An Atlantic City man has been charged with murder in connection to a fatal shooting that occurred last month on the sidewalk outside a city apartment complex.

Kelsey Smith, 37, was arrested and charged with murder and unlawful possession of a weapon for the June 26 shooting of Robert Stanley Davis, 40, according to the Atlantic County Prosecutor’s Office. Smith was advised of the charges while in custody at the Atlantic County Justice Facility.

Police responded around 8:53 p.m. that Thursday to 225 N. Virginia Avenue after a 911 call reported a man lying on the sidewalk outside the Shore Park apartments. Officers arrived to find Davis unresponsive with a gunshot wound to the head.

He was pronounced dead at the scene shortly after.

An autopsy conducted by the Southern Regional Medical Examiner’s Office confirmed the cause of death as a gunshot wound and the manner of death as homicide.

Authorities did not release details on what led investigators to identify Smith as a suspect. No additional information about a motive or weapon has been disclosed.

“These charges are merely an accusation and not proof of guilt,” the Prosecutor’s Office said. “In all criminal cases, a charged defendant is presumed innocent unless and until proven guilty.”
