NEW YORK, NY – A viral video that was released back in May featuring New York Governor Andrew Cuomo is making rounds again on the internet after the governor’s series of somber and threatening press conferences in the past week.   In  May, for Cuomo, COVID-19 was something to be laughed at, mocking those who died.  Today, even speaking the word COVID-19 can eject lethal particles into the air that can kill everyone at your Thanksgiving dinner next week.

“There’s a video that went all over the place about a young guy who was in Florida and on he’s on the video saying only young guys get it,” Cuomo said laughing and chuckling.  “And now he’s dead”

The video was resurfaced after Cuomo launched a tirade against the President, saying he’s not taking the COVID-19 pandemic seriously on Monday.

“This was the President himself. Liberate Michigan, Liberate New York, organizing protests against governors who were trying to protect the people in their state. He’s been in denial of the situation from day one. He’s never been productive. The best thing he did was just abdicate responsibility and give it to the states. But I don’t see anything different from this President. He has been incompetent and lied frankly about COVID from day one,” Cuomo said. “It’s hard to get to the place where you don’t take the President of the United States seriously. There’s a disconnect. You say President of the United States, you think that it’s a serious person. That’s not this President. ”

Conservative commentator Dan Bongino talks about the many flaws and ‘unexplainable and trouble questions’ surrounding the Dominion voting platform that has been cited for multiple problems during the election.

“Report: Dominion deleted 2.7 million Trump votes nationwide. Data analysis finds 221,000 Pennsylvania votes switched from President Trump to Biden. 941,000 Trump votes deleted. States using Dominion Voting Systems switched 435,000 votes from Trump to Biden,” President Donald J. Trump claimed.

Dominion has refuted those claims, “No credible reports or evidence of any software issues exist. Dominion equipment is used by county and state officials to tabulate ballots. Human errors related to reporting tabulated results have arisen in a few counties, including some using Dominion equipment, but appropriate procedural actions were made by the county to address these errors were made prior to the canvass process.”

TRENTON, NJ –  The New Jersey ABC has been weaponized by the administration of Governor Phil Murphy to enforce social distancing executive orders and fining businesses found in non-compliance with Murphy’s Law.  It has been several months since any large-scale enforcement actions have been taken against New Jersey’s struggling businesses, but it’s back.

This week, the Murphy administration announced that it will begin issuing citations to bars and restaurants for executive order violations such as exceeding maximum capacity, violating curfew restrictions and not enforcing mask-wearing or social distancing.  Prosecutors will soon be following up with criminal charges against those businesses, the state said.

“On Friday evening, Little Falls Police Department responded to Chelas Restaurant and observed several patrons at the bar, not social distancing. That restaurant was cited. To the Governor’s opening remarks, ABC investigators, criminal justice investigators, along with local law enforcement conducted 104 compliance checks,” said New Jersey State Police Superintendent Patrick Callahan.  “15 of those establishments appeared to be in violation and those respective prosecutor’s offices in Camden, Hudson and Passaic are working through that. I’m not going to read through the list of the 15 places, but I’m sure we can make that available once those violations, once they’re physically and actually cited.”

TRENTON –  New Jersey Governor Phil Murphy announced on Monday that over 4,450 new positive cases of COVID-19 have been reported and has signaled the start of New Jersey’s second shutdown.  Starting next Monday, indoor gatherings will be restricted in New Jersey and Thanksgiving dinner has been shrunk to just 10 people.

“I know you think you’re invincible.  Maybe you think that people aren’t getting sick anymore, or going to the hospital, or dying anymore,” Murphy said.  “Maybe you think you’re the victim of some witch hunt. Whatever that reason is, I can assure you it false. It is a myth.”

“And to that end, I must again pull back the reins at another aspect of our reopening. It gives me no joy to be doing this, by the way. Today I’m signing an Executive Order to reduce indoor gathering limits to no more than 10 persons; that’s down from 25 persons,” Murphy said. “That’s a limit that we set that has been in existence since August 3rd. This provision will take effect tomorrow morning at 6:00 a.m. There are several exemptions from this: religious services or celebrations, political activities, wedding ceremonies, funerals or memorial services, and performances will continue to be limited to 25% of capacity but with a maximum of 150 people. But all other private indoor gatherings such as house parties and public events must be capped at no more than 10, and in this we will be in In line with a growing number of our fellow states throughout the region. We had a really good five Governors Zoom call yesterday with New York, Pennsylvania, Delaware, Connecticut, and myself, and more on that later, but that was one of many of the good exchanges we’ve had over the past eight or nine months.”

Murphy said New Jerseyans must readjust their Thanksgiving plans.

