Daniel Penny charged for manslaughter in subway death of Jordan Neely

NEW YORK, NY – A 24-year-old male, Daniel Penny, has been arrested and charged with manslaughter following an ongoing investigation. The arrest was made on Friday, May 12, 2023, at approximately 8:05 am in the 5th Precinct.

The charges stem from an incident that occurred on Monday, May 1, 2023, at around 2:27 pm at the Broadway-Lafayette Street subway station. Several 911 calls reported an unconscious 30-year-old male on the floor of a northbound ‘F’ train.

Witnesses reported Neely was panhandling and harassing subway riders before Penny, a U.S. Marine put him in a choke hold, causing him to lose conciousness.

When officers arrived at the scene, they found a number of individuals standing around the victim. The officers began administering CPR, and the EMS transported the victim to Lenox Health Greenwich Village, where he was later pronounced dead.

Neely was identified as a homeless man by the NYPD.
