DWI Arrest Warrants for Man Found Asleep in Vehicle on Bay Avenue in Toms River

TOMS RIVER, NJ – Omar Perez-Gutierrez was arrested in Toms River after being found asleep at the wheel of his running vehicle, which was stopped in the right lane of travel on Bay Avenue. The incident led to charges of driving while intoxicated (DWI) and refusal to provide breath samples.

Upon discovery, Perez-Gutierrez exhibited clear signs of intoxication. However, he was uncooperative during the Standardized Field Sobriety Tests (SFSTs), claiming to not understand instructions in both English and Spanish. After his arrest and subsequent refusal to provide breath samples at District One (D1), he was additionally charged with refusal.

During the processing phase, and after confirming his identity, authorities discovered that Perez-Gutierrez had two active arrest warrants: one for $550 from Howell and another for $450 from Tinton Falls. This compounded his legal troubles as he now faces multiple charges stemming from the DWI incident and previous legal issues.

The case highlights the importance of vigilance in monitoring public roads and enforcing DWI laws to ensure community safety.
