HANS VON SPAKOVSKY: Trump’s NY Prosecution Is a Bogus Case by a Bogus Prosecutor

There are many reasons why legal experts are questioning the legitimacy of the criminal prosecution of former President Donald Trump. But the major reason is that the main claim in Manhattan District Attorney Alvin Bragg’s case—that Trump’s $130,000 settlement payment of a potential claim by Stormy Daniels was a campaign-related expense—is totally bogus. Here’s a quick tutorial on why Bragg doesn’t have a legal leg to stand on—call it “Federal Campaign Finance Law for Dummies 101”—an apropos title, given what’s going on. Daniels claims that she had a sexual encounter with Trump in 2006, fully 10 years before the 2016 presidential election, which Trump denies. For

Department of Justice counselor to Smith, Michael Dreeben, went before the Supreme Court to argue presidents should not have constitutional immunity from prosecution for official acts conducted during their presidency. Dreeben suggested that no president until Trump has ever committed crimes when Supreme Court Justice Clarence Thomas questioned him about no other president having faced prosecutions. “Over the not-so-distant past … certain presidents have engaged in

JAY TOWN: New York’s Prosecution Of Trump Is The Perfect Lawfare Prosecution—And Anything But Perfect

Imagine for a moment the design of the perfect lawfare prosecution. Such would necessitate the intersection of legal ambiguity and ethical murkiness. It would require the perfect combination of an ambitiously sloppy district attorney, morally casual witnesses, an absence of real victims, and a compromised judge. The assembly of any two of these pieces would be extraordinary in our justice system. Completing the puzzle would be devastating to it. Specifically, the perfect lawfare prosecution would first need a weak, but ambitious, prosecutor. Think a Harvard guy in a bad suit. The DA would have a history of exercising prosecutorial discretion
