No Charges Filed Against Officer in Deadly Shooting of Daniel Ackley

TRENTON, NJ – The Attorney General’s Office of Public Integrity and Accountability (OPIA) announced that a state grand jury has chosen not to indict Officer Timothy Rehmann of the Millville Police Department.

The decision comes after the grand jury’s careful consideration of the events leading to the death of Daniel Ackley, 33, of Millville, who died from injuries sustained when Officer Rehmann shot him on January 4, 2022.

The comprehensive investigation included witness interviews, the evaluation of body-worn camera footage, and the review of autopsy results from the medical examiner. The grand jury took all of this evidence into account before concluding its deliberations on Monday. The decision resulted in a “no bill” ruling, indicating that the grand jury did not find sufficient grounds for criminal charges against Officer Rehmann.

According to the investigation, the shooting occurred shortly after 9:30 p.m. on January 4, 2022, outside a residence on Burns Road in Millville. The Millville Police Department had responded to a 9-1-1 call regarding an emergency at the address. Officers found Mr. Ackley wielding a machete outside the house. Despite commands to drop the weapon, Mr. Ackley advanced towards the officers, leading Officer Rehmann to discharge his service weapon.

The body-worn camera footage corroborates that Mr. Ackley was advancing with the machete when he was shot. Medical personnel at the scene provided immediate first aid, but Mr. Ackley was later pronounced dead at Cooper University Hospital at 10:56 p.m.
