ALBUQUERQUE, N.M. – Alexander M.M. Uballez, United States Attorney for the District of New Mexico, announced today that Kyle Aguilar pleaded guilty to abusive sexual contact of a minor in Indian Country. Aguilar, 40, of San Felipe, New Mexico, and an enrolled member of the San Felipe Pueblo, will remain in custody pending sentencing, which has not been scheduled.
According to the plea agreement, between Oct. 2, 2016, and Feb. 13, 2017, Aguilar engaged in abusive sexual contact with a victim who was between 12 and 16 years old. The victim is an enrolled member of the San Felipe Pueblo and the abuse occurred on the San Felipe Pueblo.
By the terms of the plea agreement, Aguilar faces up to four years in prison, and he must register as a sex offender.
The Bureau of Indian Affairs investigated this case. Assistant United States Attorneys Nicholas J. Marshall and Brittany DuChaussee are prosecuting the case as part of Project Safe Childhood, a nationwide initiative launched in May 2006 by the Department of Justice (DOJ) to combat the growing epidemic of child sexual exploitation and abuse. Led by United States Attorneys’ Offices and DOJ’s Criminal Division’s Child Exploitation and Obscenity Section, Project Safe Childhood marshals federal, state and local resources to better locate, apprehend and prosecute individuals who exploit children via the Internet, as well as to identify and rescue victims.