“What we’re doing today we know will cause some people to readjust their Thanksgiving plans, and I understand why there might be frustration with this step. But as we have been saying, Judy and I in particular, with a good helping from Pat and Tina and others, we’ve been saying for weeks that this will not be a normal Thanksgiving,” Murphy said. “It’s not a normal school year, it’s not a normal Thanksgiving, it wasn’t a normal Halloween, it won’t be a normal Hanukkah or Christmas, and 2020 won’t be normal, period. We’re urging everybody to keep their Thanksgiving plans as small as possible because we know that indoor gatherings and homes are particularly dangerous places for COVID-19 to spread. The smaller the gathering is, the less likely it is that someone is infected and puts their loved ones at risk. It is that simple.”

Governor Phil Murphy on Monday signed Executive Order No. 196, which lowers indoor and outdoor gathering limits. Effective Tuesday, November 17 at 6:00 a.m., the indoor gathering limit will decrease from 25 to 10 people. The outdoor gathering limit will decrease from 500 people to 150 people, effective Monday, November 23 at 6:00 a.m.

“As we have been saying for weeks, this will not be a normal a holiday season, and it’s incumbent on all of us to avoid the type of gatherings that have proven to be particularly dangerous places for COVID-19 to spread,” said Governor Murphy. “With the alarming numbers we are seeing right now, we have to take these steps today to preserve and protect public health and to slow the spread of this virus.”

The limit for weddings, funerals, memorial services and religious and political activities remain unchanged and will be limited to 25% of the capacity of the room in which the gathering takes place, up to a maximum of 150 individuals.

Indoor sporting competitions and practices will be permitted to exceed the 10 person limit only for individuals necessary for the practice or competition, such as players, coaches, and referees, but may not exceed 150 individuals.  For most indoor sports, this will mean that there can be no spectators.

Legislative and judicial proceedings are not subject to the indoor gatherings limits.

Weddings, funerals, memorial services, and religious and political activities are not subject to the outdoor gatherings limit. All other types of gatherings, such as a high school football game or an outdoor concert, will be limited to 150 individuals.  Athletes, coaches, referees and other individuals necessary for a professional or collegiate sports competition are not counted towards the 150 person limit.

Outdoor gatherings continue to be subject to strict social distancing restrictions, including the requirement to wear masks whenever it is not possible to social distance.

Magadan, Nagaeva bay, Russian Federation  – When you hear the term killer whales, you might think of the movie Orca or you might think Sea World.  Regardless of what your impression is on the killer whale, it’s truly majestic and possibly frightening.  A fishing boat crew in Russia had a pod of whales tail them.  What a whale tale they can tell everyone now.

LOS ANGELES – A Glendale man was sentenced today to 84 months in federal prison for running a series of “bust out” scams that defrauded more than 20 banks out of nearly $5 million by, among other things, using fraudulently obtained credit cards to buy millions of dollars in liquor and cemetery plots that were later sold for a profit.

Mikayel Hmayakyan, 43, was sentenced by United States District Judge George H. Wu, who also ordered him to pay $4,906,534 in restitution. Hmayakyan pleaded guilty on June 29 to two counts of bank fraud and one count of aggravated identity theft.

A “bust out” scam is a form of fraud in which a person applies for a credit card, often using a stolen identity, with the intention of “maxing out” the card with no intention of paying off the debt.

Hmayakyan and his co-conspirators fraudulently obtained credit cards – sometimes using their real names, but also with synthetic identities created with a combination of real and fictitious information. After the cards were run up to the credit limit, members of the scheme “paid down” the cards by submitting payments from accounts with insufficient funds or through other fake accounts to restore the credit line, which allowed them to make additional fraudulent purchases.

For example, from 2014 through 2017, Hmayakyan – with no intention to pay any credit card bills – charged and directed others to charge over $3 million to buy things such as liquor, Rolex watches and Forest Lawn cemetery plots.

The liquor was purchased on behalf of the now-closed Liquor Spot in Glendale, where co-defendant Vahan Aloyan, 45, of Glendale, was a manager. During the execution of a search warrant in 2016, law enforcement seized more than 37,000 bottles of alcoholic beverages, worth approximately $300,000, from the Liquor Spot. They also seized nearly $13,000 in cash from the store, as well as nearly $13,000 in cash and 37 watches and other jewelry items from Aloyan’s residence, according to court documents.

In another set of scams, from 2010 through 2011 and again from 2015 through 2016, Hmayakyan applied for a number of loans in the name of real and fictitious people. He used the loan proceeds to finance the purchase of vehicles, but would not make the payments. Hmayakyan caused losses of more than $400,000 to the banks who gave those loans.

The total actual loss to which the financial institutions were exposed was $4,906,534.

Gayane Hakobyan, 70, of Hollywood Hills, admitted in June that she participated in the “bust-out” scheme by allowing others to open credit card accounts in her name. On October 8, Judge Wu sentenced her to two years’ probation and ordered her to pay $223,235 in restitution.

Mikayel Hovhannisyan, 38, of North Hollywood, pleaded guilty in June 2019 to one count of bank fraud, served a nine-month federal prison sentence and was ordered to pay $412,413 in restitution.

Aloyan, the case’s sole remaining defendant, is scheduled to go on trial in this matter on March 15, 2021.

