Illegal immigrant arrested by ice in virginia on incest and sexual battery charges after release from local jail

HERNDON, VA. — A 25-year-old Honduran national illegally present in the United States was arrested last week in Falls Church on charges of incest and aggravated sexual battery involving a minor, U.S. Immigration and Customs Enforcement (ICE) announced.

Marvin Mateo-Alberto was taken into custody on April 10 by agents from ICE Enforcement and Removal Operations (ERO) Washington, D.C., working in coordination with the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), the U.S. Department of State’s Diplomatic Security Service (DSS), and the Virginia State Police (VSP).

Mateo-Alberto faces charges of incest and aggravated sexual battery involving a child aged 13 to 17. The Fairfax County Police Department had initially arrested him on January 1 on those charges, but the Fairfax County Adult Detention Center released him on January 16 despite an ICE immigration detainer.

“Marvin Mateo-Alberto stands accused of some very appalling and disturbing crimes and represents a threat to the children of our Virginia communities,” said ERO Washington, D.C. Field Office Director Russell Hott. “ICE Washington, D.C. will continue to prioritize public safety by arresting and removing criminal alien threats from our streets.”

According to ICE, Mateo-Alberto first entered the U.S. illegally on October 17, 2005, near Eagle Pass, Texas, and was ordered removed by a Department of Justice immigration judge on April 5, 2006. ICE records indicate he had remained unlawfully in the country since.
