Florida man charged in fatal shooting of stepson during domestic dispute over Fortnite

DAVENPORT, Fla. — A 43-year-old man has been charged with shooting and killing his adult stepson during a domestic altercation Wednesday evening that began after a child in the home was caught playing the video game Fortnite, according to police.

Kelly Garcia allegedly shot 26-year-old Azareel Martinez multiple times following an argument that erupted inside a Davenport residence shared by Garcia, his wife Adriane Daza, and her three children, including Martinez and two minors aged 9 and 11.

According to Davenport police, the incident began when the 9-year-old was found playing Fortnite, which his parents had forbidden. After being disciplined and having his cellphone confiscated, the child retrieved a 9 mm Smith & Wesson handgun from a bedroom nightstand. Garcia reportedly took the weapon from the boy.

Police say Martinez entered the room as tensions escalated, saw the child agitated, and began confronting Garcia. During the argument, Garcia allegedly shot Martinez multiple times in the chest and stomach. As Martinez attempted to flee, Garcia fired two additional rounds into his back, police said.

Victim died after being transported to hospital

Martinez collapsed and was taken to a local hospital, where he was pronounced dead. It is unclear if any of the other children witnessed the shooting, but all were present in the home at the time.

Authorities have not released specific charges against Garcia, but confirmed he is in custody. The case remains under investigation by local law enforcement.
