self-inflicted. The wound was superficial and non-life threatening. He was taken to Lawnwood Medical Center where he was treated then released into custody. He has been charged with Aggravated Battery.

Detectives also received a third report from an Indian River County resident who discovered bullet holes in his vehicle. He was in the general area at the time of the incidents. Detectives are working to determine if the incident is related.

Herschel Walker Miles Ahead In Georgia’s GOP Senate Primary, Poll Shows

Herschel Walker Miles Ahead In Georgia’s GOP Senate Primary, Poll Shows

Herschel Walker, the former NFL star-turned-Republican Senate candidate in Georgia’s primary, is the clear favorite to win the nomination in 2022, a new poll shows.

Internal polling shows 74% of Georgia GOP primary voters supporting Walker, who announced his bid in August with the vocal support of former President Donald Trump. Walker led his closest opponent, Gary Black, by 68 points, while 16% said they remained undecided.

The poll’s release comes after multiple high-profile Republicans, including Senate Minority Leader Mitch McConnell, endorsed Walker despite his past, which includes allegations of domestic violence and death threats.

Walker’s support extended to both self-described moderate and conservative Republicans, 61% and 81% of whom said they would vote for him. If Walker wins the 2022 primary, he would face Democratic Sen. Raphael Warnock, who won a special election this past January. His and fellow Democratic Sen. Jon Ossoff’s twin victories gave the party 50 seats in the Senate and complete control of Congress and the White House as a result.

Republicans are trying to retake the chamber in 2022, and McConnell called Walker “the only one who can unite the party, defeat Senator Warnock, and help us take back the Senate” in a statement to Politico Wednesday.

The poll was conducted from Oct. 11-14, before top Republicans gave Walker their public support. OnMessage Inc., the GOP consulting firm that conducted it, surveyed 400 likely Republican primary voters, and the poll has a 4.9-point margin of error.

American Airlines Cancels More Flights Citing Weather And Labor Shortage

American Airlines Cancels More Flights Citing Weather And Labor Shortage

American Airlines canceled 340 flights on Monday after cutting almost 2,000 flights during the weekend due to staffing shortages and weather delays, multiple sources reported.

The airline cut 343 flights Friday, 548 Saturday, and over 1,000 Sunday, according to American Airlines data obtained by the Daily Caller News Foundation.

The company canceled 2,291 flights as of Monday morning, representing over 10% of its schedule.

American Airlines Chief Operating Officer Davis Seymour blamed inclement weather and staffing shortages around the Dallas-Fort Worth International Airport for the delays and cancelations.

“With additional weather throughout the system, our staffing begins to run tight as crew members end up out of their regular flight sequences,” Seymour said in a statement shared with the DCNF. He added that most customers were able to rebook flights on the same day, and operations would normalize by November.

“To make sure we are taking care of our customers and providing scheduling certainty for our crews, we have adjusted our operations for the last few days this month by proactively canceling some flights,” the company said in a statement.

Other airlines have also cut massive amounts of flights.

Southwest Airlines cut over 2,000 flights earlier in October, costing the company roughly $75 million. The cancelations were first attributed to inclement weather and air traffic control issues, but the company later admitted they experienced labor shortages.

Most People Don’t Really Care About Facebook Whistleblower Leaks, Data Shows: REPORT

Most People Don’t Really Care About Facebook Whistleblower Leaks, Data Shows: REPORT

Despite recent unfavorable media coverage and intensifying Congressional scrutiny, social media interactions with news stories about Facebook declined over the course of 2021, according to data from NewsWhip reported by Axios.

The most popular news stories about Facebook since March 2021 each involved former President Donald Trump, Axios reported. The Facebook Oversight Board’s decision to uphold Trump’s ban from the platform in May, for instance, coincided with the largest spike in social media engagement with Facebook-centered news stories. Later, the former president’s July lawsuit against Facebook chief executive Mark Zuckerberg produced the second-highest jump in engagement.

Meanwhile, stories surrounding internal company documents leaked by former Facebook employee Frances Haugen did not produce a significant increase in social media interactions, the outlet reported.

Online searches for Facebook also declined over the course of 2021, according to data from Google Trends, with searches involving Facebook only increasing significantly when multiple Facebook platforms all went down at once.

Though reports based on the Facebook leaks may not have grabbed readers’ attention, they have further intensified mounting bipartisan scrutiny from lawmakers eager to rein in Facebook and other major tech companies.

