New Jersey Racetrack Smoking Ban Could Soon Allow Cigar Nights

TRENTON, NJ – New Jersey legislators have introduced a bill that proposes an exemption to the state’s indoor smoking ban, specifically for racetracks and off-track wagering facilities. This exemption aims to allow these venues to host “cigar nights” in controlled areas, limited to no more than five events annually per facility.

The amendment to P.L.2005, c.383 (C.26:3D-59), seeks to balance public health concerns with cultural and recreational activities associated with cigar smoking. The bill outlines specific criteria for establishments to qualify for this exemption, including a threshold for annual gross income derived from tobacco sales and humidor rentals. It also delineates the scope of permissible areas for smoking within certain entertainment venues, including casinos and simulcast facilities.

Furthermore, the legislation introduces measures to ensure that these exemptions do not compromise overall public health efforts. It specifies that the exemptions apply only to areas within venues that meet strict criteria and are approved for specific events. The bill also reinforces the registration requirements for cigar bars and lounges, emphasizing the need for compliance with health regulations.
