ROCHESTER, NY –  Last night in Buffalo, the snow was bright and white.   A criminal out on bail for another burglary he committed this summer who robbed a beloved local deli unfortunately was not. A man who broke into Calabresella’s  overnight and robbed the deli was caught nearby after police followed his footprints in the snow.

Gates police say Miguel Escalante, 45, of Rochester was arrested around 12:30am this morning for breaking into Calabresella’s New York Style Deli on Buffalo Rd. An alert Sergeant on the night shift while on routine patrol observed the front door glass broken on the business and footprints leaving the area in the snow. The area was checked by other officers and located Mr. Escalante walking along Buffalo Rd. by the City boarder with stolen money in his pocket.

He was charged with Burglary 3rd, Criminal Mischief 3rd and Petit larceny. He was issued an Appearance ticket and transported home by our officers.  He was arrested in June for breaking into a Gas Station in the city and remains free pending his trial.

The Gates Police department expressed their frustrations over the relaxed criminal justice system in New York that allows criminals like Escalante to roam free on the street with no real punitive actions for his crimes.

“This can be very frustrating for business owners who are victimized repeatedly. It is also dangerous for the perpetrator whose life continues on the down spiral with no intervention services,” the department said.
