MINEOLA, N.Y. – After an hour of deliberation, a jury convicted Thomas DiNapoli, 70, of the murder of his wife and attempted murder of his brother-in-law in their Cord Lane residence in Levittown. The verdict was announced on Wednesday.
DiNapoli was found guilty of second-degree murder, second-degree attempted murder, and first-degree assault. He is set to return for sentencing before Judge Tammy Robbins on July 27, when he faces a potential maximum sentence of 50 years to life in prison.
On the evening of Thursday, August 13, 2020, an argument between DiNapoli and his wife, Cheryl DiNapoli, turned fatal when DiNapoli shot his wife twice in the face with a 9mm rifle. Cheryl’s younger brother, also residing at the home, entered the room and wrestled the gun away from DiNapoli. DiNapoli then retrieved a second weapon, a shotgun, from a safe in the garage, and shot his brother-in-law in the right arm.
The fight between the two men continued onto the front lawn of the house where the brother-in-law was able to disarm DiNapoli. Officers from the Nassau County Police Department arrived at around 11:49 p.m. and arrested DiNapoli.
Cheryl DiNapoli was declared deceased at the scene. The injured man was taken to the hospital, where he is recovering from his wounds.
