NJ.com Report: Amtrak train slams into car stuck on tracks in New Jersey. Police dashcam captures crash.

Newark, DE – Delaware State Police are investigating a fatal motor vehicle collision that claimed the lives of two individuals late last night.

The incident occurred on November 25, 2020, at approximately 10:40 p.m., when a 2000 Honda Civic operated by a 22-year-old male of North East, MD, was traveling northbound on I-95 in the left center lane north of the Churchman’s Road overpass. A vehicle not involved in the crash merged from the right-center lane into the left-center lane and caused the Civic to lose control and strike the concrete Jersey barrier. The Civic then became disabled in the left lane of I-95 northbound.

A 29-year-old male of North East, MD, that was traveling in front of the Civic pulled over on the shoulder after witnessing the collision and exited his vehicle to check on the operator of the Civic. At the same time, a 2020 Kia Stinger was rapidly approaching the disabled Civic in the left lane. The Operator of the Stinger, a 20-year-old male of Wilmington, DE, veered his vehicle into the left shoulder to avoid striking the Civic but ultimately side swiped the Civic and struck the 29-year-old male standing on the shoulder. After being struck, the pedestrian came to rest in the left southbound lane of I-95, where he was struck by a 2010 Chevrolet Camaro operated by a 19-year-old of Newark, DE.

After striking the pedestrian, the Kia continued traveling out of control until it struck the rear of a 2018 Ford Focus operated by a 25-year-old female of Delmar, DE, who slowed down in the left lane to assist the disabled motorist. The impact caused the Focus to be pushed forward and strike the concrete Jersey barrier on the left shoulder.

The operator and passenger of the Honda Civic were not injured in the collision. The operator and passenger of the Kia Stinger were both transported to a nearby hospital for minor injuries. The operator of the Chevy Camaro was not injured in this collision.

The operator of the Ford Focus was transported to a nearby hospital where she was pronounced deceased.

The pedestrian was pronounced deceased at the collision scene. Both names are being withheld at this time pending the notifications of next of kin.

During the course of the initial investigation, only the two left lanes for southbound I-95 were closed to vehicular traffic. On the northbound side, the left three lanes were closed to vehicular traffic.

This crash remains an active and ongoing investigation.  Anyone with information regarding the crash should contact Det. WILDWOOD, NJ  – On Saturday, November 21, 2020, at approximately 22:13 hours, the Wildwood Police Department Uniformed Patrol Division responded to the 300 block of East Magnolia Avenue within the City of Wildwood for the report of an unwanted guest possessing a weapon at that location. Arriving officers made contact with the actor, Donald Falcone, a 62-year-old unemployed cab driver from North Wildwood, standing outside the property.

The investigation revealed that the victims were inside their residence when Falcone knocked on the door to their apartment. As the female victim opened the door, Falcone forced his way inside while holding a crowbar-type object in a manner which led her to believe that he was preparing to strike her. A male resident of the apartment who observed Falcone’s actions rushed to intervene, pushing Falcone backwards and away from the female victim.

Falcone then dropped the crowbar and retrieved two nearby kitchen knives. After a brief struggle, the victims were ultimately able to disarm Falcone, during which the male victim sustained a small laceration to his upper back. Falcone then exited the residence.

The victims immediately contacted police and Falcone was stopped by officers moments later while still on the property.

The Wildwood Police Department Detective Division continued the investigation, securing formal statements from the parties involved. As a result, Falcone was charged with the following offenses:
Burglary
Aggravated Assault – 2 counts
Unlawful Possession of a Weapon – 2 counts
Possession of a Weapon for Unlawful Purpose – 2 counts

LEXINGTON, S.C. – Lexington County deputies have arrested and charged two men in a shooting in Swansea that injured a woman Wednesday morning.

