Charges Dismissed Against Former Philadelphia Police Officer in Fatal Shooting, DA to Appeal

PHILADELPHIA, PA – The District Attorney’s Office announced it will file an appeal following a Municipal Court judge’s decision to dismiss all criminal charges against former Philadelphia Police Officer Mark Dial. Dial was charged in connection to the fatal shooting of Eddie Irizarry last month.

Municipal Court Judge Wendy L. Pew dismissed the charges, including that of murder, against Dial for the incident that took place on August 14, 2023. In a statement, the District Attorney’s Office expressed its disagreement with the judge’s decision and confirmed that Special Investigations Unit prosecutors will be filing an appeal to the Court of Common Pleas by the end of the day.

The District Attorney’s Office reaffirmed its commitment to seeking justice in the case, stating it will move to have all criminal charges, including Murder, reinstated against Dial.
