Howard L Zimmerman professional malpractice suit dropped at landmark condo complex

New York, NY – A Manhattan appeals court has upheld the dismissal of a professional malpractice and negligent misrepresentation lawsuit filed by the Board of Managers of the Cipriani Club Residences at 55 Wall Condominium against architect Howard L. Zimmerman, finding the claims were brought years after the legal deadline expired.

The Appellate Division, First Department, on September 26 affirmed a lower court ruling by Justice Dakota Ramseur that granted Zimmerman’s motion to dismiss the board’s claims as untimely. The dispute stemmed from the board’s allegations that Zimmerman and his firm, Howard L. Zimmerman Architects & Engineers DPC, were responsible for design or oversight issues related to renovation work at the landmark condominium property.

According to court documents, Zimmerman’s direct involvement in the project ended on October 19, 2016, when he last signed an invoice connected to the renovation. The condominium board did not initiate its lawsuit until January 31, 2022—more than five years after that date—placing the claims well outside the three-year statute of limitations for professional malpractice under New York law.

The panel of Justices Manzanet-Daniels, Friedman, Kapnick, Shulman, and Pitt-Burke unanimously agreed that the board failed to show that Zimmerman continued to perform professional duties beyond 2016. The court rejected the board’s argument that the continuous representation doctrine should extend the limitations period, noting that the complaint alleged no ongoing personal involvement by Zimmerman or continuing work under the original agreement.

The ruling also dismissed the negligent misrepresentation claim as time-barred, citing precedents that place such actions under the same three-year limitations period when they arise from professional services.

In affirming the dismissal, the court concluded that speculation about potential evidence uncovered through discovery could not overcome the statute of limitations bar.

The decision leaves the Cipriani Club Residences board without recourse against Zimmerman personally, although litigation involving his architectural firm remains separate.

The appeals court found the Cipriani condo board’s malpractice and misrepresentation claims against architect Howard L. Zimmerman were filed too late to proceed.
