West Babylon Teen Was Using Phone, Driving When He Killed 63-Year-Old Man

SUFFOLK COUNTY, NY – Suffolk County District Attorney Raymond A. Tierney has announced the indictment of Nicolas Apostolides, 18, of West Babylon, for the death of 63-year-old David Martinez.

The indictment includes charges of second-degree manslaughter and related offenses, following a collision in April.

On April 16, at approximately 5:35 am, Apostolides, allegedly distracted by his cell phone and speeding, ran a red light on Straight Path in West Babylon, colliding with Martinez’s vehicle.


The crash, captured on surveillance video, resulted in Martinez’s death at Good Samaritan University Hospital.

Apostolides was arraigned on Friday, before Acting Supreme Court Justice Richard I. Horowitz. The charges include manslaughter in the second degree, reckless endangerment, and reckless driving.
