ALBUQUERQUE, N.M. – An Albuquerque man who went into a bank to rob it was told that the indoor lobby was closed due to COVID-19 and social distancing and all transactions must be made from the drive-through window.  He then left the lobby and walked around the drive through window to rob the bank from there instead.

According to a criminal complaint, on Dec. 16, Hansen allegedly entered a bank and was informed by a teller that transactions must be conducted at the drive-through window. Hansen allegedly returned the withdrawal slip with a demand for money. Understanding the bank was being robbed, the tellers backed away from the teller line and activated the security alarm. Hansen then allegedly returned to the vehicle in which he had arrived and fled.

Hansen was later identified through his involvement in an unrelated incident.

If convicted, Hansen faces up to 20 years in prison. A complaint is only an allegation. A defendant is presumed innocent unless and until proven guilty.

BRISTOL, CT – John H. Durham, United States Attorney for the District of Connecticut, today announced that a federal grand jury in New Haven has returned an indictment charging XAVIER CRUZ, 26, of Bristol with firearm offenses.

The indictment was returned on December 21.  Cruz appeared yesterday via video conference before U.S. Magistrate Judge Robert A. Richardson, entered a plea of not guilty to the charges, and is released on a $100,000 bond.

It is alleged that, on September 5, 2020, law enforcement found a backpack containing a loaded Smith and Wesson semiautomatic handgun in a parking lot in a residential area of Bristol.  The handgun’s serial number had been removed.  Investigators subsequently determined that Cruz had possessed the firearm before discarding it.

Prior to September 2020, Cruz sustained felony convictions in state court for controlled substance offenses.  It is a violation of federal law for a person previously convicted of a felony offense to possess a firearm or ammunition that has moved in interstate or foreign commerce.

The indictment charges Cruz with one count of possession of a firearm by a convicted felon, which carries a maximum term of imprisonment of 10 years, and one count of possession of a firearm with an obliterated serial number, which carries a maximum term of imprisonment of five years.

U.S. Attorney Durham stressed that an indictment is only a charge and is not evidence of guilt.  Charges are only allegations and a defendant is presumed innocent unless and until proven guilty beyond a reasonable doubt.

This matter is being investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives, and the Bristol Police Department.  The case is being prosecuted by Assistant U.S. Attorneys Tara Levens and Margaret Donovan.

This prosecution has been brought through Project Safe Neighborhoods (PSN), a program bringing together all levels of law enforcement and the communities they serve to reduce violent crime and make neighborhoods safer for everyone.

NORMAN, OK – A Norman man pleaded guilty today in U.S. District Court for his role as a money launderer in a Nigerian romance scam that defrauded multiple victims, including elder Americans, of millions, announced U.S. Attorney Trent Shores.

Tobiloba Kehinde, 28, pleaded guilty to conspiracy to commit money laundering before U.S. District Court Judge Gregory K. Frizzell. Kehinde’s sentencing hearing is set for March 29, 2021.

“In the last year, Americans were defrauded out of more than $200 million due to romance scams. Whether these con artists are romancing vulnerable elder victims online or facilitating money laundering to hide the illicit proceeds, this U.S. Attorney’s Office will never stop fighting to get justice for the victims,” said U.S. Attorney Trent Shores. “Today, Tobiloba Kehinde, becomes the third conspirator brought to justice for his role in a Nigerian romance scheme.”

In his plea agreement, Kehinde admitted that he knew the money involved in the financial transactions involved the proceeds from unlawful activity. He further stated that he knew the financial transactions were designed, in whole or in part, to conceal or disguise the nature, the location, the source, the ownership, or the control of the proceeds of the unlawful activity.

From 2017 through and November 2019, Kehinde knowingly concealed the proceeds of a romance scam operation by moving money between and among multiple bank accounts that were opened under various aliases using fake passports and other fraudulent identification documents to obscure the source of the funds and the identities of the co-conspirators. Court documents state that he and his co-conspirators took further steps to conceal the source of the funds, took a commission, and directed the remainder of the funds back to the online romance scammers in Nigeria, including in the form of vehicles and vehicle parts.

According to court documents, Kehinde coordinated with overseas co-conspirators who had assumed false identities on online dating websites and social media platforms with the intent to defraud victims. Kehinde opened several accounts using fraudulent identities, including “Jeff Atto” and “Ari Lawson,” then provided the account and routing numbers to the overseas co-conspirators.  The overseas co-conspirators told victims they were U.S. residents working abroad. In fact, the investigation revealed that these overseas co-conspirators were located in Nigeria. As these online “relationships” continued, the overseas co-conspirators’ would request increasingly larger sums of money, claiming that the funds were needed to complete business projects or to return to the United States. The victims were directed by the overseas co-conspirators to send funds to Kehinde and others’ bank accounts, assuring the victims that he would allocate the money as needed.

Kehinde and his co-defendants were charged in November 2019. Afeez Olajide Adebara, 35, and John Oluwaseun Ogundele, 31, have also pleaded guilty.

