A state grand jury in Trenton, New Jersey, has decided not to file criminal charges against the officers involved in the fatal shooting of Mohamed Bounaouar, a 42-year-old man from Las Vegas, Nevada. The incident, which occurred on February 4, 2023, in Fort Lee, New Jersey, concluded after the grand jury’s deliberations on June 17, 2024.

The Office of Public Integrity and Accountability (OPIA) conducted the investigation into Mr. Bounaouar’s death, following the procedures established under the Independent Prosecutor Directive of 2019. The case presented included extensive evidence such as 911 recordings, body-worn camera footage, interviews, and forensic analysis.

According to the investigation, Fort Lee Police responded to a 911 call from a family member reporting that Mr. Bounaouar was acting aggressively and was armed with a knife. Officers attempted to negotiate with Mr. Bounaouar, who was reportedly throwing items and causing damage inside the residence. The situation escalated when Mr. Bounaouar, on his second-floor balcony and still armed, moved towards officers on a neighboring balcony.

Officer Emmanuel Espinal initially used a taser, and Detectives John Gallo and Stephen Domenick discharged their firearms. Despite this, Mr. Bounaouar approached officers while still holding the knife, prompting Officers Matthew Lyle and Gabriel Avella to also discharge their firearms, resulting in Mr. Bounaouar’s fatal injuries.

The grand jury’s decision reflects the findings that the officers acted within legal bounds during the incident. The OPIA highlighted that the presentation to the grand jury was conducted neutrally and transparently, adhering to established procedures to ensure objectivity and fairness.
