Illegal Alien Convicted of Sexual Assault in New York City Removed by ICE

NEW YORK — U.S. Immigration and Customs Enforcement (ICE) has arrested an undocumented Ecuadorian national convicted of sex abuse, the agency announced.

Kail Sebastian Cardenas Aguirre, 27, was taken into custody on February 3 by ICE Enforcement and Removal Operations (ERO) officers in New York City. Cardenas had been convicted on January 13 of third-degree sex abuse: subjecting another person to sexual contact without consent and was sentenced to conditional discharge.

According to ICE, Cardenas entered the U.S. as a nonimmigrant on May 15, 2021, through New York but violated the terms of his admission.

He was arrested by the New York City Police Department on March 9, 2023, and initially charged with sexual assault: carnal abuse before being convicted of the lesser charge.

“ICE places a high priority on identifying, arresting, and removing alien offenders who pose a threat to public safety and national security,” said ICE ERO New York City acting Field Office Director William P. Joyce.

Cardenas is currently in ICE custody pending removal.