The remaining defendants are Joshua Naandom Ditep, 26, Nigerian citizen and lawful permanent resident of the United States residing in Norman; Paul Usoro, 26, Nigerian citizen and lawful permanent resident of the United States residing in Norman; Chibuzo Godwin Obiefuna, Jr., 27, U.S. citizen residing in Long Beach, California; Jamiu Ibukun Adedeji, 24, Nigerian citizen, residing in Norman; First and last name unknown #1, who maintained an address in Brooklyn, New York; First and last name unknown #2, who maintained an address in Dallas, Texas; and First and last name unknown #3, who maintained an address in Dallas, Texas. Ditep, Usoro, Obiefuna, and Adedeji await trial while the three additional co-defendants remain fugitives.  These remaining defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.

The FBI’s Oklahoma City Field Office conducted the investigation. Trial Attorney Babasijibomi Moore of the Criminal Division’s Fraud Section and Assistant U.S. Attorney Christopher Nassar of the Northern District of Oklahoma are prosecuting the case.

VERO BEACH, FL –  Two Vero Beach teens are in custody after putting on their own New Years Eve fireworks show, with guns aimed at apartment units here.  The Indian River County Sheriff’s Office received multiple calls regarding shots being fired at Palms of Vero last night at 7:36 p.m. Two males, age 15 and 17, were ultimately arrested on charges that include possession of firearm by a delinquent.

In accordance with public records laws, the minors’ identities have been withheld.

Witnesses reported approximately two dozen shots were fired. Apartment Tropical Villas North, a neighboring complex, was hit by at least three stray rounds; one of which entered a living room of an occupied apartment.  Sheriff’s deputies arrived on scene and located dozens of rounds near mailboxes in the Palms of Vero complex. While responding, Dep. Rodriguez saw a white SUV driving recklessly south on Old Dixie Highway and began to approach. However, before deputies could make contact, the vehicle ran the red light at Oslo and Old Dixie Highway at speeds estimated to be more than 50 mph.

The vehicle accelerated, driving into oncoming traffic at speeds in excess of 70 mph. The deputy was able to catch up to the vehicle as it approached Highlands Drive. He observed the tag was obscured by what he believed was a plastic bag. When the suspect driver saw authorities, he further accelerated to speeds over 120 mph and fled into St. Lucie County.

Back at the apartment complex, video surveillance showed the suspect vehicle pulling into the complex just prior to the shots fired. An anonymous source provided the first suspect’s name as being one of the shooters. He was located sitting in a second vehicle with three other males. This vehicle was not involved in the high speed chase into St. Lucie County.

Inside the vehicle in plain view were two pistols, a .40-caliber Springfield XD and a 9mm SCCY. The .40-caliber was discovered to be stolen during an auto burglary out on Nov. 24. The car in question was unlocked.

Another suspect, a known burglar, admitted to possession of the Springfield XD but denied the firing of it, even though the rounds in the magazine matched the shell casings at the scene.
Investigators tied the SCCY to the first suspect, based on the location of the firearm and evidence pictures. He, too, denied knowing about the shooting. However, there were spent casings also consistent with his firearm.

Both suspects were arrested around 8 p.m. Dec. 28 and later taken to the Department of Youth Services.

“For the safety of our community, the Indian River Sheriff’s Office urges everyone in our community who owns a firearm to be a responsible gun owner and lock their guns up when they are not being legally carried,” the agency said.

The shooting incident is still under investigation. If you have video of the incident please contact the Sheriff’s Office and ask for Det. Scribner, 772-569-6700.

On Wednesday, Dec. 30., his patient called authorities after he refused to leave her residence. Giacoboni had been drinking and wanted to take the patient’s vehicle. The patient did not want him to leave with the vehicle.

At that point Giacoboni “became enraged” attempting to snatch her purse as the patient was seated in the wheelchair. As he did so, he pulled the woman from her wheelchair. After she fell, she continued to hold onto the purse and was pulled across the floor. During the scuffle, the patient “grabbed Giacoboni’s genitals in an attempt to get Giacoboni to release her.” Giacoboni then removed from the purse the keys to the vehicle and left the home. He later returned and was drunk and aggressive with her. That is when the patient called authorities.

The patient told investigators that, prior to the incident, she had given Giacoboni permission to drive the car. Giacoboni is being held on $10,000 bond.

EAST NAPLES, FL – An East Naples man was arrested today and charged with a felony after detectives say he pointed a laser light at a Collier County Sheriff’s Office helicopter.
Michael Christian Adcox, 43, of 1328 Wildwood Lakes Blvd. Unit 5, is charged with misuse of a laser lighting device, a third-degree felony.

A crew was flying Air1 on patrol over the area of Davis and Santa Barbara boulevards about 1 a.m. Monday when they became engaged by a green laser light shining inside the aircraft. The laser hit the tactical flight officer in one of his eyes, causing him to lose sight for a few seconds.

