No Criminal Charges Filed in 2021 Trenton Police Involved Scooter Crash Death

TRENTON, NJ – On Monday, a state grand jury decided not to file any criminal charges in connection with the 2021 death of Francis Delacruz Abad, 21, of Trenton.

Abad was injured in a crash on May 25, 2021, while attempting to evade Hamilton Township Police Detective Brian Davis. Abad collided with a third-party vehicle, sustaining injuries that led to his death two days later.

The Attorney General’s Office of Public Integrity and Accountability (OPIA) conducted a thorough investigation of the crash. The evidence was presented to a state grand jury, which, following deliberation, concluded that Detective Davis did not violate any law in connection with the fatal crash.


The decision not to file any criminal charges was announced by Director Thomas Eicher of the OPIA.

Davis had attempted to pull over Abad after noticing him driving a scooter erratically without a helmet. According to witnesses and video footage, Abad accelerated and attempted to flee, leading to the fatal collision. The Attorney General’s Office expressed their condolences to the Abad family.
