WHITE PLAINS, N.Y. — A Greenburgh firefighter was convicted Wednesday on two counts of third-degree assault for attacking his then-girlfriend during a domestic dispute inside their shared Dobbs Ferry apartment, the Westchester County District Attorney’s Office announced.

Joseph Apostoli, 46, a firefighter with the Fairview Fire Department, was found guilty in a non-jury trial before state Supreme Court Justice James McCarty. He was acquitted of second-degree assault, unlawful imprisonment, and criminal obstruction of breathing or blood circulation.

The assault took place on April 11, 2024, when Apostoli slammed the victim to the bedroom floor, carried her to the living room, and again threw her down before striking her in the head. The victim sustained significant injuries, including a rib fracture, a partially collapsed lung, and multiple bruises.

At the time of the incident, the victim, who is 4-foot-10 and weighs approximately 100 pounds, was physically overpowered by Apostoli, who stands 6-foot-2 and weighs nearly 300 pounds, according to prosecutors.

Victim testimony and upcoming sentencing

District Attorney Susan Cacace praised the victim for her courage throughout the legal process. “The victim in this case suffered immensely at the hands of Mr. Apostoli, and I am proud of her for summoning the bravery to share her story,” Cacace said in a statement.

The investigation was handled by the Westchester County Department of Public Safety. The case was prosecuted by Michelle Lopez, Chief of the Sex Crimes and Human Trafficking Bureau.
