New York needs more state funding for school districts facing influx of migrant students

ALBANY, NY – A bill introduced by Assemblymember Marianne Buttenschon would require the state to reimburse school districts for additional expenses incurred due to a sudden influx of migrant students.

The measure, Assembly Bill A01041, adds a new Section 3605 to the Education Law directing the state to provide supplemental funding to cover actual costs tied to new migrant student enrollment. Eligible expenses could include hiring additional teachers and staff, expanding classroom space, and providing language and support services.

Under the bill, the Governor would be required to submit chapter amendments to the state’s Aid to Localities Budget within 30 days of the start of each school year, ensuring affected districts receive timely reimbursement. Districts seeking funds would file certified vouchers detailing their expenditures, which would then be audited and paid by the state.

Buttenschon said the proposal is meant to ensure that local taxpayers are not forced to shoulder unexpected costs linked to changing student populations.

If enacted, the law would take effect immediately.
