INDIANAPOLIS, IN – David Wagner, 50, has been arrested and charged with multiple offenses, including two counts of rape and one count of sexual battery, following an alleged assault in a victim’s home. The incident, which reportedly involved Wagner instructing a smart device to turn off the lights during the attack, has drawn significant attention.
The charges against Wagner include two counts of rape when the victim has verbally or otherwise refused, one count of sexual battery where the victim is compelled to submit by force or imminent threat, and one count of battery resulting in bodily injury, as per court records.
The Daily Journal reports that the Indiana Metropolitan Police Department responded to a call on October 13, where the female victim reported being raped in her home. The alleged incident occurred on the night of October 11, after she had invited Wagner for dinner to get to know each other.
According to the victim, Wagner made unwanted advances, including an attempt to kiss her and a request for her to touch him, both of which she refused. Despite agreeing to let Wagner stay the night under the condition of no sexual activity, he allegedly expressed a continual desire for sexual relations. The victim reported that Wagner then assaulted her, including grabbing her throat to restrict breathing, forcibly removing her clothing, and performing sexual acts without her consent.
This case highlights the increasing concerns regarding sexual violence and the misuse of technology in such incidents. The legal proceedings are ongoing, and the community is left to grapple with the serious implications of such actions.
