PITTSFIELD, Mass. – Angel Nunez, 57, formerly of Troy, N.Y., pleaded guilty Tuesday to 15 indictments stemming from his involvement in an organized theft ring targeting Berkshire Bank locations last year.
Nunez admitted to attempting fraudulent withdrawals during three visits to Berkshire Bank branches on June 23, June 26, and July 10, 2023. He entered his plea in Berkshire Superior Court, where the Honorable Judge John Agostini presided over the case.
The Berkshire District Attorney’s Office requested a two-year sentence in the House of Corrections, while Nunez’s defense team sought house arrest, citing a severe medical condition. Judge Agostini sentenced Nunez to two years of straight probation, with the condition that he not commit any additional crimes.
Prosecutors revealed that Nunez’s medical condition was a key factor in the sentencing decision, as the House of Corrections lacks the facilities to provide the necessary level of care.
Nunez’s guilty plea and the unique sentencing underscore the challenges the criminal justice system faces in balancing punishment with medical and humanitarian considerations.