The pilot then flew the helicopter toward the laser while the tactical flight officer looked for where the laser was coming from. They determined the laser was coming from the Wildwood Lakes area.

Using infrared technology, crew members then closed in on the area and pinpointed a suspect, later identified as Adcox. They maintained observation on Adcox and guided patrol deputies on the ground to his residence.

Adcox admitted to pointing the laser but told deputies it was an accident. Further investigation by detectives revealed Adcox repeatedly flashed the laser at the CCSO helicopter. The activity lasted two to three minutes. Probable cause for his arrest was established.

Detectives located Adcox at his residence today and took him into custody. Florida State Statute 784.062-3a says “any person who knowingly and willfully shines, points, or focuses the beam of a laser lighting device on an individual operating a motor vehicle, vessel, or aircraft,” can be charged with a third-degree felony.

SPRINGFIELD, MA – A Massachusetts State Trooper was shot after responding to a shots fired incident in Springfield.

According to the Massachusetts State Police, just prior to 11:20 p.m. Thursday night a Massachusetts State Police Trooper responded to a multiple shot-spotter activations, indicating multiple shots fired, in the area of 104 Stafford St., Springfield. A Springfield Police Officer also responded to the activation and arrived at the scene simultaneous with the Trooper’s arrival. The Trooper and Officer each turned onto Nursery Street, which intersects with Stafford, to seek the source of ongoing gunshots that were audible to them and address any ongoing threat to public safety.

Evidence suggests that upon the arrival of the Trooper and Officer onto Nursery Street, a male suspect fired two rounds at their cruisers. The Trooper, a 26-year-old male assigned to the State Police-Springfield Barracks, was struck by one of the rounds while still in his cruiser. The Trooper was struck in his left leg after the round passed through part of the cruiser.

The Trooper exited the cruiser and the Springfield Officer provided emergency medical aid, including application of a tourniquet to the Trooper’s leg.

A second Trooper, Trooper Richard Caron, arrived at the scene moments later and transported the wounded Trooper to Baystate Medical Center.

A description of the potential suspect was broadcast by State Police-Springfield. Moments later an MSP K9 Unit Trooper observed a male fitting the suspect‘s description running on Stafford Street. The Trooper pursued the suspect on foot into a nearby backyard but lost sight of him. A short time later Springfield Police Officers located and arrested that suspect.
The suspect taken into custody was identified as CHRISTOPHER GARDNER, 31, of the Springfield area.

Following subsequent investigation by Troopers from the State Police Detective Unit for Hampden County, GARDNER was charged with the following offenses and booked at State Police-Springfield:
1. Armed assault with intent to murder (2 counts);
2. Assault and battery by discharge of firearm;
3. Assault with a dangerous weapon;
4. Unlawful possession of a firearm; and
5. Discharging a firearm within 50 feet of a building.

GARDNER was held at the Barracks through the night and then transferred to the House of Correction in Ludlow, held on $150,000 cash bail. He will be arraigned Monday in Springfield District Court.

State Police investigators recovered two handguns from the area of the shooting, and interviewed multiple potential witnesses. While GARDNER was being interviewed by investigators, Troopers discovered a minor injury to his foot. He was briefly treated at a hospital and released.

Preliminary investigation indicates that at around 11:17 p.m. GARDNER exchanged gunfire with another man, with whom he was involved in an altercation, in a parking lot near the intersection of Nursery and Stafford street. It was that exchange of gunfire that activated the shot-spotter alerts that prompted the initial response by the Trooper and the Springfield Officer. That exchange of gunfire with the other man is also being investigated as the source of the injury to GARDNER’s foot. The other man who was involved in the altercation with GARDNER has not been located. The injured Trooper received emergency treatment at Baystate Medical Center and was released earlier this morning. He will remain on injured leave while recovering.

Colonel Christopher S. Mason, Superintendent of the Massachushetts State Police, issued the following statement:

“I commend our Trooper for his proactive response to the shot-spotter alert that led to his being shot. He rushed to a scene where he knew violence was occurring, in order to investigate and end a threat to public safety. I am also extremely grateful to the Springfield officer who cared for our injured Trooper at the scene, to Trooper Caron, who rushed to his fellow Trooper’s aid and took him to the hospital, and to the medical professionals who cared for him there. Last night’s shooting once again underscores the dangers faced on any given shift by Massachusetts State Troopers and all police officers who protect our communities. Again we are reminded — as if any reminder was necessary— that no tour of duty is routine or predictable for law enforcement officers. We will continue to investigate the incident, work with prosecutors to hold the suspected shooter accountable for his actions, and provide all necessary support to the Trooper who was injured.”

The investigation into the facts and circumstances of the incident, including the initial shooting between GARDNER and the other man, is ongoing. That investigation is being conducted by the State Police Detective Unit attached to the Hampden District Attorney’s Office along with Troop B of the Massachusetts State Police, Springfield Police, the State Police Crime Scene Services Section, the State Police Firearm Identification Section, and the State Police Collision Analysis and Reconstruction Section (which mapped the crime scene).
