Ordinance 2025-19  AN ORDINANCE OF THE TOWNSHIP OF JACKSON, COUNTY OF OCEAN, STATE OF NEW JERSEY, AMENDING AND SUPPLEMENTING CHAPTER 185 OF THE TOWNSHIP CODE OF THE TOWNSHIP OF JACKSON, ENTITLED “EXCAVATIONS, MINING, AND DREDGING” AS TO AMEND §185-2(A) AND §185-2(E) ENTITLED, “APPLICATION, LICENSING,” AND §185-6(A) ENTITLED, “BOND,”

NOTICE IS HEREBY GIVEN that the aforementioned ordinance was adopted after public hearing during a Regular meeting of the Township Council of the Township of Jackson held on  June 12, 2025 at Jackson Township Municipal Building, located at 95 W Veterans Highway, Jackson, New Jersey.

ORDINANCE 2025-22

CALENDAR YEAR 2025 ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND TO ESTABLISH A CAP BANK  (N.J.S.A. 40A: 4-45.14)

WHEREAS, the Local Government Cap Law, N.J.S. 40A: 4-45.1 et seq., provides that in the preparation of its annual budget, a municipality shall limit any increase in said budget up to 2.5% unless authorized by ordinance to increase it to 3.5% over the previous year’s final appropriations, subject to certain exceptions; and,

WHEREAS, N.J.S.A. 40A: 4-45.15a provides that a municipality may, when authorized by ordinance, appropriate the difference between the amount of its actual final appropriation and the 3.5% percentage rate as an exception to its final appropriations in either of the next two succeeding years; and,

WHEREAS, the Mayor & Council of the Township of Jackson in the County of Ocean finds it advisable and necessary to increase its CY 2025 budget by up to 3.5% over the previous year’s final appropriations, in the interest of promoting the health, safety and welfare of the citizens; and,

WHEREAS, the Mayor & Council hereby determines that a 1% increase in the budget for said year, amounting to $480,256.79 in excess of the increase in final appropriations otherwise permitted by the Local Government Cap Law, is advisable and necessary; and,

WHEREAS the Mayor & Council hereby determines that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years.

NOW THEREFORE BE IT ORDAINED, by the Mayor & Council of the Township of Jackson, in the County of Ocean, a majority of the full authorized membership of this governing body affirmatively concurring, that, in the CY 2025 budget year, the final appropriations of the Township of Jackson shall, in accordance with this ordinance and N.J.S.A. 40A: 4-45.14, be increased by 1%, amounting to $480,256.79, and that the CY 2025 municipal budget for the Township of Jackson be approved and adopted in accordance with this ordinance; and,

BE IT FURTHER ORDAINED, that any that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years; and,

BE IT FURTHER ORDAINED, that a certified copy of this ordinance as introduced be filed with the Director of the Division of Local Government Services within 5 days of introduction; and,

BE IT FURTHER ORDAINED, that a certified copy of this ordinance upon adoption, with the recorded vote included thereon, be filed with said Director within 5 days after such adoption.

NOTICE IS HEREBY GIVEN that the foregoing ordinance was introduced and passed by the Township Council on first reading at a meeting of the Township Council of the Township of Jackson held on the 12th day of June, 2025, and will be considered for second reading and final passage at a regular meeting of the Township Council to be held on the 24th day of June, 2025  at 6:30 p.m., at the Township Municipal Building, located at 95 West Veterans Highway, Jackson, New Jersey, at which time and place any persons desiring to be heard upon the same will be given the opportunity to be so heard.

TOWNSHIP OF JACKSON

ORDINANCE 2025-23

AN ORDINANCE OF THE TOWNSHIP OF JACKSON, COUNTY OF OCEAN, STATE OF NEW JERSEY, AMENDING AND SUPPLEMENTING CHAPTER 380 OF THE TOWNSHIP CODE OF THE TOWNSHIP OF JACKSON, ENTITLED “TAXICABS, LIMOUSINES AND JITNEYS” AS TO AMEND §380-33 ENTITLED, “LICENSES,”

NOW, THEREFORE, BE IT ORDAINED, by the governing body of the Township of

Jackson, County of Ocean, State of New Jersey, as follows:

SECTION 1. The Township Code of the Township of Jackson is hereby amended and supplemented so as to amend Chapter 380, entitled “Taxicabs, Limousines and Jitneys,” to amend §380-33 entitled, “Licenses” to read in its entirety as follows:

Pursuant to N.J.S.A. 48:16-22.3a, every applicant for a limousine license shall be fingerprinted by the New Jersey State Police in the Department of Law and Public Safety or by agents appointed by or under contract to the division and shall also provide written consent to the performance of a criminal history record background check unless the applicant was previously fingerprinted and had a criminal history background check conducted as part of an application for a Commercial Driver License or a passenger endorsement under a Commercial Driver License or both, pursuant to N.J.S.A. 48:16-22.3a(b). The applicant shall bear the cost of fingerprinting and the cost for the background checks, including all costs of administering and processing the checks.

After such information is received from either the New Jersey State Police in the Department of Law and Public Safety or by agents appointed by or under contract to the division, the Chief of Police or, in his or her absence, the person in charge of said Police Department, shall furnish the Township Council, in a timely fashion, with any information obtained from any source concerning said applicant or applicants. No license shall be granted to any applicant until the Township Council is satisfied that the applicant does not have any criminal record or reputation which would render the applicant unfit to have such license in accordance with N.J.S.A. 48:16-22.3a(d)(1).

The Clerk, upon filing of the required insurance policy and payment of an annual license fee of $50 for each limousine service, plus $10 for each limousine which is covered under the required insurance policy, shall issue a license in compliance with N.J.S.A. 48:16-17. Said license shall be paid for the year ending on the 31st day of March. The original license, or a copy thereof, shall be retained within the limousine, along with the insurance information required by N.J.S.A. 48:16-17, and be available for inspection by any law enforcement officer.

SECTION 2. All ordinances or parts of ordinances inconsistent herewith are hereby repealed. 

SECTION 3. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held to be invalid or unconstitutional by a Court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions hereof.

SECTION 4. This ordinance shall take effect after second reading and publication as required by law.
