ALBANY, NY – Assemblymember William Magnarelli has introduced Assembly Bill A08399, which would permit volunteer fire companies, ambulance services, and nonprofit organizations to solicit donations on low-speed state highways outside of cities and villages, provided the local town has not passed a law prohibiting it.
The legislation amends Section 1157 of the New York Vehicle and Traffic Law to allow individuals aged 18 or older to collect donations on highways where the speed limit does not exceed 30 miles per hour. Current law only authorizes solicitation within cities and villages, making similar activities in smaller towns technically illegal.
Magnarelli said the change would help community organizations fundraise safely and effectively without running afoul of outdated restrictions. Fire departments and rescue squads often rely on such roadside fundraising efforts to support equipment, training, and operations.
Under the proposal, towns would retain local control and could opt out by enacting their own prohibition.
Supporters note the measure has passed the Assembly multiple times in prior sessions and has repeatedly cleared the Senate Transportation Committee.
The bill carries no fiscal impact on the state and would take effect immediately upon becoming law.
