TRENTON, N.J. – The U.S. Supreme Court is hearing oral arguments in two cases this week that could have sweeping implications for transgender rights in sports and beyond, prompting concern from advocacy organizations across the country.

Garden State Equality, a New Jersey–based LGBTQ+ advocacy group, released a statement Monday emphasizing that sports have long been more than just competition — they represent community, teamwork, and inclusion.

The group warned that the cases before the court, centered on whether transgender girls can participate on girls’ sports teams, could lead to broader rollbacks of civil rights protections if the justices rule to restrict participation.

The organization argued that while the legal disputes focus on athletics, the broader issue concerns the right of transgender and gender-diverse individuals to live freely and equally in public life. “The court risks further empowering a national and coordinated effort to push trans and gender diverse people out of public life altogether,” the statement read, warning that such rulings could undermine civil rights protections for all LGBTQ+ Americans.

Today, the Supreme Court is hearing arguments in two cases that confirm what we’ve always known: sports, just like transgender people’s rights, are more than a game.

Sports, especially for young people, have always been an avenue to be part of something bigger. Whether it’s through school, local leagues, or pickup games with friends, sports are one of the simplest, most accessible ways for all of us to find community, to be part of a team.

And, they teach us from a young age that when we work hard and work together, we win. That’s why these cases, and fighting for the T in our Team, is so important today.

While the issues in these cases are focused on the right of trans girls to play sports with their friends, the court risks further empowering a national and coordinated effort to push trans and gender diverse people out of public life altogether and, in the process, potentially undermining civil rights protections for all LGBTQ+ people.

And as we know, extremist politicians never stop at stripping lived and legal equality away from one group. The laws at issue limit the freedom of everyone to be ourselves. They’ve already led to the harassment of non-trans and intersex athletes, particularly Black women and girls, and normalize that kind of unacceptable treatment off the field.

Garden State Equality also linked the debate to a wider pattern of political efforts aimed at limiting equality laws. The statement cited prior legislation that has led to harassment of both trans and non-trans athletes, particularly Black women and girls, and criticized attempts to normalize exclusionary behavior in sports environments.

The Supreme Court’s decisions in these cases are expected to set a precedent affecting school athletic programs and civil rights policies nationwide, making them among the most closely watched cases of the current term.

The group has also been at the center of a child endangerment case invovling its former executive director.

Justin Christian Fuscarino, a longtime New Jersey LGBTQ activist and former executive director of Garden State Equality, resigned from his position in December 2025 following his arrest on charges of child endangerment and assault. Fuscarino, who led the state’s most prominent LGBTQ advocacy group since 2016 and previously founded The Pride Network, was regarded as an influential voice in local and national equality movements.

Authorities in Neptune City, NJ, allege that on November 9, 2025, Fuscarino physically assaulted a foster child in his care — an incident reportedly captured on home security video. He was arrested on November 21 and charged with one count of second-degree endangering the welfare of a child and two counts of simple assault.

The allegations were made public nearly a month later, prompting Garden State Equality to place Fuscarino on leave; he resigned later that day.

Fuscarino has denied wrongdoing, characterizing the matter as a private family situation, while his attorney described it as a “difficult personal family moment” that resulted in no physical harm. The case remains ongoing as Fuscarino prepares to address the charges in court.
