BRONX, NY — Miguel Diaz, 40, faces charges of firing a weapon outside a Bronx deli and illegal ammunition possession after a prior felony conviction. Diaz was arrested today and presented before U.S. Magistrate Judge Katharine H. Parker.

On October 4, 2023, around 6:00 p.m., surveillance video captured Diaz approaching a victim from behind at the corner of Edward L. Grant Highway and Jesup Avenue. Diaz fired a shot, wounding the victim in the arm, before fleeing the scene. NYPD officers later recovered a 9mm FC Luger shell casing from the location.

U.S. Attorney Damian Williams stated that Diaz, previously convicted of reckless endangerment, acted recklessly and violently. NYPD Commissioner Edward A. Caban highlighted the ongoing battle against gun violence despite a 26 percent reduction in city shootings this year.

Diaz was released from state custody on June 1, 2023, after nearly five years in prison for reckless endangerment. The Bronx shooting occurred four months after his release.

Diaz is charged with possession of ammunition after a felony conviction, carrying a maximum sentence of 15 years in prison.