Xavier Marquis Golson (left), 23, and Jose Cedeak Antonio Haygood, 25, are charged with two counts of attempted murder, attempted armed robbery and possession of a weapon during a violent crime, according to arrest warrants.
A female passenger was struck in the head, according to Koon. The woman continued to receive care at the hospital for what her medical team described as a serious injury, but she has since passed.
“With the help of recovered evidence and witness statements, detectives have determined this shooting happened after Golson and Haygood tried to rob a man and a woman who were in a car parked in the 800 block of Bachman Dykes Road,” Lexington County Sheriff Jay Koon said. “Golson and Haygood fired multiple shots at the car as it drove away.”
“We’re saddened to report the shooting victim in this case died over the weekend. Charges against Golson and Haygood have been upgraded to murder,” the Lexington County Sheriff’s Office said in a statement.
“Golson turned himself in at our headquarters Thursday morning followed by Haygood Thursday night,” Koon said.

NEW YORK, NY – The United States Supreme Court has barred, temporarily an executive order issued by New York Governor Andrew Cuomo that restricts religious gatherings.   The 5-4 decision ruled that Cuomo’s executive order was in violation of the First Amendment.

“The restrictions at issue here, by effectively barring many from attending religious services, strike at the very heart of the First Amendment’s guarantee of religious liberty,” the decision read.

The case was filed against the state by the Catholic Diocese and Orthodox Jewish Synagogues in New York.

“The applicants have clearly established their entitlement to relief pending appellate review. They have shown that their First Amendment claims are likely to prevail, that denying them relief would lead to irreparable injury, and that granting relief would not harm the public interest,” the ruling stated.

In a red zone, while a synagogue or church may not admit more than 10 persons, businesses categorized as “essential” may admit as many people as they wish. And the list of “essential” businesses includes things such as acupuncture facilities, campgrounds, garages, as well as many whose services are not limited to those that can be regarded as essential, such as all plants manufacturing chemicals and microelectronics and all transportation facilities.

“These categorizations lead to troubling results,” the court ruled. ”

“The loss of First Amendment freedoms, for even minimal periods of time, unquestionably constitutes irreparable injury,” the opinion by the Supreme Court stated.

“These restrictions apply even to the largest cathedrals and synagogues, which ordinarily hold hundreds. And the restrictions apply no matter the precautions taken, including social distancing,” Supreme Court Justice Neil Gorsuch said, “Government is not free to disregard the First Amendment in times of crisis. At a minimum, that Amendment prohibits government officials from treating religious exercises worse than comparable secular activities, unless they are pursuing a compelling.”

“New York’s restrictions on houses of worship not only are severe, but also are discriminatory,” Justice Kavanaugh wrote.

GLOUCESTER TOWNSHIP, NJ  –   Two adults and a juvenile have been charged in connection with starving a pair of two-month-old twins, leading to the death of one of the infants, according to Acting Camden County Prosecutor Jill S. Mayer and  Gloucester Township Police Chief David Harkins.
Joy Wilson, 36, Sharode Snell, 22, and a 17-year-old juvenile, all of Lindenwold, have each been charged with one count of second-degree Manslaughter, two counts of second-degree Endangering the Welfare of a Child, and one count of second-degree Aggravated Assault.
Police were called to the La Cascata Apartments on July 8, 2019, for a report of an unresponsive infant. The infant was transported to an area hospital and was pronounced dead.
After performing an autopsy, a medical examiner requested additional testing to determine the infant’s cause and manner of death. Detectives said the other two-month-old infant was admitted to the hospital after doctors determined the baby was severely underweight and had healing injuries.
The infant’s death was ruled a homicide by the medical examiner on July 8, 2020 after test results confirmed the baby’s death was not due to a genetic disorder, but starvation.
“This is one of those tragic cases that you can hardly believe when you learn the suffering these two babies went through, ultimately leading to one of their deaths,” said Mayer. “While we are deeply saddened that one of the babies died as a result of this abuse, we are grateful that her twin sister was able to be treated and is now thriving and safe. The lengthy and meticulous investigation in this matter was of paramount importance to everyone who took part in it-, from the CCPO detectives, assistant prosecutors, and victim advocates to the Gloucester Township detectives, to the doctors at the New Jersey CARES Institute, to the Camden County Medical Examiner’s Office. Each agency worked tirelessly to bring about some measure of justice for these babies.”
Wilson was arrested in Lindenwold on Nov. 19. Snell and the 17-year-old were located and arrested in North Carolina by the U.S. Marshals Fugitive Task Force on Nov. 23.
Wilson was transported to the Camden County Correctional Facility awaiting a detention hearing. Snell and the 17-year-old are in custody in North Carolina awaiting further court proceedings.
All persons charged with crimes are presumed innocent until proven guilty in a court of law.