The United States Secret Service, Homeland Security Investigations and the Glendale Police Department investigated this matter.

Assistant United States Attorneys Poonam G. Kumar of the Major Frauds Section and Victor A. Rodgers of the Asset Forfeiture Section prosecuted this case.

HOUSTON – A 20-year-old Houstonian is set to appear in federal court on charges of aiding and abetting interference with commerce by robbery, announced U.S. Attorney Ryan K. Patrick.

A federal grand jury returned the indictment against Xzavier Ivar Shephard Nov. 5. He is expected to make his initial appearance via video before U.S. Magistrate Judge Andrew M. Edison at 2 p.m. today.

Originally charged by criminal complaint, Shephard was believed to be involved in at least four armed robberies of postal letter carriers since June.

The charges allege a young male would approach letter carriers while engaged in the performance of their duties. He would allegedly display a gun and/or threaten force and demand their “arrow key.” An arrow key can be used to open banks of letter boxes such as ones found in apartment complexes, according to the charges. The mail in those boxes could then be taken.

The charges allege robbers would retreat to a black Buick automobile with paper plates and flee the scene. The vehicle was registered to Shephard, according to the charges.

If convicted, Shephard faces up to 25 years in federal prison as well as a mandatory minimum of seven years that must be served consecutively to any other prison term imposed.

U.S. Postal Inspection Service conducted the investigation. Assistant U.S. Attorney Richard D. Hanes is prosecuting the case.

EUGENE, OR – A girls softball coach in Eugene, Oregon was arrested last week for luring young girls and using a child in a sexually explicit manner.  Now, police think there might be more victims from the coach who coached teams in Eugene for the past five years.
Beginning in May 2020, detectives with the Washington County Sheriff’s Office Violent Crimes Unit began investigating allegations that a former softball coach was involved in luring underage girls.
Detectives learned 45-year-old Miguel Zepeda, of Sherwood, engaged in illegal text conversations with a teen girl. On November 6, 2020, detectives arrested Mr. Zepeda on a warrant for two counts of luring a minor and one count of attempting to use a child in a display of sexually explicit conduct. Mr. Zepeda was booked into jail where he posted bail and was released pending a future court date.
The investigation showed Mr. Zepeda coached softball teams in Eugene at least as far back as 2015, and the Eugene Police Department is assisting in this case.
Detectives believe there are additional victims, including in the Portland metro area.
If you have information about Mr. Zepeda or additional victims, please call the Washington County Sheriff’s Office at 503-846-2700.

LAKE WALES, FL – Earnest is going to jail.  No, it’s not the name of a new holiday movie coming to theaters this month, because well, movie theaters are closing down again across the country in the latest lockdown and this is actually a true story.   A man in Polk County took his eight year old son on a crime spree that involved grand theft auto, drugs, domestic violence and other serious major crimes.
“Earnest McKnight III has been to prison,” Polk County Sheriff’s Department said. “He’s committed a wide-variety of crimes (Possession of a Firearm by Convicted Felon, Domestic Violence, Loitering/Prowling, Narcotics, Resisting, Theft, and DWLSR). This isn’t what we call role-model behavior.”
According to police, in the past week, Ernest has committed a series of crimes in the Lake Wales area, and got himself arrested.
“For that, he is our criminal of the day…and also because he decided to take an eight-year-old boy along for some of the crimes,” the department said. “Why would he do that, any sane person would ask.
Well, Ernest told one of our detectives, “I was trying to toughen him up…I don’t want him to be soft.”
“Folks, if you would like to read that last part again, go ahead…we’ll wait as your brain cells calm down,” the department said. “From his misadventures over the last few days, Ernest can now add the following charges to the list.”
Burglary of an Occupied Dwelling (F2), Burglary of an Unoccupied Dwelling (F2), Burglary of Unoccupied Conveyance (F3), Grand Theft Motor Vehicle (F3), Tampering with Evidence (F3), Petit Theft (M1), and 3-counts of Contributing to the Delinquency of a Minor.
One of the crimes was the theft of a delivered package. About that theft, Ernest told the detective, “It was there for me to take.”

SEATTLE, WA – Gov. Jay Inslee today announced a four-week statewide set of restrictions in response to the recent rapid spread of the COVID-19 virus in Washington and across the country.

The new restrictions come as Washington sees consistent increasing daily case counts, with over 2,000 cases a day over the weekend and average cases in the state doubling over the past two weeks.

This spike puts us in a more dangerous a position as we were in March,” Inslee said during a press conference Sunday. “And it means, unfortunately, the time has come to reinstate restrictions on activities statewide to preserve the public’s well-being, and to save lives. These were very difficult decisions that have very real consequences to people’s livelihoods. I recognize that and don’t take those impacts lightly, but we must act now and act quickly to slow the spread of this disease.”

The restrictions are statewide and will take effect Monday, November 16 at 11:59 PM and will remain in effect until Monday, December 14. The modified restrictions of restaurants, however, will take effect Wednesday, November 18 at 12:01 AM.
