Cheektowaga Man Arraigned for Trespassing at Orchard Park Stadium Construction Site

ORCHARD PARK, NY – Adam T. McPherson, a 29-year-old resident of Cheektowaga, was arraigned before Orchard Park Town Court Justice Jorge S. DeRosas on a charge of Criminal Trespass in the Third Degree, a Class “B” misdemeanor.

The Erie County Sheriff’s Office deputies responded to a call near SUNY Erie South Campus on Sunday, September 17, 2023, at approximately 12:18 p.m., where McPherson allegedly entered the stadium construction site near Southwestern Boulevard in the Town of Orchard Park. After climbing a fence, he fell into an excavated area and was subsequently hospitalized at ECMC.

McPherson is set to reappear in court on Tuesday, February 27, for further proceedings and was released on his own recognizance. The offense, as charged, carries a maximum sentence of 60 days in jail.

In related cases, nine individuals have been similarly charged for trespassing at this site. Four cases have been resolved, with Matthew J. Evens, Owen Bainbridge, Tanner Brunet, and Mohammed H. Abdelhay receiving various sentences and community service orders.

Four cases remain pending, involving Kyle J. Bauer, Christopher A. McNeal, Jr., Daniel G. Wickemeyer, and Michael D. Poremski, while a case involving a 17-year-old from Williamsville is handled separately due to the individual’s age.
