Virginia Man Arrested for Involvement in U.S. Capitol Breach

WASHINGTON – John Michael Livingston, 51, from Midlothian, Virginia, has been arrested on multiple charges related to his involvement in the breach of the U.S. Capitol on January 6, 2021. This event interrupted a joint session of the U.S. Congress that was in the process of ascertaining and counting the electoral votes of the 2020 presidential election.

Livingston faces a felony charge of obstruction of an official proceeding and several misdemeanor charges. These include knowingly entering or remaining in any restricted building or grounds without lawful authority; disorderly or disruptive conduct in any restricted building or grounds; disorderly or disruptive conduct in a Capitol building, and parading, demonstrating, or picketing in a Capitol building.

The arrest was carried out by the FBI in Virginia, and Livingston is set to make his initial court appearance in the Eastern District of Virginia.

The case is being prosecuted by the U.S. Attorney’s Office for the District of Columbia and the Department of Justice National Security Division’s Counterterrorism Section, with assistance from the U.S. Attorney’s Office for the Eastern District of Virginia.

The FBI’s Richmond and Washington Field Offices led the investigation, supported by the U.S. Capitol Police and the Metropolitan Police Department.

Since the January 6 incident, over 1,265 individuals have been charged for related crimes across almost all 50 states, including more than 440 individuals facing felony charges for assaulting or impeding law enforcement. The investigation into the breach continues, with the FBI welcoming tips from the public.