MAYS LANDING- A 70-year-old Egg Harbor City man has been convicted of sexual assault and endangering the welfare of a 12-year-old girl, Atlantic County Prosecutor Damon G. Tyner announced.

On Nov. 16, 2020, before Honorable Bernard Delury, Jr. P.J. Cr., an Atlantic County jury found Jose A. Rodriguez guilty of two counts of second-degree sexual assault and third-degree endangering the welfare of a 12-year-old girl when he sexually assaulted her on Aug. 20, 2019. gave her $10.00 and told her “not to tell anyone about what happened in his house because he didn’t want to get in trouble with the police.”  The victim reported later that evening to her mother what the defendant had done and the family went to the police to report it.

“Sexual assaults against children are some of the most heinous crimes that we prosecute.  As a society, we have an obligation to protect those who are too young or naïve to fend off dangerous predators such as this defendant.  I want to applaud the courage of this strong young lady to first, tell her parents about the assault, and then face her abuser in open court and testify.  I am hopeful that this defendant will never have the opportunity to abuse anyone ever again,” Atlantic County Prosecutor Damon G. Tyner said.

During a bench trial before Judge Delury on November 19, 2020, Rodriguez was also found guilty of one count of violation of community supervision for life. When Rodriguez sexually assaulted the 12-year-old girl, he was on Megan’s Law and subject to parole conditions. Rodriguez’s contact alone with a child put him in direct violation of his parole conditions. Rodriguez was previously convicted of a prior aggravated criminal sexual contact with a minor when he pled guilty and was sentenced to that conviction on June 11, 2004.

Assistant Prosecutor Erika Halayko represented the State in both trials. Sentencing is scheduled for February 26, 2021.

“The victim was very brave in coming forward to tell someone even though the defendant tried to buy her silence,” said Assistant Prosecutor Erika Halayko. “This type of behavior where he tried to bribe her by giving her money and the promise of gifts shows the lengths that this defendant was willing to go to not get caught. However, the jury was able to see that this defendant committed these heinous crimes against a vulnerable child and justice has been served for her and her family.”

Anyone with information involving any serious crimes are asked to call the Atlantic County Prosecutor’s Office at 609-909-7800 or go to the Prosecutor’s Office Web site at https://www.acpo.org/tips.html and provide information by filling out the form anonymously on the Submit a Tip page. TOMS RIVER, NJ – Freeholder Virginia Haines said she feels like her fellow Freeholder, Joseph Vicari doesn’t like her and opposes her out of principle since her appointment to the Board of Chosen Freeholders was brokered in a backroom deal at the offices of former GOP Chairman Joe Buckelew back in 2016.  Vicari, who often was at odds with former GOP Chairman George Gilmore has never said why, but Haines’ initial non-elected appointment was blessed by former Chairman George Gilmore at that same meeting, according to several sources involved in the discussions at the time.  Could it be that Vicari who has fought through decades of smear campaigns against him has managed to win election after election on his own merit, while Haines was propped up on the party line in 2019 to secure a victory in which she came in second behind Jack Kelly?

In a story at the Asbury Park Press today, Haines, “Vicari…has treated her with condescension and has sought to undermine her ever since she was sworn onto the board in 2016, she feels. His opposition was always a foregone conclusion.”

“He told me he was sorry for being so tough,” Haines told the Asbury Park Press. “I told (Vicari), ‘it’s OK, you do it to me all the time.’”

Haines was upset after Vicari led the charge to shoot down a proposal by Haines that would free up the $60,000,000 Ocean County Natural Lands Trust Fund to be used to bail out politically connected mayors such as Mo Hill in Toms River, who was seeking $2,000,000 from the fund to purchase already preserved land.  Under the rules set forth by now-deceased former Ocean County Freeholder John Bartlett, that money cannot be used to buy public land already preserved by another governing body, just private land, to prevent it from being developed by real estate developers.

It is now rumored that Haines will be running as Lt. Governor to “never Trumper” Jack Ciattarelli. Ciattarelli, who once said President Trump is a charlatan, not fit to be President is running against liberal socialist Phil Murphy.  Heaven help us.
