# Utica man charged after gunfire reported in two August confrontations

UTICA, N.Y. — Police charged a 41-year-old Utica man Tuesday after investigators linked him to two shootings reported hours apart in August, including one in which bullets struck a home.

No injuries were reported.

Officers first responded to the 600 block of Eagle Street at about 11:50 p.m. Aug. 19. A man told police that someone he knew pulled out a handgun during an argument and fired a shot near his head before fleeing.

Police received another report of gunfire at about 6:40 a.m. Aug. 20 near the 1200 block of St. Vincent Street. The first victim and another person were sitting on a porch when the same alleged gunman emerged from between two houses and fired at them, police said.

The shots missed both people but damaged a nearby home.

Investigators with the Utica Police Department’s GIVE Unit reviewed video and physical evidence before identifying Diandre Scott as the suspect, according to police.

GIVE investigators, Utica tactical officers and Oneida County sheriff’s deputies found Scott on Eagle Street on Sept. 2. Police said officers took him into custody without incident.

Scott faces two counts each of attempted first-degree assault, second-degree criminal possession of a weapon, third-degree criminal possession of a weapon and criminal possession of a firearm.
