ORDINANCE NO. 2025-39
ORDINANCE OF THE TOWNSHIP OF JACKSON, COUNTY
OF OCEAN, STATE OF NEW JERSEY, AUTHORIZING
SPECIAL EMERGENCY APPROPRIATION PURSUANT TO
N.J.S.A. 40A:4-53(i)
SECTION 1. Pursuant to N.J.S.A. 40A:4-53(i) the Township may authorize a Special
Emergency Appropriation to meet certain extraordinary expenses incurred for the mapping of
the Townships Stormwater Management System.
SECTION 2. Such an emergency appropriation authorizing “Special Emergency
Notes” and financing same must be provided for in succeeding annual budgets by the inclusion
of an appropriation of at least one-fifth of the amount authorized pursuant to this statute.
SECTION 3. The Township of Jackson is hereby authorized to issue a Special
Emergency Appropriation in the total amount of $437,800.00 for the mapping of the
Townships Stormwater System pursuant to N.J.S.A. 40A:4-53(i).
SECTION 4. This emergency appropriation shall be provided for in the budgets of the
next succeeding five (5) years by the inclusion of not less than one-fifth of the total amount
thereof and an emergency note, not in excess of the amount authorized pursuant to law, shall be
issued and executed by the Townships Chief Financial Officer and Mayor.
SECTION 5. If any section, subsection, sentence, clause, phrase or portion of this
ordinance is for any reason held to be invalid or unconstitutional by a court of competent
jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and
such holding shall not affect the validity of the remaining portions hereof.
SECTION 6. This Ordinance shall take effect after second reading and upon
publication, as required by and in conformance with law.

Township of Jackson held on the 16th day of October, 2025, and will be considered for second

day of October, 2025, at 6:30 p.m., at the Township Municipal Building, located at 95 West
Veterans Highway, Jackson, New Jersey, at which time and place any persons desiring to be
heard upon the same will be given the opportunity to be so heard.

ORDINANCE 2025-40
AN ORDINANCE OF THE TOWNSHIP OF JACKSON, COUNTY OF
OCEAN, STATE OF NEW JERSEY AMENDING AND SUPPLEMENTING
THE MUNICIPAL CODE OF THE TOWNSHIP OF JACKSON, SO AS TO
AMEND CHAPTER 244, ENTITLED “LAND USE AND DEVELOPMENT
REGULATIONS.” SO AS TO REVISE RESIDENTIAL DENSITY
STANDARDS IN THE HIGHWAY COMMERCIAL MIXED-USE ZONE
NOW, THEREFORE, BE IT ORDAINED, by the governing body of the Township of
Jackson, County of Ocean, State of New Jersey, as follows:
SECTION 1. The Township Code of the Township of Jackson is hereby amended and
supplemented so as to amend Chapter 244, entitled “Land use and Development Regulations,” so
as to amend subsection E(2). of 244-57.2, entitled “HCMU Highway Commercial Mixed-Use
Zone” as follows:
E. Residential use requirements.
(2) The maximum number of dwelling units, including affordable units, is four units
per net acre dedicated to residential use;
SECTION 2. All ordinances or parts of ordinances inconsistent herewith are hereby
repealed.
SECTION 3. If any section, subsection, sentence, clause, phrase or portion of this
ordinance is for any reason held to be invalid or unconstitutional by a court of competent
jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such
holding shall not affect the validity of the remaining portions hereof.
SECTION 4. This ordinance shall take effect after second reading and publication as
required by law.
