Pennsylvania Attorney General Secures Settlement Over Unlawful Telemarketing

HARRISBURG, PA — Attorney General Michelle Henry has settled with Titan Gas, LLC, a Texas-based energy company doing business as CleanSky Energy, over alleged violations of a previous agreement related to the Pennsylvania ‘Do-Not-Call’ registry.

The settlement resolves issues arising from 2.7 million telemarketing calls made to Pennsylvanians since a 2019 agreement, which prohibited such calls to individuals listed on the ‘Do-Not-Call’ registry. The Attorney General’s office claimed that Titan Gas employed deceptive lead generation tactics to obtain consumer “consent” for these calls, violating the earlier settlement and consumer protection laws.

Under the new agreement, Titan Gas will pay $160,000 in civil penalties and $35,000 in costs.

Additionally, the company is required to submit a compliance report detailing their adherence to the original settlement and consumer protection statutes.

Attorney General Henry emphasized the importance of respecting consumer privacy, stating that this settlement warns other telemarketers about the consequences of disregarding legal restrictions on telemarketing practices.

A portion of the civil penalties from the settlement will be remitted to consumers who lodged complaints against the company’s allegedly unlawful calls.

To further protect themselves from unsolicited calls, Pennsylvanians are encouraged to register their phone numbers on the state’s Bureau of Consumer Protection’s Do-Not-Call List and the Federal Trade Commission’s National Do-Not-Call Registry. Consumers should also be vigilant when providing contact information online to avoid unintentionally subscribing to telemarketing lists.

The Consent Order, filed by Deputy Attorney General Mark Wolfe, awaits final approval from the Dauphin County Court of Common Pleas to become effective.