Following the publication of the Facebook Files — the first batch of stories based on leaked Facebook documents and communications — lawmakers grilled Facebook executives Steve Satterfield and Antigone Davis in separate hearings over the perceived negative effects their platforms have on teen users and society as a whole. Former Facebook employee Frances Haugen testified on the leaks before the Senate in early October.

Republican Missouri Sen. Josh Hawley proposed legislation in late September stripping Section 230 liability protections from social media platforms who are found to have caused harm to children, while House Democrats proposed a bill removing Section 230 immunity from algorithmically-boosted content causing harm to users.

At Lead 10 Dead After Rebel Missile Hit Religious Facility In Yemen

At Lead 10 Dead After Rebel Missile Hit Religious Facility In Yemen

At least 10 people died and 25 were wounded after a Houthi rebel missile hit a religious facility in the province of Marib, Yemen, country officials said Monday, the Associated Press reported.

Women and children died in the attack targeting the Dar al-Hadith religious academy and mosque in Sanaa’s al-Aumd neighborhood Sunday night, according to the AP. The missiles also damaged several homes in the area, according to officials who spoke on the condition of anonymity since they weren’t authorized to speak on the matter.

Around 1,200 students attended the school but many of them left after the Houthis increased attacks around Marib last month, the AP reported. The Houthis have not commented on the attack and Yemen’s Information Minister Moammar al-Iryani said several women and children were injured.

“This horrific massacre comes after a series of systematic killings of civilians that the terrorist Houthi militia committed in the past few days,” al-Iryani said, the AP reported.

Al-Iryani asked the U.S. and U.N. Security Council to put pressure on the rebels and prosecute those involved in the attacks as “war criminals,” according to the AP.

A Houthi missile killed at least 11 people and injured 16 others in an attack on a tribal leader’s home in al-Aumd on Thursday, the AP reported. At least three children were killed in a separate Houthi attack on a neighborhood near Taiz on Saturday.

The Houthi rebels are a Shiite group of militants that started a war against Yemen’s majority Sunni government in 2004, according to the Wilson Center. The group has been connected to Iran and the Hezbollah terror group, though leaders have denied the affiliation.

Votes On Build Back Better, Infrastructure Bill Delayed As Democrats Scramble To Reach Agreement On Lowering Drug Costs

Votes On Build Back Better, Infrastructure Bill Delayed As Democrats Scramble To Reach Agreement On Lowering Drug Costs

The House Rules Committee is no longer meeting Monday to markup Democrats’ spending package, meaning that the full House vote on it and the bipartisan infrastructure bill will be delayed past Tuesday, when Democratic leadership originally sought to pass the linked legislation.

An aide said Sunday that the committee would need “additional time to craft language and get final agreement with all parties involved,” telling Punchbowl News that “extensive progress” had been made, and that the House would vote “as early as possible this week.”

Democrats have been trying to compromise on a provision allowing Medicare to negotiate drug prices in a bid to lower them. Though the policy has the support of nearly every Democrat and the overwhelming majority of the American people, some in the party, notably Arizona Sen. Kyrsten Sinema, have opposed efforts to allow price negotiations.

“We have made extensive progress on Rx drugs and other key initiatives which were not included in the text posted to Rules on Thursday,” the aide said.

The left wing of the Democratic Party has insisted that drug pricing reforms be included in the package, which can move through Congress without any Republican votes as long as Democrats stay united in voting for it. They delayed another vote on the bipartisan infrastructure bill last week after insisting that it be voted on in tandem with the broader spending package, the text of which was released Thursday.

“[Biden] reaffirmed, as our Caucus has month after month, that both the infrastructure bill and the popular Build Back Better Act must move together because they are part of the same agenda,” Washington Rep. Pramila Jayapal, the chair of the Congressional Progressive Caucus, said Thursday.

The votes’ delay means that they will be considered after Virginia voters head to the polls Tuesday to decide their state’s next governor. Though Republicans have not won a statewide race in Virginia since 2009 and President Joe Biden won the state by 10 points last November, GOP candidate Glenn Youngkin is running neck-and-neck with former Democratic Gov. Terry McAuliffe, with polling trackers showing him taking a narrow lead in the final days of the campaign.

Many forecasters have described the race as a bellwether for next year’s midterm elections, where Democrats are defending their current 220-212 House majority and a 50-50 Senate.
