Illegal Migrant Convicted of Killing Baby Tossing into Dumpster in New York City

NEW YORK — Maria Oliva Guaman, a 33-year-old Ecuadorian citizen unlawfully present in the United States, was arrested by Enforcement and Removal Operations (ERO) New York City officers on March 15. Guaman was taken into custody without incident by officers from the Newburgh sub-office, immediately following her release from the New York State Department of Corrections. She is currently detained without bond, pending removal proceedings.

Kenneth Genalo, the ERO New York City Field Office Director, highlighted the gravity of Guaman’s crime, stating, “The absolute heinous nature of the crime cannot be overstated as this woman strangled her newborn baby to death and tossed him in a dumpster.” ERO NYC intends to pursue Guaman’s removal to Ecuador.

Guaman previously entered the United States unlawfully on an unspecified date, without undergoing inspection by immigration officials.

She was removed to Ecuador on January 14, 2009, following an expedited removal order. However, she later re-entered the U.S. unlawfully.

On December 10, 2013, the Spring Valley Police Department arrested Guaman for murder, leading to her conviction by the Rockland County, New York Supreme Court for felony manslaughter on September 15, 2014. She was sentenced to 12 years in prison. Additionally, on April 8, 2014, Guaman was convicted by the United States District Court in White Plains, New York, of illegal reentry and sentenced to time served.
