BOSTON, MA – A New Hampshire woman has filed a lawsuit against the Italian food emporium Eataly in Boston, claiming that negligence in floor maintenance led to her slipping on a piece of prosciutto and fracturing her left ankle.
Alice Cohen and her husband Ronald, of Gilford, New Hampshire, were visiting Eataly on Oct. 7 last year when the incident occurred. According to the lawsuit filed on Friday in Suffolk Superior Court in Boston, Cohen slipped on the thinly sliced cured ham and sustained injuries, including “a loss of enjoyment of life, pain and suffering.”
The medical expenses, encompassing a hospital visit and physical therapy, have resulted in more than $7,500 in bills. The couple is seeking a jury trial and at least $50,000 in damages.
The lawsuit argues that Eataly failed to maintain the premises in a reasonably safe condition and warn of any hazardous conditions. Additionally, it claims a loss of consortium.
Eataly is a renowned gourmet Italian restaurant and food market, boasting eight U.S. locations and eight overseas locations. The company has not yet publicly responded to the lawsuit, according to an AP report.
